About licensing of export of apples
Based on articles 29 and 47 of the Agreement on the Eurasian Economic Union of May 29, 2014 and subitem 1.5 of Item 1 of the Presidential decree of the Republic of Belarus of April 5, 2016 "About state regulation of foreign trade activity" the Council of Ministers of the Republic of Belarus DECIDES: No. 124
1. Determine that under the one-time licenses granted by the Ministry of anti-monopoly regulation and trade (further respectively - licenses, MARCH) in coordination with regional executive committees (The Minsk Gorispolkom) according to the procedure, similar established by Rules of issue of the licenses and import permits and (or) commodity import included in the single inventory to which measures of non-tariff regulation in trade with the third countries approved by the Decision of Council of the Eurasian economic commission of November 24, 2023 No. 125 are applied (further - Rules) export is performed:
out of limits of the Republic of Belarus in state members of the Eurasian Economic Union (further - EEU) apples (code 0808 10 of the single Commodity nomenclature of foreign economic activity of EEU) * regardless of their origin (further - apples);
out of limits of customs area of EEU in the Republic of Belarus to the states which are not state members of EEU, apples in case of their room under customs procedures of export, temporary export, outward processing and re-export (further - customs procedures).

2. The measure of non-tariff regulation specified in Item 1 of this resolution extends also to apples which are placed under customs procedures in the Republic of Belarus before entry into force of this Item and whose actual evacuation out of limits of the Republic of Belarus according to customs procedures is performed after entry into force of this resolution.
3. Operation of this resolution does not extend to apples:
the Republic of Belarus which is exported out of limits for rendering the international humanitarian assistance to foreign states, and also as supplies;
moved within the international transit carriages which are beginning and coming to an end outside the territory of the Republic of Belarus.
4. The legal entity, the individual entrepreneur (further - the interested person) for receipt of the license for export of apples address in MARCH with submission of the following documents:
the application for licensing for export of apples issued according to appendix No. 1 to Rules (further - the statement). If the interested person is not producer of apples, data on the contracts for acquisition of the amount of apples declared to export and (or) the order signed with the producer of apples by the amount of apples (number and date of the agreement, goods quantity, the name and legal address of the producer) declared to export are specified in the statement. Data are specified in the column 16 "Additional information" of the statement;
other documents and (or) data according to the legislation on ministerial procedures.
5. The documents specified in item 4 of this resolution (further - documents), are represented in MARCH during acceptance of the interested person, or by means of mail service, or the courier (courier).
The bases for refusal in adoption of documents are the cases provided in Item 1 of article 17 of the Law of the Republic of Belarus of October 28, 2008 No. 433-Z "About bases of ministerial procedures".
6. Documents within five working days from the date of their receipt go MARCH (with use of the protected systems of electronic communication or by means of interdepartmental information systems) for review licensing for export of apples to regional executive committee (The Minsk Gorispolkom) in the location of the interested person and if the interested person is not producer of apples, - to regional executive committee (The Minsk Gorispolkom) in the place of origin of apples.
7. The regional executive committee (The Minsk Gorispolkom) in the absence of the basis specified in the paragraph the second to part two of Item 10 of this resolution within two working days from the date of receipt of documents sends them to the Ministry of Agriculture and Food (further - Ministry of Agriculture and Food Production) with appendix of request about approval of export of apples (further - request) in which data are specified:
about ratio of free resources in the area Minsk) and need of the area (Minsk) for apples;
about availability of free resources of apples;
about amount of the apples declared to export;
about the signed contracts for the amount of apples declared to export (if the interested person is not producer).
8. Ministry of Agriculture and Food Production performs approval of export of apples within three working days from the date of receipt of documents and request or in the specified time directs to regional executive committee (The Minsk Gorispolkom) motivated refusal in approval of export of apples.
The basis for refusal in approval of export of apples is non-compliance for date of submission to Ministry of Agriculture and Food Production of documents and request of ratio of free resources in the Republic of Belarus and need of the Republic of Belarus on apples - at least 30 percent.
9. Approval of export of apples is performed by Ministry of Agriculture and Food Production by putting down on the statement of the signature of person authorized on approval and impress of a seal of Ministry of Agriculture and Food Production.
10. The regional executive committee (The Minsk Gorispolkom) performs approval of licensing for export of apples within five working days from receipt date of documents from MARCH or directs to the specified time in MARCH motivated refusal in approval of issue of such license.
The bases for refusal in approval of licensing for export of apples are:
non-compliance for date of submission of documents in regional executive committee (The Minsk Gorispolkom) of ratio of free resources in the area Minsk) and needs of the area (Minsk) on apples - at least 30 percent;
lack of approval of export of apples by Ministry of Agriculture and Food Production.
11. Approval of licensing for export of apples is performed by regional executive committee (The Minsk Gorispolkom) by putting down on the statement of the signature of person authorized on approval and impress of a seal of regional executive committee (The Minsk Gorispolkom).
12. MARCH refuses licensing:
in case of availability of motivated refusal of regional executive committee (The Minsk Gorispolkom) in approval of licensing for export of apples;
in case of availability in MARCH of information on the fact of failure to deliver (underdelivery) by the interested person of apples from stabilization funds of goods in month of submission of documents and (or) in prior to month of submission of documents;
