Based on part (3) Article 12 and Item c) parts (2) article 60 of the Law No. 227/2022 on industrial emissions (The official monitor of the Republic of Moldova, 2022, Art. No. 326-333, 628), with subsequent changes, DECIDES: the Government

1. Approve:

1.1. Methodology of calculation of cost of complex nature protection permission and nature protection permission, according to appendix No. 1;

1.2. The list of the services connected with issue of complex nature protection permission and nature protection permission and the size of rates for them, according to appendix No. 2.

2. To the agency of the environment in case of issue of complex nature protection permission and nature protection permission to apply the rates specified in appendix No. 2.

3. To impose control over the implementation of this resolution on the Ministry of the environment.

Methodology of calculation of cost of complex nature protection permission and nature protection permission

I. General provisions

1. The methodology of calculation of cost of complex nature protection permission and nature protection permission (further – Methodology) establishes calculation principles of cost of issue of complex nature protection permission and nature protection permission for a fee (further – cost) the Agency of the environment.

2. This Methodology establishes:

2.1. cost structure and the expenses connected with operating activiies, used when calculating cost of complex nature protection permission and nature protection permission;

2.2. procedure of payments of cost of complex nature protection permission and nature protection permission.

3. When calculating cost the mechanism of covering/compensation for expenses on the operating activiies connected with the procedure of issue by the Agency of the environment of allowing documents – complex nature protection permission and nature protection permission is provided.

4. In this Methodology the following basic concepts are used:

the cost of works and operating activiies – the total amount of the expenses incurred directly in the course of consideration of the request for receipt of complex nature protection permission or nature protection permission;

operating activiies – the administrative activities performed by the Agency of the environment within the procedure of issue of complex nature protection permission or nature protection permission, specified in appendix to this Methodology;

direct costs – the amount of the incurred administrative expenses including compensation of the personnel involved in the procedure of issue of complex nature protection permission or nature protection permission, the fees of compulsory national social insurance paid by the employer, the used materials and services;

indirect costs – expense amount which cannot be identified and directly carried to the cost of the services and works performed in the course of issue by the Agency of the environment of complex nature protection permission and nature protection permission;

the operator – the receiver of the state services performing the industrial and economic activity specified in appendices 1 and 2 to the Law No. 227/2022 on industrial emissions.

5. Provisions of this Methodology are not applied to calculation of cost:

5.1. the accompanying services rendered to operators (simple photocopying, scanning of documents, consultations, provision of statistical data, delivery of documents, etc.);

5.2. the main functions and the main powers of the Agency of the environment which are performed for accomplishment of the obligations provided by regulations.

II. Structure of cost and expenses on the operating activities connected with issue of complex nature protection permission and nature protection permission

6. The structure of cost of issue of complex nature protection permission and nature protection permission for a fee the Agency of the environment includes:

6.1. direct costs;

6.2. indirect costs;

6.3. other expenses for operating activiies.

7. Direct costs are the expenses connected with the procedure of issue of complex nature protection permission and nature protection permission, included directly without intermediate calculations among them:

7.1. the salary of the personnel involved in the procedure of issue of complex nature protection permission or nature protection permission;

7.2. the fees of compulsory national social insurance paid by the employer;

7.3. material costs;

7.4. expenses on the services provided by the third parties (the electric power, other services);

7.5. other direct costs.

8. Indirect costs are the costs connected with management and servicing of organizational structure in the course of issue of complex nature protection permission and nature protection permission which can be referred only after intermediate calculations of distribution. Indirect costs include:

8.1. salary of administrative and service personnel of operational divisions and fees of compulsory national social insurance;

8.2. the expenses connected with information services;

8.3. depreciation of the invaluable and fast-wearing-out objects;

8.4. other indirect costs (telecommunication services, official journeys, advanced training, running repair, etc.).

9. Other expenses for operating activiies includes the expenses incurred within nature protection activities and also other types of activity connected with allowing requirements according to provisions of the Law No. 227/2022 on industrial emissions.

10. The structure of costs and expenses of the operating activiies connected with process of issue of complex nature protection permission and nature protection permission is determined according to accounting of obligations, according to the methodological regulations developed and approved by the Ministry of Finance and provisions of the Law No. 113/2007 on financial accounting, and is fixed in accounting policies of the Agency of the environment.

III. Procedure of payments of cost of complex nature protection permission and nature protection permission

11. The cost of the state service in issue of complex nature protection permission and nature protection permission is determined on the basis of the expenses incurred in the course of rendering the state service in issue of the corresponding permission according to formula:
