About veteran entrepreneurship

This Law is aimed at providing sustainable development of Ukraine, preserving human capital, overcoming effects of the armed aggression of the Russian Federation against Ukraine, the state support of combatants by creation of the exclusive economic rights and conditions for veteran entrepreneurship.

Section I. General provisions

Article 1. Veteran entrepreneurship

1. The veteran entrepreneurship is independent, initiative, systematic, on own risk the economic activity or independent professional activity performed by subjects of veteran entrepreneurship which correspond to the criteria determined by article 2 of this Law for the purpose of achievement of economic and social results, including profit earning.

Article 2. Subjects of veteran entrepreneurship

1. Subjects of veteran entrepreneurship are:

1) the veteran of war registered in the procedure established by the law as physical person entrepreneur;

2) the veteran of war performing independent professional activity in the value given in the Tax code of Ukraine and which is taken on tax accounting as self-employed person;

3) the legal entity of private law irrespective of form of business registered in the territory of Ukraine in the procedure established by the legislation of Ukraine in which the veteran of war independently and/or with other veterans of war is final beneficial owner (beneficiary) of such legal entity who corresponds to any one of the following criteria:

the veteran of war personally and/or with other veterans of war owns corporate laws of such legal entity in the amount of at least 100 percent of the created authorized capital of such legal entity;

100 percent of members of such legal entity are veterans of war.

2. The subject of veteran entrepreneurship has the right to receive at the same time only one of types of financial state support. Data on receipt of certain type of financial state support are reflected in the Unified state register of veterans of war (further - EGRVV).

3. The status of the subject of veteran entrepreneurship is acquired for five years from the date of acquisition of such status by the subject of veteran entrepreneurship according to the procedure, provided by this Law.

4. The foreigner or the stateless person who are in Ukraine on legal causes within the last five years and who as a part of the Armed Forces of Ukraine or other military forming formed according to the laws of Ukraine protected independence, sovereignty and territorial integrity of Ukraine and were directly involved in anti-terrorist operation, ensuring its carrying out, being directly in areas of anti-terrorist operation during its carrying out, in implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, ensuring their implementation, being directly in areas and during implementation of the specified actions, in the actions necessary for ensuring defense of Ukraine, protection of safety of the population and interests of the state in connection with the armed aggression of the Russian Federation against Ukraine, can acquire the status of the subject of veteran entrepreneurship according to the procedure, established by this Law and other laws of Ukraine.

5. For the purposes of this Law persons determined by part one Items 19-25 of Article 6, Items 11-16 of part two of article 7 of the Law of Ukraine "About the status of veterans of war, guarantees of their social protection" are considered as veterans of war.

6. Cannot be the subject of veteran entrepreneurship:

1) the legal entity who violated requirements of the legislation concerning disclosure of information on final beneficial owners and/or provision of information on structure of property of such legal entity;

2) the legal entity whose direct or mediated owner of shares (shares) in the authorized (joint-stock) capital is the state recognized by the Verkhovna Rada of Ukraine the state aggressor or the legal entity registered according to the legislation of such state or the physical person who is the citizen of such state or constantly living (being, registered) in the territory of such state;

3) the legal entity, the founder and/or the member of whom is the state recognized by the Verkhovna Rada of Ukraine the state aggressor or the legal entity registered according to the legislation of such state or the physical person who is citizen of such state or constantly lives (is, it is registered) in the territory of such state;

4) the legal entity registered in the territory and/or according to the legislation of foreign state;
