1. Approve Regulations on statistical transfer of amounts of energy from renewable sources between agreement parties about creation of Energy community it (is applied).

To the central industry body of public management in the field of power to notify the Secretariat of Energy community on all agreements on statistical transfer of amounts of energy signed with other contracting parties not later than in 12 months after the termination every year during which the transfer was in force. Information sent to the Secretariat shall include data on amount and the price of the corresponding statistical transfer.

3. Statistical transfers become effective after accomplishment by contracting parties with which the agreement on statistical transfer, all obligations under the specified agreement was signed.

4. The financial resources necessary for purchase of statistical transfer are provided from the government budget and are planned according to the Law No. 181/2014 on public finance and budget and tax responsibility. Income gained from sale of statistical transfer is transferred in full into the government budget and used for projects implementation of energy efficiency and/or mastering of energy from renewable sources according to the procedure, established by the Government.

5. Impose control over the implementation of this resolution on the Department of Energy.

Chapter I. General provisions

Section 1 Purpose and determinations

1. The regulations on statistical transfer of amounts of energy from renewable sources between agreement parties about creation of Energy community (further - the Provision) determine the mechanism of international cooperation for statistical transfer of amounts of energy from renewable sources.

2. The mechanism of international cooperation creates opportunities for cost reduction, necessary for accomplishment of the national task provided in Item b) parts (1) article 6 of the Law No. 10/2016 on promotion of energy use from renewable sources, and flexibility concerning accomplishment of obligations within the Agreement on creation of Energy community provides.

3. In this Provision the concepts determined in the Law No. 10/2016 on promotion of energy use from renewable sources and also the following basic concepts are used:

3.1. the contracting party - the state - the contracting party of Energy community according to the Agreement on creation of Energy community;

3.2. the statistical transfer - virtual transfer to one contracting party of statistical size of certain amount of the energy from renewable sources made in the territory of other contracting party owing to what the corresponding amount of energy is excluded at the rate of energy share from renewable sources of the contracting party in the territory of which this amount of energy from renewable sources was made, and is added when calculating share of energy from renewable sources for the contracting party to which transfer is performed;

3.3. amount of statistical transfer - the transferred energy amount from renewable sources which is deductible from energy share from renewable sources of the selling contracting party and to addition to energy share from renewable sources of the buying contracting party according to Chapter II;

3.4. the agreement on statistical transfer - the agreement signed on behalf of the Government with other contracting party for implementation based on the transaction of purchase and sale of statistical transfer between contracting parties;

3.5. estimative criterion - the smallest price offered in case of purchase and the highest price in case of sale of statistical transfer included in the offer submitted the contracting party;

3.6. the offer - the document submitted by the contracting party in selection process in which the price and amount requested by the contracting party for statistical transfer is specified;

3.7. minimum price - the price, acceptable for the Republic of Moldova, for sale of statistical transfer to the contracting party determined during the cost analysis and benefits which is carried out based on Item 18;

3.8. maximum price - the price, acceptable for the Republic of Moldova, for purchase of statistical transfer from the contracting party determined during the cost analysis and benefits which is carried out based on Item 18;

3.9. energy share from renewable sources - ratio in percentage expression of gross end use energy consumption from renewable sources and gross end use energy consumption, received from all power sources.

Section 2 General principles and tasks

4. The statistical transfer is based on objective, transparent and non-discriminatory criteria.

5. The statistical transfer can be performed between all interested contracting parties according to this Provision.

6. For the purpose of ensuring transparency in the course of the organization of tenders the central industry body of public management in the field of power publishes on the official web page and constantly updates the following information:

6.1. intention to purchase or sell statistical transfer, including detailed data on amount of statistical transfer, maximum price for purchase or minimum price for sale;
