About marking of jewelry and other products

For the purpose of providing the legal address of jewelry and other products, consumer protection, establishment of legal regulation of marking of jewelry and other products:

1. Determine that:

1.1. since January 1, 2026 subjects of managing perform marking of jewelry and other products means of identification according to the procedure, established by the Ministry of Finance, in cases:

import to the Republic of Belarus for realization;

production, except for production by individual orders of citizens from the jewelry and other products and (or) scrap and waste of jewelry and other products belonging to them;

wholesale and (or) retail trade *;

export to the countries with which the international contracts providing mutual recognition of means of identification are signed (further, unless otherwise specified, - export).

Marking by means of identification of remaining balance of jewelry and other products which were formed for January 1, 2026 is performed within one year from the effective date of this subitem;

* When marking jewelry and other products in the form of remaining balance, and also in case of trade in jewelry and other products which are accepted by subjects of managing from citizens under commission agreements are withdrawn, arrested, turned into the income of the state in the procedure established by the legislation or on which collection on account of the unexecuted tax liability, unpaid penalty fee is turned and which are transferred for realization of JSC Belyuvelirtorg.

1.2. marking of jewelry and other products with means of identification is provided by subjects of managing in the way:

drawings the sign of protection containing means of identification on commodity label (label, the label or other carrier) or funds of identification for the protected material carrier of each jewelry and other product. In case of export means of identification is also applied directly on jewelry and other products (if necessary). Drawing means of identification is direct on jewelry and other products is performed by the Ministry of Finance;

entering into the automated information system of marking of jewelry and other products (further, unless otherwise specified, - system of marking of jewelry) data on jewelry and other products with the means of identification applied on commodity labels (labels, labels or other carriers) or on the protected material carriers of each jewelry and other product and about these means of identification, and in case of export - also about jewelry and other products with applied on them (in need of drawing it is direct on jewelry and other products) means of identification and about these means of identification;

1.3. jewelry and other products are considered marked in case of drawing means of identification according to the paragraph the second subitem 1.2 of this Item in the procedure established by the Ministry of Finance and contents in system of marking of jewelry of authentic data on such jewelry and other products and means of identification;

1.4. the address in the territory of the Republic of Belarus of jewelry and other products, except for the jewelry and other products specified in appendix 1 is forbidden:

without applied on commodity labels (labels, labels or other carriers) or on the protected material carriers of jewelry and other products of means of identification;

with the funds of identification for commodity labels (labels, labels or other carriers) or for the protected material carriers of jewelry and other products put in defiance of the procedure established by the Ministry of Finance;

in case of absence in system of marking of jewelry of data on jewelry and other products and means of identification which are subject to introduction according to the paragraph to third subitem 1.2 of this Item, or in case of discrepancy of these data to the data containing in system of marking of jewelry;

1.5. violation of the requirements established in subitem 1.4 of this Item is violation of procedure of activities with precious metals and gemstones;

1.6. collection, transfer, acceptance, processing, accounting, control, storage, introduction, obtaining and accumulating of the data specified in part one of Item 2 of the Regulations on functioning of the automated information system of marking of jewelry and other products approved by this Decree are performed in system of marking of jewelry which owner and the operator is RUP "Belblankavyd Publishing house (further, unless otherwise specified, - the operator).

The operator performs generation of codes of marking, and also realization of codes of marking, the protected material carriers, signs of protection containing means of identification.

Works on development, maintenance and technical support in use of system of marking of jewelry, generation of codes of marking are carried out by the operator at the expense of own means.

Production of the protected material carriers, the signs of protection containing means of identification will be organized by the Ministry of Finance in the state organizations subordinated to it which control of activities is exercised by Department of the state signs of the Ministry of Finance;

1.7. acceptance of payments in case of sale of jewelry and other products is performed by cash and in non-cash form according to the legislation in the field of payment systems and payment services, and also with the legislation on use of cash and other equipment in case of acceptance of instruments of payment with use of payment terminals and the cash equipment providing:

reading of the means of identification applied on each unit of jewelry and other products;

the differentiated accounting of data on implementable jewelry and other products with use single for all the jewelry and other products of identification article number marked by means of identification (global number of trade item - Global Trade Item Number (GTIN), data on which contain in the interdepartmental distributed information system "Databank of Electronic Passports of Goods";

transfer of data on marking code in the control system of the cash equipment according to the requirements determined by the Ministry of Taxes and Tax Collection and the State committee on standardization to the cash summing-up registers, the Ministry of Taxes and Tax Collection - to program cash desks;

forming in the payment document in addition to other data determined in requirements to the cash equipment, descriptions of goods;

1.8. the jewelry and other products imported on the territory of the Republic of Belarus from state members of the Eurasian Economic Union (further - EEU) in case of cross-border trade, the identifications which are at the same time subject to marking by means in state members of EEU, are recognized marked in case of observance of at the same time following conditions:

availability between state members of EEU of the international treaty providing mutual recognition of the means of identification applied on jewelry and other products and (or) their commodity labels (labels, labels or other carriers);
