About approval of the Program of compensation of advance in price on the electric power for the companies of the Republic of Moldova

Based on Item c) article 12 of the Law No. 71/2023 on subsidizing of agricultural industry in the rural zone (The official monitor of the Republic of Moldova, 2023, Art. No. 134-137, 209), with subsequent changes, articles 9 and 11 of the Law No. 179/2016 on the small and medium companies (The official monitor of the Republic of Moldova, 2016, Art. No. 306-313, 651), with subsequent changes, DECIDES: the Government

1. Approve the Program of compensation of advance in price on the electric power for the companies of the Republic of Moldova it (is applied).

2. Develop, administer and provide to public organization "Agency of Electronic Control" maintenance of the electronic platform intended for collection, processing and approval of statements for compensation of price difference on the electric power on the basis of the agreement with public organization "Organization for Development of Entrepreneurship" which will exercise operational management of verification process and calculation of compensations.

3. The partial compensation of difference of regulated price for the electric power is provided from the effective date this resolution till December 31, 2025 within the available budget.

4. The companies which submitted applications on the government portal of legal units (MCabinet) to the period from January 10, 2025 to February 20, 2025, according to Item 3.5 of the Order of the Commission on emergency situations of the Republic of Moldova No. 4/2025, but not received compensation, repeatedly submit applications till March 30, 2025.

5. Remaining balance of the financial resources allocated to the Ministry of Economic Development and digitalization from intervention fund of the Government based on Item 3.10 of the Order of the Commission on emergency situations of the Republic of Moldova No. 4/2025 (including the acts issued for the purpose of its execution), are listed to public organization "Organization for Development of Entrepreneurship" for accomplishment of this resolution.

6. To impose control over the implementation of this resolution on the Ministry of Economic Development and digitalizations and the Ministry of Agriculture and the food industry.

7. This resolution becomes effective from the date of publication in the Official monitor of the Republic of Moldova.

The program of compensation of advance in price on the electric power for the companies of the Republic of Moldova

I. General provisions

1. The program of compensation of advance in price on the electric power for the companies of the Republic of Moldova (further – the Program) establishes the procedure, procedure and conditions of partial compensation of difference of regulated price for the electric power for the companies.

2. The purpose of this Program is support of the companies from priority sectors by partial compensation of increase in regulated prices for the electric power for the purpose of preserving competitiveness and economic stability.

3. This Program is applied to the companies which are acquiring the electric power at owners of the license for electrical supply at regulated prices or not having direct contractual relations with electric power suppliers, but buying the electric power from the wholesale consumer or as the user in the closed electrical distribution system, performing the main activities in the areas specified in appendix No. 1.

4. Implementation of this Program is assigned to public organization "Organization for Development of Entrepreneurship" and to intervention and payments Agency in the field of agricultural industry.

5. For the purpose of accomplishment of this Program the public organization "Organization for Development of Entrepreneurship" and intervention and payments Agency in the field of agricultural industry will be developed and will publish the application guide on the official website of the organization.

6. The size and procedure for covering of the administrative expenses incurred by public organization "Organization for Development of Entrepreneurship" in implementation process affirm Council of organization from the administrative budget of organization.

7. For the purposes of this Program the following concepts are used:

7.1. compensation – the financial support provided to the companies in the form of the little significant help according to provisions of the Law No. 139/2012 on government assistance or in the form of additional payment according to provisions of the Law No. 71/2023 on subsidizing of agricultural industry in the rural zone for the purpose of partial covering of the additional costs which resulted from advance in price on the electric power;

7.2. the supplier of compensation (further – the supplier):

7.2.1. public organization "Organization for Development of Entrepreneurship" – in case of provision of compensation in the form of the little significant help;

7.2.2. Intervention and payments agency in the field of agricultural industry – in case of provision of compensation in the form of additional payment;

7.3. the receiver of compensation (further – the receiver) – any company answering to the conditions specified in Item 9;

7.4. difference of regulated price as a result of increase in regulated prices for electrical supply – difference between the regulated price for electrical supply for the compensated period and the corresponding price in December, 2024;

7.5. corrective the invoice with the sign "minus" – the document which is written out by owners of the license for electrical supply at regulated prices to which earlier is adjusted the invoice by reducing the amount which was originally subject to payment by the receiver after the adjustment of energy consumption or regulated prices applied to already compensated period;
