The government of the Russian Federation decides:

1. Approve the enclosed Rules for apportionment between participants of foreign trade activity of amount of the tariff quota concerning separate types of whey and modified whey, in powder, granules or in other firm types, without addition of sugar or other edulcorant substances (codes 0404 10 120 1 and 0404 10 160 1 CN FEA EEU), the Board of the Eurasian economic commission established by the decision of October 7, 2025 No. 89 "About establishment for 2026 of the tariff quotas concerning separate types of the agricultural goods imported on customs area of the Eurasian Economic Union and also amounts of the tariff quotas concerning these goods imported in the territory of state members of the Eurasian Economic Union" for 2026.

2. To the Ministry of Economic Development of the Russian Federation no later than December 19, 2025:

a) distribute amount of the tariff quota established for 2026 by the decision of Board of the Eurasian economic commission of October 7, 2025 No. 89 "About establishment for 2026 of the tariff quotas concerning separate types of the agricultural goods imported on customs area of the Eurasian Economic Union and also amounts of the tariff quotas concerning these goods imported in the territory of state members of the Eurasian Economic Union" concerning separate types of whey and modified whey in powder, granules or in other firm types without addition of sugar or other edulcorant substances (further - whey) (codes 0404 10 120 1 and 0404 10 160 1 CN FEA EEU), according to the calculation provided by Items 2 and 3 of the Rules approved by this resolution between participants of foreign trade activity performing import to the Russian Federation of whey (codes 0404 10 120 and 0404 10 160 of the CN FEA EEU) from January 1, 2013 to December 31, 2015 according to customs procedure of release for internal consumption, in proportion to the whey amounts (codes 0404 10 120 and 0404 10 160 of the CN FEA EEU) imported from January 1, 2013 to December 31, 2015 according to customs procedure of release for internal consumption, except for the whey (codes 0404 10 120 and 0404 10 160 of the CN FEA EEU) occurring and imported from the State Parties of the Commonwealth of Independent States;

b) post on the official site of the Ministry of Economic Development of the Russian Federation on the Internet and provide data on the amount of the tariff quota distributed according to the subitem "an" of this Item between participants of foreign trade activity to the Ministry of Industry and Trade of the Russian Federation.

3. To the Ministry of Industry and Trade of the Russian Federation to perform from December 24, 2025 to December 31, 2026 issue to participants of foreign trade activity of import licenses of whey (codes 0404 10 120 1 and 0404 10 160 1 CN FEA EEU) within the amount of the tariff quota distributed according to Item 2 of this resolution.

4. The decision on issue of licenses, the stipulated in Item 3 presents of the resolution, or on refusal in their issue is accepted by the Ministry of Industry and Trade of the Russian Federation within 15 working days from the date of giving in accordance with the established procedure by the participant of foreign trade activity of the corresponding statement.

Effective period of the specified licenses is established from the date of their issue (but not earlier than January 1, 2026) till December 31, 2026.

5. Represent to the Federal Customs Service:

a) in the Ministry of Economic Development of the Russian Federation and the Ministry of Agriculture of the Russian Federation not later than in 39 days after the termination of each month under report (starting with the report for January, 2026) - data on whey amounts (codes 0404 10 120 and 0404 10 160 of the CN FEA EEU) imported into the Russian Federation in month under report and the accruing result since the beginning of year;

6. This resolution becomes effective from the date of its official publication.
