About approval of the Technical regulation about restriction of use of certain dangerous substances in the electric and electronic equipment

Based on Item b) Article 6 and part (5) article 17 of the Law No. 277/2018 on chemicals (The official monitor of the Republic of Moldova, 2019, Art. No. 49-58, 109), with subsequent changes, and also parts (3) article 50 of the Law No. 209/2016 on waste (The official monitor of the Republic of Moldova, 2024, Art. No. 260-263, 373), with subsequent changes, DECIDES: the Government

This resolution shifts the Directive 2011/65/EU of the European parliament and Council of June 8, 2011 about restriction of use of certain dangerous substances in the electric and electronic equipment, CELEX: 320111L0065, published in the Official magazine of the European Union by L 174 of June 1, 2011, with the last changes made by the Delegated directive (EU) 2024/1416 of Council of March 13, 2024.

1. Approve the Technical regulation about restriction of use of certain dangerous substances in the electric and electronic equipment it (is applied).

2. This resolution becomes effective after 12 months from the date of publication in the Official monitor of the Republic of Moldova, except for Items 15, of 16, 63 and 66-68, and also appendices No. 5 to the Technical regulation about restriction of use of certain dangerous substances in the electric and electronic equipment which become effective from the effective date the law on ratification of the Agreement on assessment of conformity and recognition of industrial products between the Republic of Moldova and the European Union.

3. Before date of accession of the Republic of Moldova to the European Union:

3.1. placement in the market of the electric and electronic equipment with marking of compliance of SM put according to provisions of the Law No. 235/2011 on activities for accreditation and assessment of conformity is allowed;

3.2. the producer or his authorized representative puts mark of conformity of SM and issues the declaration of conformity in case assessment of conformity of the electric and electronic equipment intended for the national market is performed with use of the procedure provided in appendix No. 7 to the Technical regulation about restriction of use of certain dangerous substances in the electric and electronic equipment. Availability of marking of CE on the electric and electronic equipment excludes need of drawing on the same equipment of marking of compliance of SM;

3.3. the provisions of the Technical regulation concerning marking of CE and the declaration of the EU on compliance are applied equally and to marking of compliance of SM, and to the declaration of conformity.

4. Responsibility and obligations of the producer, his authorized representative, the importer or the distributor having the location in the Republic of Moldova concerning the electric and electronic equipment placed in the market with marking of compliance of SM and accompanied with the declaration of conformity correspond to the responsibility and obligations provided by the Technical regulation about restriction of use of certain dangerous substances in the electric and electronic equipment with marking of CE accompanied with the declaration of the EU on compliance.

5. To the ministry of the environment before the date of entry into force of this resolution to develop and approve the list of the harmonized standards to the Technical regulation about restriction of use of certain dangerous substances in the electric and electronic equipment.

6. Monitoring of application of the Technical regulation about restriction of use of certain dangerous substances in the electric and electronic equipment and also to assign its updating taking into account the changes made at the European Union level to the Ministry of the environment.

7. To impose control over the implementation of this resolution on Inspectorate for environmental protection.

1. The technical regulation about restriction of use of certain dangerous substances in the electric and electronic equipment (further – the Technical regulation) establishes conditions of restriction of use of certain dangerous chemicals in the electric and electronic equipment for the purpose of protection of health of the person and the environment, including in case of utilization and ecological removal of electric and electronic waste.

I. Purpose and scope of application

2. This Technical regulation is applied to the electric and electronic equipment belonging to the categories provided in appendix No. 1.
