1. Approve the enclosed Rules of payment of remuneration to the financial manager by the authorized body performing management in the field of public administration on recovery of solvency and bankruptcy of citizens of the Republic of Kazakhstan.

2. To provide to committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. This order becomes effective after ten calendar days after day of its first official publication.

Rules of payment of remuneration to the financial manager by the authorized body performing management in the field of public administration on recovery of solvency and bankruptcy of citizens of the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules of payment of remuneration to the financial manager by the authorized body performing management in the field of public administration on recovery of solvency and bankruptcy of citizens of the Republic of Kazakhstan (further - Rules) are developed according to Item 2 of article 44 of the Law of the Republic of Kazakhstan "About recovery of solvency and bankruptcy of citizens of the Republic of Kazakhstan" (further - the Law) and determine remuneration payment procedure to the financial manager the authorized body performing management in the field of public administration on recovery of solvency and bankruptcy of citizens of the Republic of Kazakhstan (further - authorized body).

2. The purpose of Rules is providing single payment procedure with authorized body of remuneration to the financial manager at the expense of budgetary funds within the procedure of judicial bankruptcy.

Chapter 2. Remuneration payment procedure to the financial manager the authorized body performing management in the field of public administration on recovery of solvency and bankruptcy of citizens of the Republic of Kazakhstan

3. Remuneration payment to the financial manager is made by authorized body if during procedure of judicial bankruptcy the following circumstances are established in total:

1) the debtor belongs to the category of socially vulnerable segments of the population according to the Law of the Republic of Kazakhstan "About the housing relations";

2) there is no property on which according to the Law of the Republic of Kazakhstan "About enforcement proceeding and the status of legal executives" collection can be turned.

4. In case of observance of requirements, stipulated in Item 3 these rules, during consideration in court of the final report of the financial manager the territorial authority of authorized body on areas, the cities of republican value and the capital (further - territorial authority of authorized body) declares the petition for remuneration payment to the financial manager by authorized body, at the expense of budgetary funds in form according to appendix to these rules.

5. Remuneration payment to the financial manager is performed by authorized body based on the judgment which took legal effect about the completion of the procedure of judicial bankruptcy and discharge of the bankrupt or the decision on completion of the procedure of judicial bankruptcy and refusal in discharge of the bankrupt which remained unexecuted during the procedure of the judicial bankruptcy (further - the judgment about completion of the procedure of judicial bankruptcy and termination/refusal in discharge of the bankrupt) containing specifying about payment of the amounts specified in the petition.

Remuneration payment to the financial manager is performed by authorized body in the amount of 1 (one) minimum size of the salary established by the law on the republican budget for the corresponding financial year for every month of activities of the financial manager from the date of its appointment and no more than 3 (three) months of holding procedure of judicial bankruptcy.

In case of implementation of activities by the financial manager not complete calendar month, remuneration is paid for actually fulfilled days of the specified month.

6. The territorial authority of authorized body creates the list of bankrupts (further - the List) on whom the judgments about completion of the procedure of judicial bankruptcy and termination/refusal in discharge of the bankrupt with indication of about payment of remuneration of the financial manager by authorized body, took legal effect from January 1 to December 31 the year preceding year of forming of the List.

7. According to the List the authorized body constitutes the budget request about remuneration payment to the financial manager for financial year of forming of the List.

8. Remuneration payment to the financial manager is performed by authorized body by money transfer on its bank account.
