2. Recognize invalid:

1) the order of the Government of the Kyrgyz Republic "About approval of the Regulations on the state registers of intellectual property items of the Kyrgyz Republic" of February 29, 2012 No. 155;

2) the order of the Government of the Kyrgyz Republic "About entering of amendments into the order of the Government of the Kyrgyz Republic "About approval of the Regulations on the state registers of intellectual property items of the Kyrgyz Republic" of February 29, 2012 No. 155" of February 4, 2014 No. 71;

3) Item 2 of the order of the Government of the Kyrgyz Republic "About modification and amendments in some decisions of the Government of the Kyrgyz Republic" of September 7, 2015 No. 619;

Procedure for maintaining the State register of the protected selektsinny achievements of the Kyrgyz Republic

Chapter 1. Order of registration of selection achievement in the State registry of SD

1. The state register of the protected selection achievements of the Kyrgyz Republic (further - the State registry of SD) is the official document intended for registration of selection achievements on which patents of the Kyrgyz Republic are granted (further - patents), and also changes of their legal status.

2. The state registry of SD represents the book which is page by page numbered, strung together and certified by seal subject to permanent storage in the Ministry of science, the higher education and innovations of the Kyrgyz Republic (further - authorized state body).

3. The state electronic register of SD is the public database intended for registration of the protected selection achievements to which legal protection in the Kyrgyz Republic, and also all changes of their legal status is provided.

4. According to the statement of the applicant the electronic security document (the patent for selection achievement) is issued.

5. The basis for entering of data on selection achievement into the State registry of SD is the decision on registration of selection achievement and payment of the established duty on registration, the publication and patent grant.

6. In the State registry of SD the following data are entered:

1) number of registration (patent);

2) registration date;

3) registration requisition number;

4) date of application;

5) requisition number based on which the conventional priority is asked;

6) date of conventional priority;

7) country of conventional priority (country code);

8) date of the publication of data on selection achievement, number of the bulletin;

9) name of selection achievement;

10) surname, name, middle name or full name of the applicant(s), country code;

11) surname, name, author(s) middle name, country code;

12) surname, name, middle name or full name of the owner of the patent, country code;

13) surname, name, middle name and registration number of the patent agent;

14) the address for correspondence.

7. Authorized state body within a month from the date of receipt of the decision:

1) enters data on selection achievement in the State registry of SD;

Directs 2) to the publication of the data on the registered selection achievement in the amount determined by authorized state body;

3) grants the patent for selection achievement.

Chapter 2. Procedure for modification and amendments in the State registry of SD

8. In the course of maintaining the State registry of SD the following changes and additional data can be made to it:

1) about change of the name or surname, name, middle name of the owner of the patent and/or the address of its location (residence);

2) about the agreement on patent concession;

3) about the license agreement about provision of the right to use selection achievement;

4) about recognition of registration of selection achievement of invalid;

5) about the termination of the patent;

6) about correction of plain and technical errors;

7) about issue of the duplicate of the patent;

8) about recovery of action of the patent;

9) about the compulsory license;

10) about the open license;

11) about transition of the rights according to the procedure of legal succession by reorganization;

12) about transition of the rights by inheritance.

9. In the State registry of SD data on change of the name or surname, name, middle name of the owner of the patent and/or the address of its location (residence) are entered.
