About approval of the Regulations on the Unified register of powers of attorney

The Cabinet of Ministers of Ukraine decides:

1. Approve the enclosed Regulations on the Unified register of powers of attorney.

2. Determine that informing the owner on requests of persons concerning information containing in the Unified register of powers of attorney on such owner is performed from the day of origin determined by the Ministry of Justice in Single state electronic system of e-notariate of the corresponding technical capability, information on what will be promulgated on the official website of the Ministry of Justice.

3. To the Ministry of Justice:

provide development and deployment of the software necessary for maintaining the Unified register of powers of attorney as the constituting Single state electronic system of e-notariate;

take measures to transfer of information from the Unified register of powers of attorney with preserving its integrity and communications in the database of the Unified register of powers of attorney as the constituting Single state electronic system of e-notariate.

4. To the Ministry of Justice, the Ministry of Foreign Affairs within six months from the date of, the publication of this resolution following behind day to bring own regulatory legal acts into accord with this resolution.

5. This resolution becomes effective from the date of, the publication by the Ministry of Justice following behind day in the Official Bulletin of Ukraine of the message on the beginning of functioning of the software ensuring functioning of Single state electronic system of e-notariate except Items 3, 4 presents of the resolution which become effective from the date of, its publication following behind day.

Regulations on the Unified register of powers of attorney

1. This Provision determines procedure for creation, maintaining and use of data of the Unified register of powers of attorney (further - the Register).

2. In this Provision terms are used in the following value:

1) the administrator Reestra (further - the administrator) - the state company belonging to the sphere of management of Ministry of Justice;

2) extraction from the Register - the document in paper or electronic form created by Register software in the specified request parameters, containing data from the Register which are urgent for date and time of forming of extraction, or information on lack of required data in the Register;

3) extraction about registration in the Register - the document in paper form created by Register software, confirming the fact of entering into the Register of data on registration of the power of attorney, the duplicate of the power of attorney or cancellation of the power of attorney;

4) the owner (holder) Reestra - the state on behalf of Ministry of Justice;

5) the user Reestra (further - the user) - official and officials of public authorities, the physical persons and legal entities having the right to obtain information from Reestra in the cases established by the legislation;

6) subject of the Register - data on powers of attorney and duplicates of powers of attorney;

7) the public logger and the creator of register information (further - the logger) - the person which according to this Provision registers powers of attorney, duplicates of powers of attorney and cancellation of powers of attorney and also provides information from the Register;

8) The register - the information communications system which is component of Single state electronic system of e-notariate (further - System of e-notariate) which software is intended for information processing about powers of attorney, duplicates of powers of attorney and cancellation of powers of attorney.
