1. Approve the enclosed Rules of the delivery of the automotive vehicle and the goods which are in it to the storage location performed by person managing the automotive vehicle accompanied by service employees of bodies of state revenues and transportation (transportation) of the detained automotive vehicles and goods which are in it to the storage location.

2. To provide to committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. This order becomes effective after ten calendar days after day of its first official publication.

Rules of the delivery of the automotive vehicle and goods which are in it to the storage location performed by person managing the automotive vehicle accompanied by service employees of bodies of state revenues and transportation (transportation) of the detained automotive vehicles and goods which are in it to the storage location

Chapter 1. General provisions

1. These rules of the delivery of the automotive vehicle and the goods which are in it to the storage location performed by person managing the automotive vehicle accompanied by service employees of bodies of state revenues and transportation (transportation) of the detained automotive vehicles and goods which are in it to the storage location (further - Rules) are developed according to Items 5 and 6 of article 18-1 of the Code of the Republic of Kazakhstan "About customs regulation in the Republic of Kazakhstan" (further - the Code) and determine procedure:

1) the delivery of the automotive vehicle and the goods which are in it to the storage location performed by person managing the automotive vehicle (further - the driver), accompanied by service employees of bodies of the state revenues included in structure of mobile group (further - the service employee);

2) transportation (transportation) of the detained automotive vehicles and goods which are in it to the storage location.

2. In these rules the following basic concepts are used:

1) mobile group - the exit group of service employees consisting of two and more service employees authorized to provide observance of international treaties of the Republic of Kazakhstan, the customs legislation of EEU, customs and other legislation of the Republic of Kazakhstan, in zones and out of customs control zones;

2) the job specification of mobile group - group of the service employees directed along certain routes of movement on highways.

Chapter 2. Procedure for the delivery of the automotive vehicle and the goods which are in it to the storage location performed by person managing the automotive vehicle accompanied by service employees of bodies of state revenues

3. In case of decision making about carrying out customs examination and (or) customs examination in the storage location in case, stipulated in Item 4 articles 18-1 of the Code, the service employee hands:

1) to the driver the requirement about delivery of the automotive vehicle for form according to item 4 of article 18-1 of the Code;

2) to the service employee performing the escort of the automotive vehicle, documents on the automotive vehicle and which are in it the goods shown by the driver according to Item 2 of article 18-1 of the Code under the delivery-acceptance certificate of such documents.

At the same time according to item 4 of article 18-1 of the Code the storage location is understood as the stops of the automotive vehicle, next to the place, permanent or temporary customs control zones, stipulated in Article 404 Codes.

4. Delivery of the automotive vehicle and the goods which are in it to the storage location is performed by the driver, accompanied by service employees, the accompanied automotive vehicle performed on or on the vehicle of body of state revenues.

5. In case of maintenance by service employees the technical means of customs control performing photographing audio-and video are used.

At the same time the beginning of time of maintenance does not exceed 6 (six) hours from the moment of creation of the act of stop of the automotive vehicle in form, stipulated in Item 3 articles 18-1 of the Code.

The term of the beginning of time of maintenance established by this Item stops for action of the circumstances specified in Item 11 of these rules.

6. Maintenance is performed proceeding from type, the number of automotive vehicles, nature of the transported goods, and also other factors influencing efficiency of implementation of maintenance, including rout to follow, traffic conditions, technical condition of automotive vehicles and climatic conditions.

7. Before escort by the senior of the job specification of mobile group it is instructed staff in oral form with fixing of its results in leaf of acquaintance, the state of health and readiness of staff for accomplishment of tasks, availability and operability of equipment, and also technical condition of the equipped vehicles are checked.

8. Service employees provide maintenance no more than 10 (ten) automotive vehicles for one maintenance.

9. Information on escort of the automotive vehicle is transferred on operational communication channels to division of the body of state revenues performing customs examination and (or) customs examination, prior to the beginning of time of making of delivery of the automotive vehicle, specified in the requirement about delivery of the automotive vehicle, and introduced in special register of the accompanied automotive vehicles which is got for calendar year.
