Some questions of ensuring steady functioning of electronic communication networks in the conditions of warlike situation

For the purpose of ensuring steady functioning of electronic communication networks in the conditions of the warlike situation Cabinet of Ministers of Ukraine decides:

1. Determine that:

1) determined Kiev city, regional public administrations (the relevant military authorities), military authorities of settlements, local government bodies of the company, organization and the organization, belonging to the sphere of their management (are in management), and also other subjects of managing (in consent) can be provided:

reserve power supply of technical means of the electronic communications necessary for provision of services of mobile communication (further - the equipment), suppliers of electronic communication services with use of networks of mobile communication (further - suppliers) during the termination of power supply with use of means of autonomous generation of the electric power (generators) (further - means of power supply) belonging to the subjects specified in paragraph one of this subitem according to the agreement signed with the supplier according to the approximate agreement (appendix 1);

operational maintenance of the means of power supply given by suppliers for providing reserve power supply of the equipment according to the agreement signed with the supplier according to the approximate agreement (appendix 2);

placement and ensuring functioning of the means of power supply belonging to suppliers according to the agreement signed with the supplier according to the approximate agreement (appendix 3);

2) the expenses connected with providing the actions specified in the subitem of 1 this Item are compensated in full by the supplier according to the signed agreements and, in particular, include expenses on:

acquisition of fuels and lubricants for functioning of means of power supply;

purchase and installation of spare parts for means of power supply;

connection, installation and/or adjustment of means of power supply;

maintenance, repair of means of power supply;

delivery of means of power supply to the place of its placement;

3) expenses of fuels and lubricants for functioning of means of power supply can be refunded by the supplier by return of fuels and lubricants in amount, equivalent to spent;

4) Kiev city, regional public administrations (the relevant military authorities), the military authorities of settlements, local government bodies and the companies, organizations and the organizations relating to the sphere of their management (which are in management), can use the reservoirs (reservoirs) belonging to them for storage of the fuels and lubricants necessary for ensuring functioning of the means of power supply provided by suppliers;

5) providing reserve power supply of the equipment of suppliers according to the agreement specified in the paragraph the second the subitem of 1 this Item is not the service connected with production, transfer, distribution, purchase and sale, delivery of electrical energy.

2. Bring in resolutions of the Cabinet of Ministers of Ukraine of September 30, 2015 No. 775 "About approval of the Procedure for creation and use of material reserves (except state) for prevention of emergence of emergency situations and liquidation of their effects" (The Official Bulletin of Ukraine, 2015, No. 80, Art. 2675; 2023, No. 36, Art. 1912; 2024, No. 26, the Art. 1668) and of July 22, 2022 No. 824 "Some questions of obtaining, distribution, use and accounting of the humanitarian assistance for power requirements satisfaction in the conditions of warlike situation" (The Official Bulletin of Ukraine, 2022, No. 60, Art. 3601; 2023, No. 106, the Art. 6363) changes which are applied.

3. Recommend to local government bodies to perform the actions necessary for the organization of work on ensuring steady functioning of electronic communication networks in the conditions of warlike situation according to this resolution.

4. This resolution becomes effective from the date of its publication and is effective during the period of warlike situation.

Changes which are made to resolutions of the Cabinet of Ministers of Ukraine of September 30, 2015 No. 775 and of July 22, 2022 No. 824

1. For prevention of the emergence of emergency situations and liquidation of their effects approved by the resolution of the Cabinet of Ministers of Ukraine of September 30, 2015 No. 775, to add Item 12 of the Procedure for creation and use of material reserves (except state) with the paragraph of the following content:

"ensuring power supply with means, fuel and lubricants and other consumable materials for implementation (support) of reserve power supply of technical means of the electronic communications necessary for provision of services of mobile communication, in the territory where martial law is declared, except for the territory included in the list of the territories in which are conducted (were conducted) fighting or temporarily occupied by the Russian Federation, the approved Minrazvitiya concerning which date of completion of temporary occupation or date of the termination of possible fighting, or date of completion of fighting is not determined.".
