About measures for implementation of technologies of satellite communication for expansion of scope communication in the remote areas of the republic

For the purpose of the accelerated development of digital infrastructure in the republic, reducings digital gap between the urban and rural areas, expansions of scope of communication services in the remote regions, developments of digital economy, and also realization of the tasks designated in Strategy "Digital Uzbekistan - 2030", I decide:

I. Priority directions

1. Determine the priority directions of development of technologies of satellite communication:

(a) creation of regulatory framework of implementation and use of average and low-orbit satellite communication systems;

(b) creating favorable conditions for provision of telecommunication services in the remote regions and in the territories which are not covered by land networks;

(c) providing by means of satellite communication of reliability of networks and reserve communication in emergency situations;

(d) determination of organizational and technical bases of information security support when using satellite communication systems.

II. Main requirements

2. Determine that implementation of satellite communication systems and provision of services of the satellite Internet are the licensed types of activity in the field of telecommunications in the territory of the Republic of Uzbekistan.

3. Determine the main requirements of activities for implementation of the satellite communication system:

(a) registration of permissions to selection of radio frequencies and use of radio-electronic means;

(b) creation of the legal entity in the territory of the Republic of Uzbekistan or cooperation with the local operator of telecommunications;

(c) construction of the central terrestrial station (Gateway) on territories of the country and observance of requirements of information security;

(d) storage of user data in the territory of the republic.

III. Parcels of land and infrastructure

4. Determine that in case of placement of infrastructure of satellite communication (the central terrestrial stations, terminals and other active devices of infrastructure of satellite communication) the procedure for execution of lease agreements on investment of funds of telecommunications is applied.

IV. Privileges and preferences

5. Establish procedure according to which since January 1, 2026 for a period of 5 years within the projects connected with the organization of average and low-orbit satellite communication networks through the central terrestrial station in the territory of Uzbekistan:

(a) purchase and equipment maintenance, the software products, spare parts and component parts relating to communication satellite networks of operators of telecommunications are performed by the conclusion of direct contracts with vendors and (or) suppliers of the equipment of satellite communication on the basis of negotiations without carrying out the tender (competitive) biddings;

(b) the imported equipment, software products, spare parts and component parts are exempted from customs payments (except for charges for customs clearance);

(c) operators of telecommunications are exempted from payment for use of radio-frequency range by average and low-orbit satellite communication networks (except for the payment connected with the organization of direct connection from the companion to the device of the ultimate user (Direct-to-Device) and from the companion directly to the mobile terminal of communication (Direct-to-Cellular) in network of mobile satellite communication, and also systems of the mobile terrestrial station (ESIM) in cars and trains);

(d) the services provided by operators of communication satellite networks via the satellite communication system are exempted from the value added tax;

(e) constructions of telecommunications and their parcels of land on which the central terrestrial stations, terminals and other active devices of infrastructure of satellite communication are placed are exempted from the property tax and the land tax;

(g) operators of communication satellite networks are exempted from the income tax for the services rendered via the created satellite communication system.

6. To the Ministry of Economics and finance, to the Tax Committee and the Ministry of digital technologies in three-months time to introduce to the Cabinet of Ministers the bill, this resolution providing proceeding from Item 5 modification and amendments in the Tax code.

V. Organizational actions

7. Permit till December 31, 2030 to the operators of telecommunications having communication satellite networks within 6 months from the date of receipt of the license in the field of telecommunications for implementation of services of satellite communication:

(a) implementation project and installation and construction works on the central terrestrial stations and terminal platforms by fast-track method;

(b) registration of permissions to acquisition, installation, import to the territory of the Republic of Uzbekistan and operation of radio-electronic means, and also the acceptance act in operation of means and constructions of telecommunications and permission to their use with simultaneous rendering services of telecommunications, on condition of fulfillment of requirements of subitems "b" - "" of Item 3 of this resolution.

VI. Organization, providing and control of execution of the resolution

8. To the ministry of digital technologies in two-month time to make in the Cabinet of Ministers offers on the changes and amendments in acts of the legislation following from this resolution.

9. To perform monitoring of execution of this resolution in the following procedure:

(a) To the ministry of digital technologies annually till February 15 to carry out monitoring of execution of the resolution and to enter results of monitoring to Audit Chamber and the Ministry of Justice;

(b) To Audit Chamber together with the Ministry of Justice to exercise control of execution of the resolution on the basis of the Plan of conducting monitoring and annually till February 25 to provide information in Administration of the President of the Republic of Uzbekistan.

10. Assign to the minister of digital technologies Sh. H. Shermatov the personal responsibility for the effective organization of execution of this resolution.

11. To assign discussion of course of execution of this resolution, implementation of coordination and control of activities of the responsible organizations to the Prime Minister of the Republic of Uzbekistan A. N. Aripov.
