DECISION OF BOARD OF THE EURASIAN ECONOMIC COMMISSION

About application of anti-dumping measure by means of introduction of anti-dumping duty concerning the titanium dioxide coming from People's Republic of China and imported on customs area of the Eurasian Economic Union

According to Item 107 of the Protocol on application of special protective, anti-dumping and countervailing measures in relation to the third countries () (further – the Protocol) and based on the report of Department of protection of the domestic market of the Eurasian economic commission the Board of the Eurasian economic commission SOLVED appendix No. 8 to the Agreement on the Eurasian Economic Union of May 29, 2014:

1. Apply anti-dumping measure by means of introduction of anti-dumping duty in sizes according to appendix No. 1 concerning imported on customs area of the Eurasian Economic Union (further – the Union) the pigments made on the basis of titanium dioxide, containing 80 Mas. % or more titanium dioxide in terms of solid (except for kinds of pigments according to the list according to appendix the No. 2) coming from People's Republic of China and classified by code 3206 11 000 0 of the CN FEA EEU (further – titanium dioxide), having established effective period of this anti-dumping measure of 5 years.

2. Approve the price obligations accepted by producers according to the list according to appendix No. 3.

3. Determine that the anti-dumping duty provided by this Decision is not levied concerning the titanium dioxide made by the producers specified in the list provided by appendix No. 3 to this Decision, in the presence at the customs applicant of such goods on registration date of the declaration on goods of the manufacturer's certificate of origin in form according to appendix No. 4, of the relevant producer signed by the authorized employee and such producer assured by seal and in case of the statement of data on such certificate in the declaration goods.

4. To department of protection of the domestic market of the Eurasian economic commission:

send to the state bodies of state members of the Union (further – state members) authorized in the field of customs affairs, specimen signatures of authorized employees and prints of seals of the producers specified in the list provided by appendix No. 3 to this Decision;

exercise control of execution of the price obligations approved by this Decision;

perform monitoring of observance of the recommended approaches to supply activity of goods provided by Titanic Investments limited liability company in state members according to appendix No. 5;

in case of non-compliance by Titanic Investments limited liability company with the specified recommended approaches to make repeated anti-dumping investigation according to Item 110 of the Protocol.

5. Determine that the anti-dumping duty provided by this Decision is not levied when importing to customs area of the Union of titanium dioxide within annual amounts (outside price obligations) in the amount of 250 tons for the Republic of Armenia, 4 500 tons for the Republic of Belarus, goods, held for use in case of production, from which at least 2 000 tons for production of paper basis for decorative facing materials, 5 000 tons for the Republic of Kazakhstan and 300 tons for the Kyrgyz Republic in the presence at the customs applicant on registration date of the declaration on goods of the document confirming purpose of the titanium dioxide issued by authorized body of the executive authority of state member on which territory its import, and the containing data on quantity of imported goods is performed. Data on such document are subject to the statement in the declaration on goods.

6. To provide to the state bodies of state members authorized in the field of customs affairs collection of the anti-dumping duty provided by this Decision, being guided both by code of the CN FEA EEU, and description of goods.

7. This Decision becomes effective after 30 calendar days from the date of its official publication.
