About enhancement of procedure for sale of premises by agricultural organizations

1. Make changes to the Presidential decree of the Republic of Belarus of June 17, 2011 No. 253 "About single questions of purchase and sale of apartment houses (apartments) of agricultural organizations" (appendix).

The list of the changes made to the Presidential decree of the Republic of Belarus of June 17, 2011 No. 253

1. In Item 3:

the fourth to state part in the following edition:

"In case of recognition of auction cancelled, and also in case of refusal of the single participant of auction of acquisition of premises at the initial price of the sale increased by 5 percent repeated auctions for sale of premises with lowering of starting price of sale are made:

no more than for 50 percent inclusive after the first cancelled auction, and also in case of refusal the single participant from acquisition of premises at the initial price increased by 5 percent;

no more than for 80 percent inclusive after the cancelled auction held according to the paragraph the second this part, and also in case of refusal the single participant from acquisition of premises at the initial price increased by 5 percent.";

* For the purposes of this Decree the baking plate is understood by debt of agricultural organization on soft credit the debt of agricultural organization which is registered in Belagroprombank open joint stock company on the soft credit (principal debt, percent, penalty fee, penalties and other payments according to the credit agreement, and also the legal costs and other expenses connected with recovery by enforcement of debt) provided on construction, reconstruction or acquisition of the sold apartment house (apartment), fee, connected with the state registration of real estate.".

2. The sixth Item 6 to state part in the following edition:

"In case of sale of premises by agricultural organizations at auction, including premises of the state housing stock, means from their sale:

go to Belagroprombank open joint stock company for debt repayment of agricultural organizations on soft credits (in case of its availability);

are enlisted on the current (settlement) bank accounts of agricultural organizations, except for the funds allocated to Belagroprombank open joint stock company according to the paragraph the second this part.".

3. The second Item 9-2 to state part in the following edition:

"The anti-recessionary managing director signs with the relevant local executive and administrative organ of basic territorial level the contract of assignment of the requirement with the notification of the citizen on the taken place transition of the rights of the creditor to local executive and administrative organ of basic territorial level, including on new details for payment by the citizen of cost of the premises sold by installments within 20 working days:

after the introduction in legal force of the judgment about recognition of the debtor - the legal entity the bankrupt and opening of liquidating production - in case of availability of purchase and sale agreements of premises for date of opening concerning agricultural organization of liquidating production;

from the date of the conclusion of the purchase and sale agreement of premises, but no later than completion of liquidating production - in case of sale of populated apartment houses (apartments) after opening concerning agricultural organization of liquidating production.".
