About artificial intelligence
In this Law the following basic concepts are used:
1) library of data - set of the structured and (or) grouped data suitable for training of models of artificial intelligence;
2) the manufacturer of library of data - person who organized collection, processing and structuring the data suitable for training of models of artificial intelligence;
3) artificial intelligence - the functional capability to imitation of the cognitive functions characteristic of the person providing the results comparable to results of intellectual activities of the person or exceeding them;
4) synthetic results of activities of systems of artificial intelligence - the images, video, audio, texts or their combinations created or changed by system of artificial intelligence, imitating appearance, voice, behavior of physical person or event which actually did not occur;
5) system of artificial intelligence - the object of informatization functioning on the basis of one or several models of artificial intelligence;
6) result of activities of system of artificial intelligence - information or the decision irrespective of form of their provision, or action, including the works and (or) services made and (or) rendered by system of artificial intelligence;
7) the user of system of artificial intelligence (further - the user) - person using system of artificial intelligence for accomplishment of specific function and (or) task;
8) the model of artificial intelligence - the software product developed for accomplishment of specialized tasks and capable to adapt to the changing conditions to study at basis of the accumulated experience and to optimize processes and results of the activities;
9) training of model of artificial intelligence - processing of the provided or cumulative data with the purpose of forming or enhancement of capability of model to carry out intellectual tasks;
10) authorized body in the field of artificial intelligence (further - authorized body) - the central executive body performing management and cross-industry coordination in the field of artificial intelligence;
11) national platform of artificial intelligence - the technological framework intended for collection, processing, storage and distribution of libraries of data and provision of services in the field of artificial intelligence;
12) software product of national platform of artificial intelligence (further - platform software product) - the software product developed, placed on national platform of artificial intelligence;
13) the operator of national platform of artificial intelligence - the legal entity to who ensuring development and functioning of national platform of artificial intelligence is assigned;
14) machine-readable form - the form of provision of information allowing its automated reading and processing by systems of artificial intelligence or other software;
15) text request - the request expressed in writing or electronic form, the task or other message of the user sent to system of artificial intelligence for receipt of result of its activities.
1. The legislation of the Republic of Kazakhstan in the field of artificial intelligence is based on the Constitution of the Republic of Kazakhstan, consists of this Law and other regulatory legal acts of the Republic of Kazakhstan.
2. The international agreements ratified by the Republic of Kazakhstan have priority before this Law. The procedure and conditions of action in the territory of the Republic of Kazakhstan of international treaties which participant is the Republic of Kazakhstan are determined by the legislation of the Republic of Kazakhstan.
1. The purposes of state regulation of the public relations in the field of artificial intelligence are ensuring development of artificial intelligence and stimulation of its implementation in different areas for improvement of quality of human life and increase in efficiency of economy.
2. The main objectives of state regulation in the field of artificial intelligence are:
1) determination of legal and organizational basis of regulation of the public relations in the field of artificial intelligence;
2) ensuring transparency and safety in use of systems of artificial intelligence, and also results of activities of systems of artificial intelligence;
3) creating favorable conditions for investment attraction in development of the sphere of artificial intelligence;
4) the state support of researches and innovations in the field of artificial intelligence.
State regulation of the public relations in the field of artificial intelligence is based on the following principles:
1) legality;
2) justice and equality;
3) transparency and explanation;
4) responsibility and submission to control;
5) priority of wellbeing of the person, free will in adoption of decisions by it;
6) data protection and confidentiality;
7) safety and securities.
Subjects of the relations in the field of artificial intelligence, state bodies, officials of state bodies when implementing state regulation in the field of artificial intelligence shall observe requirements of the Constitution of the Republic of Kazakhstan, this Law and other regulatory legal acts of the Republic of Kazakhstan.
Systems of artificial intelligence shall be created and be operated so that to provide justice and equality with recognition of advantage of each person, its equal value, the rights, freedoms and legitimate interests, excepting any discrimination based on origin, social, official and property status, floor, race, nationality, language, the relation to religion, beliefs, the residence or on any other circumstances.
1. The complete information about operational and other characteristics and restrictions of system of artificial intelligence for ensuring target use of system of artificial intelligence shall be provided to users.
2. The user on whom decisions with use of systems of artificial intelligence are made has the right to be informed on procedure for the automated processing and its effects, about opportunity to declare objection against the automated processing, and also procedure for protection of the rights, freedoms and legitimate interests.
