In recent years in our country the large-scale reforms directed to further democratization of the judicial and legal sphere and realization of constitutional rights of citizens are performed.
In the new edition of the Constitution of the Republic of Uzbekistan as one of the most important guarantees of providing the rights and freedoms of citizens it is fixed that the rights of the victims from offenses are protected by the law, and the state creates conditions for compensation of the damage caused to the victims.
However in cases when the measure of restraint in the form of detention is not applied to persons who committed crime, cases of departure of such persons out of limits of the territory of the Republic of Uzbekistan for the purpose of concealment from inquiry, the investigation or court take place. As a result the possibility of recovery of the rights of the victims from crimes and compensation of the caused damage by it decreases.
This Law makes additions and changes to the laws of the Republic of Uzbekistan "About prosecutor's office", "About courts", and also in the Code of penal procedure of the Republic of Uzbekistan, the rights of the suspect, the person accused or the defendant to departure from the Republic of Uzbekistan by the investigator, investigator, prosecutor or court providing procedure for temporary restriction if the measure of restraint in the form of detention is not applied to such persons, but good reasons to believe are had that they having left the territories of the Republic of Uzbekistan can evade without valid excuse from inquiry, pretrial investigation or court.
