About approval of the Regulations on the permitted wine-making practicians and restrictions applied to production and storage of wine-making products

Based on part (1) Articles 17, parts (3) Article 21 and part (1) article 28 of the Law No. 57/2006 on grapes and wine (repeated publication: The official monitor of the Republic of Moldova, 2013, Art. No. 64-68, 193), with subsequent changes, DECIDES: the Government

1. Approve Regulations on the permitted wine-making practicians and restrictions applied to production and storage of wine-making products it (is applied).

2. The inventories of wine-making products made before the date of entry into force of this resolution can be realized for consumption by the person according to the rules existing before the corresponding date.

3. Items 29-1, 115-1, 115-2 and 115-3, 117 - 143-1, 145 and appendix No. 10 to the Regulations on the organization of the grape and wine-making market approved by the Order of the Government No. 356/2015 (Official monitor of the Republic of Moldova, 2015, Art. No. 150-159, 399), with subsequent changes, to recognize invalid.

4. To impose control over the implementation of this resolution on the National agency on safety of foodstuff.

5. This resolution becomes effective after 6 months from the date of publication in the Official monitor of the Republic of Moldova.

Regulations on the permitted wine-making practicians and restrictions applied to production and storage of wine-making products

This Provision:

- shifts Article 80 and appendix VIII of Regulations (EU) No. 1308/2013 of the European parliament and Council of December 17, 2013 about creation of the general organization of the markets of agricultural products and cancellation of Regulations (EEC) No. 922/72, No. 234/79, (EC) No. 1037/2001 and (EC) No. 1234/2007 of the Council published in the Official magazine of the European Union by L 347 of December 20, 2013 (CELEX: 32013R1308), with the last amendments made by Regulations (EU) 2024/1143 of the European parliament and Council of April 11, 2024 and

- partially shifts the Delegated regulations (EU) 2019/934 of the Commission of March 12, 2019 supplementing Regulations (EU) No. 1308/2013 of the European parliament and Council concerning the wine-making areas in which the fortress of alcohol can be increased permitted wine-making the practician and the restrictions applied to production and storage of wine-making products, the minimum content of alcohol in by-products and their utilizations, and also publication of newsletters of OIV published in the Official magazine of the European Union by L 149 of June 7, 2019 (CELEX: 32019R0934), with the last amendments made by the Delegated regulations (EU) 2022/68 of the Commission of October 27, 2021.

Chapter I. Scope

1. The regulations on the permitted wine-making practicians and restrictions applied to production and storage of wine-making products (further - the Provision), establish the regulations concerning the permitted wine-making practice and restrictions applied to production and storage of wine-making products (further - products) determined in appendices No. 4 and 5 to the Regulations on the organization of the grape and wine-making market approved by the Order of the Government No. 356/2015 (further - Regulations on the organization of the grape and wine-making market), the minimum percentage of alcohol in by-products and publications of newsletters of the International organization of grapes and wine (further - OIV).

2. For production and preserving products listed in appendices No. 4 and 5 to the Regulations on the organization of the grape and wine-making market only the permitted wine-making practicians according to appendix No. 1, in which are used conditions and borders of their use are specified, and also the permitted wine-making connections according to appendix No. 2, in which are specified conditions and borders of their use.

3. Item 2 is not applied in the relation:

3.1. grape juice and the concentrated grape juice; and

3.2. the grape mash and the concentrated grape mash intended for production of grape juice.

4. The permitted wine-making practicians are applied only for the purpose of providing high-quality winemaking, good safety or increase in value of product.

5. The Ministry of Agriculture and the food industry publishes the files of the International code of wine-making practice of OIV specified in appendices No. 1 and 2 in the Official monitor of the Republic of Moldova.

Chapter II. Wine-making practicians

Section 1. Procedures of enrichment

6. Process of enrichment for the purpose of increase in natural volume fraction of ethyl alcohol of fresh grapes, mash grape, mashes of the grape partially fermented, young wine which is even in process of fermentation, and the wine received from wine of grades of grapes which can be classified according to article 10 of the Law No. 57/2006 on grapes and wine can be performed:

6.1. in case of fresh grapes, mash of the grape partially fermented or young wine which is even in process of fermentation - only by addition of sucrose, mash grape concentrated or mashes grape concentrated rectified;

6.2. in case of grape mash - only by addition of sucrose, mash grape concentrated or mashes grape concentrated rectified or by partial concoction, including the return osmosis;

6.3. in case of wine - only by partial cold concentration.

7. The processes specified in Item 6, exclude each other in cases when wine or mash grape is enriched with mash grape concentrated or mash by the grape concentrated rectified.

8. Sucrose addition about which it is told in subitems 6.1 and 6. 2, it can be performed only by sweetening without water.

9. The following limits of enrichment by addition of sucrose, mash grape concentrated or mashes of the grape concentrated rectified are resolved:
