About approval of the Regulations on the Advisory committee on technical regulation, application of sanitary, veterinary and phytosanitary measures

1. Approve the enclosed Regulations on the Advisory committee on technical regulation, application of sanitary, veterinary and phytosanitary measures.

2. Declare invalid the Decision of Board of the Eurasian economic commission of April 24, 2017 No. 37 "About the Advisory committee on technical regulation, application of sanitary, veterinary and phytosanitary measures".

3. This Decision shall enter into force upon the expiry of 30 calendar days from the date of its official publication.

Regulations on the Advisory committee on technical regulation, application of sanitary, veterinary and phytosanitary measures

I. General provisions

1. The advisory committee on technical regulation, application of sanitary, veterinary and phytosanitary measures (further - Committee) is created under Board of the Eurasian economic commission (further respectively - Board, the Commission) according to Items 7 and 44 of the Regulations on the Eurasian economic commission (appendix No. 1 to the Agreement on the Eurasian Economic Union of May 29, 2014 (further - the Agreement)).

The committee is the consultative body of the Commission providing preparation of offers, recommendations and carrying out consultations concerning technical regulation, standardization, accreditation of conformity assessment bodies, ensuring unity of measurements and application of sanitary, veterinary and sanitary and quarantine phytosanitary measures within the Eurasian Economic Union (further - the Union).

2. The committee in the activities is guided by the Agreement, other international treaties and acts of bodies of the Union, the Regulations of work of the Eurasian economic commission approved by the Decision of the Supreme Eurasian economic council of December 23, 2014 No. 98, and also this Provision.

II. Main objectives of Committee

3. The main objectives of Committee are:

a) preparation of recommendations for the Commission according to Item 46 of the Regulations on the Eurasian economic commission on questions of realization of provisions of Sections X and XI of the Agreement, including:

to enhancement of acts of bodies of the Union in spheres of technical regulation, standardization, accreditation of conformity assessment bodies, ensuring unity of measurements and application of sanitary, veterinary and sanitary and quarantine phytosanitary measures within the Union;

to ensuring coordinated actions of public authorities of the state members of the Union authorized in spheres of technical regulation, standardization, health care, sanitary and epidemiologic wellbeing of the population, veterinary science, quarantine of plants, agricultural industry, other industries of economy, ensuring unity of measurements within the Union, accreditation of the conformity assessment bodies authorized on implementation of the state control (supervision) of observance of requirements of technical regulations of the Union, and also on interaction with the Commission (further respectively - state members, authorized bodies), in case of implementation of the Agreement, other international treaties and acts of bodies of the Union in spheres of technical regulation, standardization, accreditation of conformity assessment bodies, ensuring unity of measurements and application of sanitary, veterinary and sanitary and quarantine phytosanitary measures within the Union;

to assessment of condition and the directions of enhancement of normative legal regulation in spheres of technical regulation, standardization, accreditation of conformity assessment bodies, ensuring unity of measurements and application of sanitary, veterinary and sanitary and quarantine phytosanitary measures within the Union;

to preparation of offers on introduction, application, change or cancellation of requirements in spheres of technical regulation, standardization, accreditation of conformity assessment bodies, ensuring unity of measurements and application of sanitary, veterinary and sanitary and quarantine phytosanitary measures within the Union, including preparation of the corresponding drafts of recommendations of the Commission;

b) consideration of the questions included in the list of questions on which the Board of the Eurasian economic commission shall hold consultations within the Advisory committee on technical regulation, application of sanitary, veterinary and phytosanitary measures before decision making of Board or Council of the Eurasian economic commission, No. approved by the order of Council of the Eurasian economic commission of March 17, 2016 7, according to Item 25 of the Regulations on the Eurasian economic commission;

c) implementation of examination of acts of bodies of the Union in scope of sanitary, veterinary and sanitary and quarantine phytosanitary measures within the Union regarding their compliance to international standards, decisions and recommendations according to the Regulations on single procedure for conducting examination of regulatory legal acts in scope of sanitary, veterinary and phytosanitary measures approved by the Decision of Board of the Eurasian economic commission of November 6, 2012 No. 212;

d) consideration of other questions in spheres of technical regulation, standardization, accreditation of conformity assessment bodies, ensuring unity of measurements and application of sanitary, veterinary and sanitary and quarantine phytosanitary measures within the Union.

III. Structure of Committee

4. The structure of Committee is created of heads (deputy managers) and (or) other officials (not below heads of structural divisions) authorized bodies based on offers of state members.

Committee from each state member representatives of the authorized bodies performing regulation in spheres according to the paragraph third the subitem "an" of Item 3 this provision without fail are included.

Based on offers of state members of Committee from each state member no more than 15 representatives, including no more than 3 representatives of business communities, scientific and public organizations, other independent experts are included (if necessary).

5. The structure of Committee affirms the order of Board of the Commission.
