About approval of Rules of marking of separate types of radio-electronic products means of identification and the features of implementation of the state information system of monitoring of turnover of goods which are subject to obligatory marking by means of identification concerning separate types of radio-electronic products

The government of the Russian Federation decides:

1. Approve the enclosed Rules of marking of separate types of radio-electronic products by means of identification (further - Rules).

2. Determine that participants of turnover of separate types of the radio-electronic products specified in appendix to Rules (further - radio-electronic products), according to Rules:

a) give to the state information system of monitoring of turnover of goods, subject to obligatory marking by means of identification (further - information system of monitoring), the statement for registration in information system of monitoring since March 1, 2026, but no later than 7 calendar days from the date of emergence of need of implementation by the participant of turnover of radio-electronic products of the activities connected with input in turnover and (or) turnover, and (or) conclusion from turnover of radio-electronic products concerning which the input prohibition in turnover, and (or) turnover, and (or) conclusion from turnover of radio-electronic products not marked by means of identification (except for participants of turnover of radio-electronic products is established, the provisions of Items 3 and 7 of article 2 of the Federal law "About Use of the Control and Cash Equipment when Implementing Calculations in the Russian Federation" falling under action (further - participants of turnover of radio-electronic products in the remote or remote areas).

At the same time participants of turnover of radio-electronic products in the remote or remote areas submit the application for registration in information system of monitoring within 30 calendar days from the date of emergence of need of implementation of the activities connected with input in turnover by them and (or) turnover, and (or) conclusion from turnover of radio-electronic products;

b) provide no later than 15 calendar days from the date of registration in information system of monitoring readiness of own software and hardware for information exchange with information system of monitoring and send to the operator of information system of monitoring the request for passing of testing of information exchange electronically;

c) for work on ensuring readiness of own software and hardware for information exchange with information system of monitoring and for passing of testing of information exchange electronically after registration in information system of monitoring send electronically to the operator of information system of monitoring the request for provision of remote access to the issue registration device placed in infrastructure of information system of monitoring;

d) pass test of information exchange of own software and hardware with information system of monitoring according to the procedure posted on the official site of the operator of information system of monitoring on the Internet concerning the transactions connected with marking of radio-electronic products, its input in turnover and (or) turnover, and (or) conclusion from turnover according to Rules, no later than 15 calendar days from the date of readiness of own software and hardware for information exchange with information system of monitoring and the direction of the request according to the subitem "b" of this Item.

3. Determine that:

a) the participants of turnover of radio-electronic products performing input in turnover of radio-electronic products mark means of identification radio-electronic products and represent to information system of monitoring of the data on drawing means of identification and input in turnover of radio-electronic products according to Rules since May 1, 2026;

b) the participants of turnover performing turnover of radio-electronic products represent to information system of monitoring of the data on turnover of radio-electronic products according to Rules since December 1, 2026;

c) the participants of turnover of radio-electronic products performing conclusion from turnover of radio-electronic products (as in case of conclusion from turnover when implementing calculations using the control and cash equipment, and different ways), represent to information system of monitoring of the data on conclusion from turnover of radio-electronic products according to Rules since March 1, 2027;

d) participants of turnover of radio-electronic products have the right to put funds of identification for radio-electronic products and to represent to information system of monitoring of the data on drawing means of identification, about input in turnover, about turnover and about conclusion from turnover of radio-electronic products according to Rules from the date of entry into force of this resolution;

e) participants of turnover of radio-electronic products in the remote or remote areas have the right to represent the data specified in the Section VIII of Rules within 30 calendar days:

from the date of shipment (transfer or acceptance) radio-electronic products by its transfer (acceptance) within the transactions providing transition of the property right to the specified products and also within commission agreements, and (or) agency agreements, and (or) works agreements, and (or) agreements of the order;

from the date of conclusion of radio-electronic products from turnover in case of conclusion of radio-electronic products from turnover;

from the date of return of radio-electronic products to turnover in case of such return;

from the date of modification of the data provided by Sections III, IV and VIII of Rules, according to the procedure, provided by the Section IX of Rules (if changes were made to such data);

e) participants of turnover of radio-electronic products till May 31, 2026 perform marking of the radio-electronic products acquired till April 30, 2026 and issued by customs authorities since May 1, 2026, imported (imported) and placed under customs procedures of release for internal consumption or reimport to the offer of radio-electronic products for realization (sale) and enter into information system of monitoring of the data on marking of radio-electronic products means of identification according to Rules;

g) participants of turnover of radio-electronic products in the presence as of May 1, 2026 in the territory of the Russian Federation the unrealized radio-electronic products made in the territory of the Russian Federation or imported on the territory of the Russian Federation till the April 30, 2026 having the right to perform marking of such radio-electronic products means of identification till November 30, 2026 according to Rules.

4. Registration in the information system used for the purpose of carrying out experiment according to the order of the Government of the Russian Federation of November 25, 2023 No. 1993 "About carrying out in the territory of the Russian Federation experiment on marking by means of identification of separate types of radio-electronic products" (further - experiment), legal entities and individual entrepreneurs who as of February 28, 2026 were participants of experiment is equated to registration in information system of monitoring according to the subitem "an" of Item 2 of this resolution.

If the data provided within the experiment by participants of turnover of radio-electronic products to the information system used for the purpose of carrying out experiment do not meet the requirements of Rules, participants of turnover of radio-electronic products shall provide to information system of monitoring missing and (or) urgent data till April 30, 2026.

5. Determine that the operator of information system of monitoring provides:

a) the organization of testing of information exchange of software and hardware of participants of turnover of radio-electronic products and information system of monitoring no later than 30 calendar days from the date of obtaining from the participants of turnover of radio-electronic products registered in information system of monitoring, the notification of the readiness to information exchange with information system of monitoring;

b) provision to participants of turnover of radio-electronic products of remote access to the issue registration devices placed in infrastructure of information system of monitoring on the conditions provided by Rules no later than 30 calendar days from the date of obtaining from the participants of turnover of radio-electronic products registered in information system of monitoring, the request electronically for provision of remote access to the issue registration device.

6. Determine that in the territory of the Russian Federation input in turnover of radio-electronic products without drawing funds of identification for it and representation in information system of monitoring of data on marking is allowed by means of identification of radio-electronic products before the corresponding date, the stipulated in Item 3 presents of the resolution with which drawing funds of identification for radio-electronic products and representation in information system of monitoring of data on drawing funds of identification for radio-electronic products and its input in turnover becomes obligatory.

Turnover and conclusion from turnover of the unmarked radio-electronic products made in the territory of the Russian Federation or imported (imported) on territory Russian Federation (including in case of import from the territory of the Eurasian Economic Union) within cross-border trade or release by customs authorities in case of its room under customs procedures of release for internal consumption or reimport (in case of its production out of the territory of the Russian Federation) till April 30, 2026, is allowed till November 30, 2026.

Release by customs authorities imported (imported) unmarked and placed under customs procedures of release for internal consumption or reimport of the radio-electronic products specified in the subitem "e" of Item 3 of this resolution till May 31, 2026 is allowed.

7. Operation of this resolution does not extend to radio-electronic products to which according to Rules and international treaties of the Russian Federation requirements about obligatory marking by means of identification do not extend.

8. Determine that since May 1, 2026 provision to the participant of turnover of radio-electronic products of the codes of marking necessary for forming of means of identification, is performed by the operator of information system of monitoring on paid basis according to Rules.

9. From the date of entry into force of this resolution according to the decision of the participant of turnover of radio-electronic products provision to it the codes of marking necessary for forming of means of identification, can be performed by the operator of information system of monitoring before the corresponding date, the stipulated in Item 3 presents of the resolution with which drawing funds of identification for radio-electronic products becomes obligatory. Such codes of marking are provided by the operator of information system of monitoring on a grant basis. At the same time the participant of turnover of radio-electronic products who received marking codes on a grant basis provides their transformation to means of identification and submits in information system of monitoring the report on drawing funds of identification for radio-electronic products and data on input in turnover of radio-electronic products before the corresponding date, the stipulated in Item 3 presents of the resolution with which drawing funds of identification for radio-electronic products becomes obligatory. The operator of information system of monitoring enters into information system of monitoring information on drawing means of identification specified by the participant of turnover of radio-electronic products in the report on drawing funds of identification for radio-electronic products after receipt of the specified report. Such service is recognized the information system of monitoring rendered by the operator at the time of entering of information system of monitoring by the operator into information system of monitoring of information on drawing funds of identification for the radio-electronic products specified by the participant of turnover of radio-electronic products in the report on drawing funds of identification for radio-electronic products.

If the participant of turnover of radio-electronic products who received marking codes on a grant basis did not provide their transformation to means of identification and did not submit in information system of monitoring the report on drawing means of identification and data on input in turnover of radio-electronic products before the corresponding date, the stipulated in Item 3 presents of the resolution with which drawing funds of identification for radio-electronic products becomes obligatory, such codes of marking are paid by the participant of turnover of radio-electronic products or cancelled according to Rules.

10. This resolution becomes effective since March 1, 2026.

Rules of marking of separate types of radio-electronic products means of identification

I. General provisions

1. These rules determine procedure for marking of the separate types of radio-electronic products (further - radio-electronic products) which are subject to obligatory marking by means of identification, the requirement to participants of turnover of radio-electronic products, procedure for information exchange of the participants of turnover of radio-electronic products with the state information system of monitoring of turnover of goods who are subject to obligatory marking by means of identification (further - information system of monitoring), characteristics of means of identification, and also procedure for representation by participants of turnover of radio-electronic products in information system of monitoring of data on input in turnover, about turnover and about conclusion from turnover of radio-electronic products.

2. The concepts used in these rules mean the following:

"aggregation" - process of consolidation of goods in packaging in group packaging, either in set, or in shipping package, or group packagings or sets in shipping package, or shipping packages in shipping package of higher level of enclosure with preserving information on interrelation of codes of identification of each enclosed commodity unit with code of identification of the created group packaging and (or) shipping package or with code of identification created set and (or) shipping package, about interrelation of codes of identification of each enclosed group packaging with code of identification of the created shipping package or codes of identification of each enclosed set with code of identification of the created shipping package, and also about interrelation of codes of identification of each enclosed shipping package with code of identification of the created shipping package of higher level of enclosure and drawing appropriate means of identification on group packaging or set or code of identification of shipping package on shipping package for the purpose of ensuring traceability of movement of goods on goods distribution chain without the need for opening of the created group packaging and (or) shipping package or set and (or) shipping package;

"aggregative customs code" - the unique sequence of symbols for each separate set of goods representing consolidation of codes of identification of each goods, including codes of identification of the packaging uniting goods in the course of aggregation, created by the operator of information system of monitoring for the purpose of identification of goods according to these rules, used by the participant of turnover of goods in case of customs declaration of goods. At the same time consolidation in aggregative customs code of codes of identification which part is already included in code of identification of group packaging, or in code of identification of shipping package, or in other aggregative customs code is not allowed;

"validation of means of identification" - quality evaluation of transformation of code of marking to means of identification and drawing means of identification regarding compliance of its structure to requirements of these rules;
