1. Approve Regulations on procedure for planning of public procurements it (is applied).
2. Declare invalid the Order of the Government No. 1419/2016 about approval of the Regulations on procedure for planning of agreements on public procurements (The official monitor of the Republic of Moldova, 2017, No. 1, the Art. 4).
3. This resolution becomes effective after one month from the date of publication in the Official monitor of the Republic of Moldova.

1. The regulations on procedure for planning of public procurements (further - the Provision) establish framework and the procedure of planning of public procurements for the purpose of ensuring effective, transparent and proper management of the financial resources allocated for implementation of public procurements.
2. The procedure of public procurements, including public procurements of small cost, irrespective of estimated value of the purchase agreement, is initiated only after its inclusion in the preliminary or annual plan of purchases and when ensuring availability of necessary financial resources. In case of the procurements of small cost conducted for the urgency reasons the conclusion of agreements before modification of the preliminary or annual plan of purchases on condition of updating of this plan within 15 days is allowed.
3. Agreements on public procurements which subject is both rendering services, and performance of works, are awarded according to the provisions applicable to the purchase type characterizing the main subject of the agreement. The main subject is determined proceeding from the greatest estimated value of the corresponding services or works.

The buying body shall reveal and analyze real needs, risks and the existing problems which prove need of implementation of public procurement for the purpose of realization of the purposes and actions provided in documents national and sectoral the politician in plans of organizations, and also in other planning documents.

After identification of needs the buying body classifies them according to the priorities established in documents institutional and sectoral the politician, considering delivery dates of goods, rendering services or performance of works, and also availability of financial resources, for the purpose of effective use of resources and proper carrying out procurement process.
7. The analysis of needs is performed with involvement of structural divisions of the buying body and, if necessary, by means of consultations with direct or indirect beneficiaries of purchase, for the purpose of documentary reasons for the made decisions and ensuring proper planning of procedures of public procurements.
8. Each structural division fills and directs the request for need for purchases, using standard form according to appendix No. 1.
9. The working group on purchases analyzes the offers on needs provided by structural divisions taking into account possibility of optimization of quantity and cost, depending on change of needs and availability of financial resources.
10. The file connected with offers of structural divisions surely includes the explanatory note about needs in purchases, quantitative estimates, delivery dates, rendering services or performance of works and, if necessary, the conclusion of financial division, and also any other documents, stipulated by the legislation.
11. The central buying body develops the consolidated plans of centralized purchases which include the needs transferred by the buying bodies beneficiaries and performs powers on planning, coordination and consolidation of centralized purchases, including according to the sectoral politicians and programs approved at the national level and the programs financed from external sources.
12. The central buying body initiates process of identification of needs in the consolidated purchases by means of request of the standardized information at organizations beneficiaries. The transmitted data shall contain reasons concerning quantity, terms and specifications, being the approved beneficiaries.
13. Within planning process of public procurements the buying body performs validation and confirmation of the revealed needs for the purpose of their inclusion in procurement plan in case of observance of internal procedures of managerial supervision and provisions of the national legal system.
16. The value assessment of the agreement of purchase is based on documentary confirmed analysis of the expected expenses reflecting real costs for goods, services or works taking into account market conditions and financial rules.
17. Depending on nature and complexity of purchase, the buying body estimates feasibility of separation of the contract for lots for the purpose of stimulation of the competition and participation of small and medium scale enterprises.
18. Planning of public procurements of goods is performed taking into account indicators of the average market prices, the place of delivery of goods, their complexity, the purpose of purchase, completion date of agreements (the agreements of continuous execution or agreements of one-time execution meeting the specific need at present, without continuous execution - not requiring maintenance of guarantees, etc.).
19. Agreements of one-time execution on public procurements of goods represent the agreements providing one-time and bystry delivery of goods, without subsequent obligations on their maintenance, intended for satisfaction of specific and accurate needs.
20. Agreements of continuous execution on public procurements of goods represent the agreements providing the consecutive deliveries of goods to certain period including constant control of execution, establishment of intermediate terms, quality assurances and sanctions for non-execution.
21. Planning of agreements on public procurements of services is performed taking into account the place of their provision, the purpose and term of rendering (continuous or one-time execution).
