About veterans of war
The parliament adopts this organic law.
This law establishes legal status of veterans of war - citizens of the Republic of Moldova, category of veterans of war, regulates their social rights and guarantees.
The purpose of the law is fixing of the social rights and guarantees of veterans of war in honor for their merits, dedication and commitment. The law is oriented to support to veterans of war, to members of their families and associations of veterans of war for the purpose of encouragement of their active participation in public life and their involvement in education of younger generation in the spirit of patriotism and commitment to the Republic of Moldova.
(1) the Legislation on veterans of war is based on the Constitution of the Republic of Moldova and consists of this law and other regulations.
(2) If provisions of this law contradict provisions of international treaties which party is the Republic of Moldova, provisions of international treaties are applied.
(The State recognizes 1) and appreciates heroism and dedication of all categories of the veterans of war provided by this law.
(2) the Policy of the state for veterans of war is directed on:
a) complete integration of veterans of war into society and into public life;
b) honoring of memory of veterans of war, dead on duty, and celebration of their dedication and commitment to the Republic of Moldova;
c) providing the rights concerning health and welfare, the medical and public assistance;
d) provision of social services and payments.
(3) Social protection of all categories of veterans of war is priority for the state.
(The following concepts mean 1) for the purposes of this law:
the veteran of war - the citizen of the Republic of Moldova who was involved in fighting on protection of territorial integrity and independence of the Republic of Moldova or in other fighting and belonging to one of the categories established by this law;
person with limited opportunities owing to war - the veteran of war whose restriction of opportunities is caused by wound, contusion, the mutilation or disease got during participation in fighting on protection of territorial integrity and independence of the Republic of Moldova or in other fighting.
(2) for the purposes of this law as members of families of veterans of war are considered:
a) surviving spouses of veterans of war, the dead on duty, or the died persons with limited opportunities owing to war;
b) the worried parents of veterans of war, the dead on duty;
c) children of the died persons with limited opportunities owing to war - before achievement of 18-year age, and in case of continuation of training at full-time department of educational institutions by them - before training completion, but no more than before achievement of 23-year age.
In case of application of provisions of this law any discrimination of veterans of war on the basis of race is forbidden, to nationality, ethnic and social origin, language, religion or beliefs, age, sex, restriction of opportunities, views, political affiliation, property status, by criterion of participation in fighting or on any other signs.
(1) the Ministry of Defence bears responsibility for realization of function on development and promotion of program documents in the field of protection of the rights of veterans of war. For this purpose Ministry of Defence:
a) develops and represents to the Government drafts of the regulations regulating promotion and observance of the rights of veterans of war, except for the rights, relating to the social sphere and health sector;
b) cooperates with the Ministry of Education and Research and associations of veterans of war for the purpose of projects implementation on education of youth in the spirit of patriotism and commitment to the Republic of Moldova;
c) develops and approves sample of the certificate of the veteran of war and records the corresponding certificates;
d) cooperates with associations of veterans of war for the purpose of ensuring their participation in the actions devoted to perpetuating of memory of veterans of war, the dead on duty;
e) cooperates with associations of veterans of war and gives them support in the organization of funeral of veterans of war;
f) informs on the rights and guarantees of veterans of war.
(2) the Ministry of Labour and Social Protection bears responsibility for realization of function on development and promotion of the program documents and/or regulations in the social sphere concerning measures of social protection of veterans of war.
(3) the Ministry of Health is responsible for realization of function on development and promotion of the program documents and/or regulations in health sector concerning measures of protection of veterans of war in health sector.
(4) Organa of local public authority and the business entities performing the activities within the territory managed by them can cooperate and give support to veterans of war and their associations for the purpose of implementation of actions, provided by this law, within available financial resources.
(5) Informing on the rights and guarantees of veterans of war is within the competence of the Ministry of Defence and the bodies of the public power responsible for implementation of state policies of this sphere.
(1) Coordinating of state policy, programs, plans and measures of social protection of veterans of war, and also providing equal opportunities with it for realization of constitutional rights and freedoms are performed by the National council for veterans of war founded by the Government.
(2) the National council for veterans of war is collegiate consultative body on coordination of activities of the bodies of the public power having competences in realization of the rights of veterans of war and members of their families.
Veterans of war are recognized citizens of the Republic of Moldova who:
a) were involved in fighting on protection of territorial integrity and independence of the Republic of Moldova during the period from March 2 to August 13, 1992;
