About introduction of the moratorium on trade production of fish in some water storage basins

For the purpose of preserving, increase in fish inventories, improvement of the habitat of fish and conditions of its reproduction in fishery reservoirs, according to the subitem 7 parts of 1 Article 36, article 38 of the Law of the Kyrgyz Republic "About aquaculture, fishery and protection of water biological resources", being guided by articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic", the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Announce temporary ban (moratorium) for a period of three years on trade production (catch), transportation, realization, storage, acquisition and export of all species of fish living in fishery reservoirs of the state value: Toktogul, Bazar-Korgonsky, Kurpsaysky, Shamaldysaysky, Tash Kumyrsk, Uch-Korgonsky and Kirov water storage basins (further - water storage basins), except as specified:

1) implementation of cage fish breeding;

2) organizations and carrying out amateur and sports fishery;

3) carrying out the approved annual planned works on artificial reproduction of fish inventories;

4) holding research actions and icthyological monitoring of condition of population of fish.

2. To the ministry of water resources, agricultural industry and processing industry of the Kyrgyz Republic:

To suspend 1) temporarily for a period of three years issue of fishery documents for production (catch) of fish in the water storage basins specified in Item 1 of this resolution, except as specified carrying out:

- the planned works on artificial reproduction of fish inventories approved and coordinated in accordance with the established procedure:

- research actions, icthyological monitoring of condition of water biological resources;

- organized forms of amateur and sports fishery;

2) together with Institute of biology of National academy of Sciences of the Kyrgyz Republic to provide implementation of measures for impact assessment of the established moratorium on preserving and increase in fish inventories by carrying out annual scientific icthyological research and monitoring of condition of raw fish inventories in the water storage basins specified in Item 1 of this resolution;

3) regularly during operation of the moratorium to carry out works on artificial reproduction of cyprinid and herbivorous species of fish for the purpose of stocking of the water storage basins specified in Item 1 of this resolution, and increase in fish inventories;

4) annually till December 1 to provide information on execution of this resolution in Administration of the President of the Kyrgyz Republic.

3. To provide to the ministry of natural resources, ecology and technical supervision of the Kyrgyz Republic coordination of collateral actions of nature protection, law enforcement agencies with local public administrations and local government bodies of the Jalal-Abad and Talas regions of the Kyrgyz Republic concerning prevention of cases of illegal production (catch) of fish and poaching in the water storage basins specified in Item 1 of this resolution.

4. To the Ministry of Internal Affairs of the Kyrgyz Republic to render every possible assistance to authorized state body in the field of environmental protection in actions for suppression of cases of poaching in the water storage basins specified in Item 1 of this resolution.

5. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

6. This resolution becomes effective after ten days from the date of official publication.
