About application of anti-dumping measure by means of introduction of anti-dumping duty concerning the graphitized electrodes coming from People's Republic of China and imported on customs area of the Eurasian Economic Union

In compliance with Item 107 of the Protocol on application of special protective, anti-dumping and countervailing measures in relation to the third countries (appendix No. 8 to the Agreement on the Eurasian Economic Union of May 29, 2014) (further – the Protocol) and based on the report of Department of protection of the domestic market of the Eurasian economic commission Board of the Eurasian economic commission of RESHILA:

1. Apply anti-dumping measure by means of introduction of anti-dumping duty in sizes according to appendix No. 1 to the electrodes imported on customs area of the Eurasian Economic Union used in the furnaces graphitized round section with a diameter more than 520 mm, but no more than 650 mm, or other cross section more than 2700 cm of 2, but no more than 3300 cm 2, of the CN FEA EEU coming from People's Republic of China and classified by code 8545 11 002 0, having established effective period of this anti-dumping measure of 5 years.

2. To provide to the state bodies of state members of the Eurasian Economic Union authorized in the field of customs affairs collection of the anti-dumping duty provided by this Decision, being guided by code of the CN FEA EEU.

3. To department of protection of the domestic market of the Eurasian economic commission:

perform monitoring of observance by Al 6 limited liability company of the recommended approaches to planning, negotiation and supply activity of the graphitized electrodes with a diameter more than 520 mm provided to them, but no more than 650 mm, in state members of the Eurasian Economic Union according to appendix No. 2 (further – the recommended approaches);

in case of non-compliance by Al 6 limited liability company with the recommended approaches to consider question of conducting repeated anti-dumping investigation according to Item 110 of the Protocol.

4. This Decision becomes effective after 30 calendar days from the date of its official publication.

The recommended approaches to planning, negotiation and supply activity of the graphitized electrodes with a diameter more than 520 mm, but no more than 650 mm, in state members of the Eurasian Economic Union

1. Negotiation and (or) continuation of earlier begun negotiations with consumers in state members of the Eurasian Economic Union regarding emergence of obligations on deliveries of the graphitized electrodes with a diameter more than 520 mm, but no more than 650 mm (further – the graphitized electrodes), using formular pricing on long-term basis for a period of 3 up to 5 years with the action period during 2026 - 2030.

2. Respect for the principles of transparent, competitive and reasonable pricing concerning the graphitized electrodes, including by use of the mechanisms of formular pricing providing dependence of the price of the graphitized electrodes on dynamics of change of the price quotations on the graphitized electrodes and raw materials published in open analytical sources in case of supply activity directly to consumers in state members of the Eurasian Economic Union.

3. Implementation of uninterrupted supplies of the graphitized electrodes directly to consumers in state members of the Eurasian Economic Union according to their requests and in strict accordance with conditions of the approved obligations.

4. Prioritization of deliveries of the graphitized electrodes to state members of the Eurasian Economic Union according to long-term agreements with consumers in state members of the Eurasian Economic Union using formular pricing before spot (short-term, one-time) deliveries to the market of the Eurasian Economic Union irrespectively conditions of such deliveries.
