About approval of the Technical regulation "Measures for Protection of Soils in Agricultural Practice"

Based on Item e) Article 5 of the Land code No. 22/2024 (The official monitor of the Republic of Moldova, 2024, Art. No. 93-95, 137), with subsequent changes, DECIDES: the Government

1. Approve the Technical regulation "Measures for Protection of Soils in Agricultural Practice" it (is applied).

2. Declare invalid the Order of the Government No. 1157/2008 about approval of the Technical regulation "Measures for Protection of Soils in Agricultural Practice" (The official monitor of the Republic of Moldova, 2008, Art. No. 193-194, 1195), with subsequent changes.

3. To confer responsibility for accomplishment of this resolution on National land reclamation agency.

4. To impose control over the implementation of this resolution on the Ministry of Agriculture and the food industry.

Technical regulation "Measures for Protection of Soils in Agricultural Practice"

This Technical regulation shifts the Directive of Council 86/278/EEC of June 12, 1986 about environment protection and, in particular, soils when using sludges in agricultural industry, CELEX: 31986L0278, published in the Official magazine of the European Union by L 181 of July 4, 1986, with the last changes made by Regulations (EU) 2019/1010 of the European parliament and Council of June 5, 2019.

I. General provisions

1. This Technical regulation establishes measures for the prevention of natural processes of degradation of soils which can be caused to perform the agricultural works making negative impact on capability of the soil the functions, and also establishes obligations of owners of lands of agricultural purpose irrespective of property type (further – owners of lands) on application of preventive measures of territorial and organizational, agromeliorative, forest melioration and hydromeliorative nature if degradation of the soil can result from use of lands and obstacles for accomplishment of its natural functions can appear (ecological, economic, social and cultural).

2. In this Technical regulation the following basic concepts are used:

2.1. depletion of soils – process of decrease in content of nutrient elements in the soil is lower than the level of requirements of plants;

2.2. rainfall:

2.2.1. the residual rainfall which is formed on the treatment facilities purifying household waste waters and also on other treatment facilities purifying the waste waters having the structure similar to composition of household waste waters;

2.2.2. the residual rainfall which is formed in septic settlers and other similar installations on activated sludge process;

2.2.3. the residual rainfall which is formed on the treatment facilities which are not mentioned above;

2.3. the processed rainfall – rainfall which underwent to biological, chemical or heat treatment, long-term storage or any different corresponding way of processing for the purpose of considerable decrease in intensity of their fermentation and risks for the health and the environment resulting from their use;

2.4. agriculture – cultivation of all types of crops for the commercial and food purposes, including for the purposes of animal husbandry;

2.5. optimization – the actions aimed at providing in soils of the parameters and the modes promoting improvement of functioning of soils and, respectively, the best growth and development of agricultural plants;

2.6. the optimum period for work – the period of year which is characterized by good and very good conditions of humidity for carrying out agricultural works without violation of physical properties of the soil and its functions;
