About approval of Regulations about creation and publication of the Report on solvency and financial stability of insurance or reinsurance companies

Based on part provisions (2) the Art. 25, the item b) parts (1) the Art. 44, parts (1) and (6) Art. 50 of the Law on insurance or reinsurance activity No. 92/2022 (The official monitor of the Republic of Moldova, 2022, No. 129-133, the Art. 229) the Executive committee of National Bank of Moldova DECIDES:

1. Approve Regulations about creation and publication of the Report on solvency and financial stability of insurance or reinsurance companies, according to appendix.

2. This resolution becomes effective from the date of its publication in the Official monitor of the Republic of Moldova.

3. In departure from Item 52 of the regulations specified in Item 1, the first publication of the Report on solvency and financial stability according to the regulations specified in Item 1, it will be performed as of December 31, 2024 till September 30, 2025.

Regulations about creation and publication of the Report on solvency and financial stability of insurance or reinsurance companies

These Regulations:

- partially restacks (restacks Art. 290 - Art. 295 (4), Art. 295 (6) - Art. 297 (2), Art. 297 (5) - the Art. 298, of Art. 300 - Art. 301 (3), Art. 301 (5) - Art. 302 and Appendix XX) the delegated Regulations (EU) 2015/35 Commissions of October 10, 2014 supplementing the Directive 2009/138/CE of the European Parliament and Council concerning access to activities and the implementation of insurance and reinsurance activity (Solvency II) published in the Official magazine of the European Union by L 12/1 of 17.01.2015 of CE-LEX: 32015R0035, with the last changes made by the delegated Regulations (EU) 2021/1256 Commissions of April 21, 2021 concerning integration of risks of sustainable development in management of insurance and reinsurance companies;

- partially restacks (restacks Managements 1 - 10, 12, 30 - 32, 36 - 37) the Management of EIOPA-BoS No. 15/109 about the reporting and the publication of information.

Chapter I. General provisions

1. The regulations about creation and publication of the Report on solvency and financial stability by insurance or reinsurance companies (further - Regulations) establish requirements to structure and contents of the report on solvency and financial stability published by insurance or reinsurance companies (further - societies) and represented to National Bank of Moldova, terms, methods of its publication and representation.

2. The terms and expressions used in Regulations have the values provided by the Law on insurance or reinsurance activity No. 92/2022 (further - the Law No. 92/2022).

3. For the purposes of these regulations "society" is understood as the insurance company or reinsurance society with the central office in the Republic of Moldova, and also department of insurance or reinsurance company from the third state.

Chapter II. Report on solvency and financial stability

Part 1. Structure and content

4. The report on solvency and financial stability is constituted and corresponds to the structure provided in appendix and will promulgate information specified in Items 9 - 41.
