1. Approve Regulations on procedure for indexation of rates (prices) of utilities and debt repayments for them it (is applied).

2. Recognize invalid:

the resolution of Council of Ministers of the Republic of Belarus of February 27, 2014 No. 175 "About approval of the Regulations on procedure for indexation of rates (prices) of the utilities provided to legal entities by the organizations of system of the Ministry of Housing and Public Utilities, and recognition voided resolutions of Council of Ministers of the Republic of Belarus of March 19, 1998 No. 429 and of June 2, 1999 No. 831";

the resolution of Council of Ministers of the Republic of Belarus of January 18, 2018 No. 37 "About modification and amendments in the resolution of Council of Ministers of the Republic of Belarus of February 27, 2014 No. 175";

the resolution of Council of Ministers of the Republic of Belarus of November 3, 2022 No. 747 "About change of the resolution of Council of Ministers of the Republic of Belarus of February 27, 2014 No. 175".

3. To provide to regional executive committees and the Minsk Gorispolkom reduction of acts of the legislation in compliance with this resolution and to take other measures for its realization.

4. This resolution becomes effective in the following procedure:

Items 1 and 2 - since January 1, 2026;

other provisions of this resolution - after its official publication.

Regulations on procedure for indexation of rates (prices) of utilities and debt repayments for them

1. This Provision determines procedure for indexation of rates (prices) of the utilities provided to the legal, and also physical persons (including to individual entrepreneurs) operating non-residential premises (further - persons), by the organizations of system of the Ministry of Housing and Public Utilities (further - rates for utilities), and debt repayments for them.

2. Indexation of rates for utilities is performed taking into account ratio of the official rate of Belarusian ruble established by National Bank to the foreign currency used in case of establishment of rates for utilities on payment date by persons of the consumed utilities and the Belarusian ruble exchange rate to the foreign currency used in case of establishment of rates for utilities specified in decisions of regional executive committees and the Minsk Gorispolkom on establishment of rates for utilities and accepted in case of their calculation.

The indexation of rates specified in part one of this Item is made and reflected in invoices for payment of the consumed utilities no later than the last date following after month of payment by persons of the consumed utilities.

3. Indexation of rates for utilities is performed by the organizations of system of the Ministry of Housing and Public Utilities in case of difference of the official rate of the Belarusian ruble in relation to foreign currency established by National Bank on payment date persons of the consumed utilities from applied in case of determination of rates for utilities and establishments on payment date by persons of the consumed utilities by the Central bank of the Russian Federation of the official rate of Russian ruble to US dollar in the amount of 75 and more Russian rubles for 1 US dollar on the following formula:

TB - the rate for utility established by decisions of regional executive committees and the Minsk Gorispolkom, operating for date of provision of utilities, rubles;

Kt - specific weight of costs for the natural gas, electrical and purchased heat energy in rates for utilities (without the value added tax) established by regional executive committees and the Minsk Gorispolkom in case of establishment of rates for utilities, coefficient;

KN - value of the official rate of the Belarusian ruble to the foreign currency used in case of establishment of rates for utilities established by National Bank on payment date persons of the consumed utilities, rubles;

Kb - value of the Belarusian ruble exchange rate to the foreign currency used in case of establishment of rates for utilities specified in decisions of regional executive committees and the Minsk Gorispolkom on establishment of the rates for utilities operating for date of provision of utilities, and accepted in case of their calculation, rubles.

4. Payment by persons of the consumed utilities, including debt repayment for these services, is made on the rates for utilities indexed according to the procedure, provided by this Provision.
