About identification of service providers

Based on part (2) article 4 of the Law on cyber security No. 48/2023 (The official monitor of the Republic of Moldova, 2023, Art. No. 151-153, 225) DECIDES: the Government

This resolution shifts Article 3 and appendices I and II of the Directive (EU) 2022/2555 European parliament and Council of December 14, 2022 about measures for providing the overall high level of the cyber security in the Union making amendments to Regulations (EU) No. 910/2014 and the Directive (EU) 2018/1972 and canceling the Directive (EU) 2016/1148 (the Directive NIS 2) (the text concerning EEP) published in the Official log of the European Union No. L 333/80 of December 27, 2022 (CELEX: 32022L2555).

1. Approve:

1.1. Regulations of identification of service providers according to appendix No. 1;

1.2. The list of critical sectors and splits, types and categories of service providers according to appendix No. 2;

1.3. Regulations about procedure for creation, maintaining and updating of the Supplier list of services according to appendix No. 3.

2. To the ministries, other central administrative authorities responsible for realization of state policy in the critical industries and splits established in appendix No. 1, of the State office, and also to organizational structures within their competence:

2.1. give support to the Agency of cyber security in the course of identification of service providers;

2.2. submit on demand within the terms established by this resolution, information on change of accounting these service providers.

3. To the ministries, other central administrative authorities, the State office in cooperation with the regulating bodies, including on the basis of risks assessment in sectors and/or splits for which they bear responsibility, if necessary, to represent to the Ministry of Economic Development and digitalization of the offer on modification of the List of critical sectors and splits, and also types and categories of service providers provided in appendices to Regulations about identification of service providers.

4. To the agency of cyber security:

4.1. implement information technology solutions in the course of identification and accounting of service providers, including creation, maintaining and updating of the Supplier list of services;

4.2. approve methodical managements and instructions for the legal entities of public and private law participating in process of identification or being object of this process.

5. To impose control over the implementation of this resolution on the Ministry of Economic Development and digitalizations.

Regulations of identification of service providers

Chapter I. General provisions

1. The regulations of identification of service providers (further – Regulations) establish the procedure of identification, including obligation of the people involved and interaction between them, procedure, tools and mechanisms of application of conditions of selection of the service providers established by the Law on cyber security No. 48/2023 (further – the Law No. 48/2023).

2. For the purposes of these Regulations the concepts determined in the Law No. 48/2023, and also the following concepts are used:

2.1. essential service – the service necessary for maintenance of the vital functions of society, the vital types of economic activity, health and safety of the population or the environment;
