According to Item 1 of article 7 of the Agreement of o the principles and approaches of implementation of the state control (supervision) of observance of requirements of technical regulations of the Eurasian Economic Union for the purpose of harmonization of the legislation of state members of the Eurasian Economic Union in the specified sphere of February 16, 2021 and within realization of Item 4.7.1 of the Strategic directions of development of Eurasian economic integration till 2025 approved by the Decision of the Supreme Eurasian economic council of December 11, 2020 No. 12, Council of the Eurasian economic commission DECIDED:

1. Approve the enclosed Order of interaction of state control (supervision) bodies behind observance of requirements of technical regulations of the Eurasian Economic Union of state members of the Eurasian Economic Union, and also state control (supervision) bodies with bodies or the legal entities authorized according to the legislation of state member on carrying out accreditation.

2. Information exchange of state control (supervision) bodies behind observance of requirements of technical regulations of the Eurasian Economic Union (further - the Union) state members of the Union (further respectively - state control (supervision) bodies, state members) among themselves, and also with bodies or the legal entities authorized according to the legislation of state member on carrying out accreditation (further - accreditation bodies), and the Eurasian economic commission by means of use of system of informing on products which are not conforming to requirements of technical regulations of the Union is performed concerning technical regulations of the Union (Customs union) according to the list according to appendix.

Information exchange concerning the technical regulations of the Union (Customs union) which are not included in the list provided by appendix to this Decision is performed no later than 60 months from Date of Introduction in action of general process "Forming, maintaining and use of system of informing on products which are not conforming to requirements of technical regulations of the Eurasian Economic Union".

3. If for the organization and holding actions for the state control (supervision) of observance of requirements of technical regulations of the Union the state control (supervision) body of one state member needs to receive the documents (set of documents) which formed the basis for issue (acceptance) of the document on assessment of conformity of products to requirements of the technical regulation of the Union in other state member it can send to state control (supervision) body and (or) accreditation body of this other state member the corresponding request in electronic form and (or) on paper. The state control (supervision) body and (or) accreditation body which received such request submit necessary documents according to the legislation of the state (in the presence of such documents or after their obtaining from certification body and (or) the applicant specified in the document on assessment of conformity of products to requirements of the technical regulation of the Union).

The documents and data carried by the legislation of state member to information of confidential nature (including commercial, tax, office and other confidential information, except for the state secret (the state secrets)) or to office information of limited distribution, are represented to state control (supervision) body with observance of the requirements established by the legislation of state member concerning such information. The state control (supervision) body which received such documents and (or) data provides the necessary level of information security and observance of requirements of the legislation of the state during the obtaining, transfer, collection, processing, accumulating, storage and use of the documents containing confidential information and documents of limited distribution.

4. This Decision becomes effective after 30 calendar days from the date of its official publication, except for Items 1 - 11 Procedures, approved by this Decision which become effective from the effective date orders of Board of the Eurasian economic commission about enforcement of general process "Forming, maintaining and use of system of informing on products which are not conforming to requirements of technical regulations of the Eurasian Economic Union".

This Procedure determines rules of interaction of state control (supervision) bodies behind observance of requirements of technical regulations of the Eurasian Economic Union (Customs union) of state members of the Union (further respectively - state control (supervision) bodies, the Union, state members) among themselves, with bodies or the legal entities authorized according to the legislation of state members on carrying out accreditation (further - accreditation bodies), and also with customs authorities of state members based on data on products which are not conforming to requirements of technical regulations of the Union and the taken measures placed in general information resources of the integrated information system of the Union.
