About introduction conditions on the market of aerosol sprayers

Based on the Law No. 112/2014 on ratification of the Agreement on association between the Republic of Moldova, on the one hand, both the European Union and European Atomic Energy Community and their state members, from other party (The official monitor of the Republic of Moldova, 2014, Art. No. 185-199, 442), the Government DECIDES:

This resolution shifts the Directive 75/324/EEC of Council of May 20, 1975 about rapprochement of the legislation of state members concerning aerosol sprayers, CELEX: 31975L0324, published in the Official magazine of the European Union by L 147 of June 9, 1975, with the last changes made by the Directive (EC) 2016/2037 of the Commission of November 21, 2016.

1. Approve introduction conditions on the market of aerosol sprayers (are applied).

2. For the purposes of this resolution the term "aerosol sprayer" means any reservoir disposable from metal, glass or plastic containing compressed, the gas liquefied or dissolved under pressure, with liquid or without it, paste or powder, equipped with the final device allowing content to vypryskivatsya in the form of firm or liquid particles in suspension in gas in the form of foam, paste, powder or in liquid state.

3. Provisions of this resolution are not applied to aerosol sprayers with a total volume less than 50 ml and to aerosol sprayers with the total capacity exceeding specified in subitems 3. 1, 4.1.1, 4.2.1, 5.1 and 5.2 of appendix.

4. In case of introduction on the market of aerosol sprayers business entities shall apply on aerosol sprayers symbol "" (turned epsilon), certifying that they correspond to provisions of this resolution.  

5. Without prejudice to Regulations on classification, marking and packaging of the substances and mixes approved by the Government, each aerosol sprayer or if data cannot be applied on the aerosol sprayer owing to its small sizes (with the maximum volume of 150 ml or less), the label attached to it shall contain the following information placed by noticeable, legible and nonerasable method:

5.1. the name and the address or the trademark of person responsible for introduction on the market of the aerosol sprayer;

5.2. symbol "" (turned epsilon), confirming compliance to requirements of this resolution;

5.3. the code marking allowing to identify lot of products;

5.4. the data specified in appendix Items 2.2;

5.5. content net on amount.

6. If the aerosol sprayer contains flammable components according to their determination in appendix Item 1.6, but the aerosol sprayer is not classified as "flammable" or "extremely flammable" according to the criteria established in appendix Item 1.1, the amount of the flammable material containing in the aerosol sprayer shall be accurately designated on the label in the form of the following legible and nonerasable text: "Contains the X % of mass of flammable components".

7. The information specified on the label provided in Items 5 and 6, shall be provided in Romanian. It does not exclude possibility of its representation in other languages of the international communication.

8. It is forbidden to apply on aerosol sprayers of marking or text which can be mixed with symbol "" (turned epsilon).

9. In case of introduction of aerosol sprayers on the market the producer provides that they were designed and manufactured according to the safety requirements stated in annex.

10. In case of introduction and/or provision on the market of aerosol sprayers business entities shall observe provisions of the Law No. 162/2023 on supervision of the market and compliance of products and the Law No. 105/2003 on consumer protection.

11. Based on the Law No. 162/2023 on supervision of the market and compliance of products and within the spheres of competence established by the Regulations on the organization and functioning of Inspectorate for environmental protection approved by the Order of the Government No. 548/2018, Inspectorate for environmental protection is competent authority of supervision of the market performing check of observance of provisions of this resolution concerning requirements to marking of aerosol sprayers, drawings the corresponding marking, availability of the declaration of conformity and technical documentation on product. Control is exercised according to the Law No. 131/2012 on the state control.
