About procedure for customs clearance of the vehicles imported on the territory of the Republic of Moldova for the purpose of receipt of neutral registration signs

For the purpose of realization of provisions of the Law No. 170/2018 on registration of some vehicles and modification of some legal acts (The official monitor of the Republic of Moldova, 2018, No. 309-320/490), with subsequent changes and amendments, according to Art. 160 of the Customs code No. 95/2021 (The official monitor of the Republic of Moldova, 2021, Art. No. 219-225, 238), with subsequent changes, and according to Art. 6 of h (9) g subitem) the Law No. 302/2017 on Customs Service (The official monitor of the Republic of Moldova, 2018, Art. No. 68-76, 143), with subsequent changes and amendments, and also based on item 295 of the Regulations on enforcement of the Customs code No. 95/2021, approved by the Order of the Government No. 92/2023 (The official monitor of the Republic of Moldova, 2023, 193), with subsequent changes and amendments, I ORDER to Art. No. 93-96,:

1. Customs clearance of the vehicles classified in tariff heading 8703, and trail cars to them, classified in tariff heading 8716, of motorcycles (including mopeds) and bicycles with the auxiliary engine, with carriages or without them classified in tariff heading 8711 (further - vehicles), imported on the territory of the Republic of Moldova during 24.04.2018 - 1.09.2018 persons specified in Item 3 of article I of the Law No. 170/2018 on registration of some vehicles and modification of some legal acts and on the terms of this Law to perform only on posts of internal customs control (further - PVTK) according to the following procedure:

1) Submission by the applicant of the declaration on own responsibility in the form established in appendix to this order;

3) Filling with the official of customs authority in IS "Asycuda World" of "The receipt on collection of import and export customs payments" with indication of tax benefit (release code 014);

4) Filling with the official of customs authority in IS "Asycuda World" of the electronic form "Accounting of the Cleared Transport" (ETV) where in the field "Note" the text "For issue of registration plates with neutral registration number based on the Law No. 170/2018" will be introduced.

5) After completion of the actions described in item 3 and the item 4, the authorized employee of customs is unpacked by the paper form "Receipt on Payment of Import and Export Customs Payments", introduces on the right side above number and date of ETV created by the SI of "Asycuda World", including the text "For issue of registration plates with neutral registration number based on the Law No. 170/2018 and puts down personal seal.

2. To perform filling of the forms specified in the item of 1 subitem 3) and subitem 4) (according to the Art. I, item 2 of the Law No. 170/2018) for vehicles with the registration plates issued in administrative and territorial units of left bank of Dniester or Bender's municipality (except for settlements Kochiyer, Korzhova, the Basket, Dorotskaya, Molovata Noua, Pyryta, Pokhrebya, Vasilyevka of the area Dubesar), in case of presentation of the vehicle and the following documents on internal post of customs control:

1) a) the identity certificate of the citizen of the Republic of Moldova, or the identity certificate for stateless persons, or the identity certificate for refugees, or the identity certificate for the persons using humanitarian protection, living in administrative and territorial units of left bank of Dniester or Bender's municipium issued by the authorities of the republic Moldova (except for settlements Kochiyer, Korzhova, the Basket, Dorotskaya, Molovata Noue, Pyryta, Pokhrebya, Vasilyevka near Dubesar) (according to the provisions provided by the Art. I, Item 3 a) the Law 170/2018);

b) the document confirming the property right to the vehicle;

c) declarations on own responsibility (appendix No. 1 to this order);

3. The legal entities submitting the registration application of the vehicle on the terms of the Art. I the item 3, 2) of the Law No. 170/2018, shall provide subitem to official persons of customs authority:

a) the documents confirming registration of the legal entity till 24.04.2018 in body of state registration of the Republic of Moldova;

b) the identity certificate of the citizen of the Republic of Moldova, authorized to represent the corresponding legal entity;

c) the power of attorney issued by notary office of the Republic of Moldova, certifying the right to be the representative of the corresponding legal entity;

d) the document confirming the property right to the vehicle (copy);

e) the declarations on own responsibility (appendix No. 1 to this order) provided by the head of the legal entity or the authorized person;

f) and to correspond to the following conditions:

- the location in administrative and territorial units of left bank of Dniester or Bender's municipality, except for settlements Kochiyer, Korzhova, the Basket, Dorotskaya, Molovata Noua, Pyryta, Pokhrebya, Vasilyevka near Dubesar;

- perform external business activity;

- do not perform motor transportations of loads and passengers.
