About approval of the Regulations on procedure for informing and carrying out public discussions in the course of development and approval of documentation on arrangement of the territory and to town planning

Based on Article 32 and part (1) article 94 of the Town-planning and construction code No. 434/2023 (The official monitor of the Republic of Moldova, 2024, Art. No. 41-44, 61), with subsequent changes, DECIDES: the Government

1. Approve Regulations on procedure for informing and carrying out public discussions in the course of development and approval of documentation on arrangement of the territory and to town planning it (is applied).

2. This resolution becomes effective from the date of its publication in the Official monitor of the Republic of Moldova.

Regulations on procedure for informing and carrying out public discussions in the course of development and approval of documentation on arrangement of the territory and to town planning

Chapter I. General provisions

1. The regulations on procedure for informing and carrying out public discussions in the course of development and approval of documentation on arrangement of the territory and to town planning (further – the Provision) establish procedural framework for the organization and carrying out informing and public discussions in the course of development, modification and approval of documentation on arrangement of the territory and to town planning, according to the principles of transparency, nondiscrimination and social integration, promoting participation of the public in planning of city development.

2. Public discussion is the tool providing sblalansirovanny participation of all segments of society in sustainable and fair city development by means of timely and available informing, active participation and effective use of deposits of concerned parties that allows to perform collection of the corresponding opinions and data on the analyzed territory for the purpose of creation and maintenance of the favorable living environment for all persons to whom action of the corresponding documentation on arrangement of the territory and town planning extends.

3. Public discussion is obligatory, being integral part of the procedure of initiation, development, approval and approval of all documentation on arrangement of the territory and to town planning.

4. Informing and consultation of the population is performed at all development stages, modification and approval of documentation on arrangement of the territory and to town planning.

5. Public discussions within process of development and approval of documentation on arrangement of the territory and to town planning are performed by four methods:

5.1. the public discussions performed for the purpose of detection of opinion of the population and the entrepreneurial circle concerning initiation of development of documentation on arrangement of the territory and to town planning;

5.2. public discussions concerning the proposed initiatives and possible advanced project solutions;

5.3. the public discussions performed by social researches in the course of development and approval of documentation on arrangement of the territory and to town planning;

5.4. the public discussions performed in the course of strategic ecological assessment of documentation on arrangement of the territory and town planning according to article 10 of the Law No. 11/2017 on strategic ecological assessment.

6. Responsibility for the organization of public discussions is conferred on bodies of public management, authorized to approve documentation on arrangement of the territory and town planning.

7. Financing of public discussions is performed according to articles 33 and 97 of the Town-planning and construction code No. 434/2023.

Chapter II. Organization of public discussions

8. Public discussion begins with informing the population and the entrepreneurial circle on intention to develop documents on arrangement of the territory and town planning and comes to the end with their approval.

9. Public discussion is initiated according to the order of executive body of public management which creates the working group responsible for supervision and approval of process of public discussions at all development stages of documentation on arrangement of the territory and to town planning into which structure, in addition to her members, the chairman and the secretary enter. Mandates of members, their powers, quantity of workgroup members, and also information on method of processing of personal data are established by the order about creation of working group.

10. The planned public discussions are performed in Romanian in hybrid format by means of public meetings with physical presence and at the same time online, with access to video and to audioaccess, providing possibility of involvement of all participants.

11. Online sessions register completely (in the form of video and audiomaterials) and are published on the official website of authorized body of the public power with approval of the corresponding documentation before creation of protocols and shorthand reports if the meeting took place, including in online or hybrid format. Protocols and shorthand reports of meetings concerning the organization of public discussions are stored in the State register of local acts as related documents which formed the basis for approval of the corresponding documentation.

12. Depending on complexity of the developed documentation on arrangement of the territory and to town planning, public discussions, in addition to public meetings, can include individual meetings with vulnerable working groups in addition to public meetings, and also other methods of collection of the corresponding opinions and data, such as questioning, individual or group (target groups) high-quality interviews, polls or working seminars for the purpose of ensuring receipt of representative and reliable data.

13. Methods of collection of the corresponding opinions and data shall provide documentation and check of source of information for providing guarantee that information arrives only from the population, the companies or from the organizations which are in the analyzed territory.

14. The public discussions mentioned in subitem 5. 1, are performed for the analysis and validation of subject program, being the first stage of process of public discussions.
