1. Approve the enclosed Rules of functioning of electronic platform of purchases of the national project on upgrade of energy and municipal sectors.

2. To provide to department of digital transformation of the Industry ministry and construction of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Industry ministry and construction of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of functioning of electronic platform of purchases of the national project on upgrade of energy and municipal sectors

Chapter 1. General provisions

1. These rules of functioning of electronic platform of purchases of the national project on upgrade of energy and municipal sectors (further - Rules) are developed according to Item 2 of article 10-11 of the Law of the Republic of Kazakhstan "About the housing relations" and determine procedure for functioning of the information system providing carrying out electronic procurement within implementation of the national project on the upgrade of energy and municipal sectors providing electronic services in providing point of access for purchase of goods, works and services, the conclusions of the agreement on "turnkey" construction and also selection and monitoring of projects within implementation of the national project on upgrade of energy and municipal sectors.

2. In these rules the following concepts are used:

1) the technical operator in the sphere of the housing relations and housing and communal services of the national project on upgrade of energy and municipal sectors (further - the technical operator) - the legal entity with absolute participation of the state in the authorized capital determined by the Government of the Republic of Kazakhstan as the technical operator in the sphere of the housing relations and housing and communal services of the national project on upgrade of energy and municipal sectors;

2) electronic platform of purchases of the national project on upgrade of energy and municipal sectors (further - the Electronic platform) - the information system providing carrying out electronic procurement within implementation of the national project on upgrade of energy and municipal sectors, providing electronic services in providing point of access for purchase of goods, works and services, the conclusions of the agreement on "turnkey" construction and also selection and monitoring of projects within implementation of the national project on upgrade of energy and municipal sectors;

2) the electronic copy of the document - the document which is completely reproducing type and information (data) of the authentic document in electronic and digital form;

3) the electronic document - the document in which information is provided in electronic and digital form and is certified by means of the digital signature;

4) the digital signature (further - the EDS) - set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content;

5) the project - the project of upgrade and construction of energy and municipal infrastructure within implementation of the national project on upgrade of energy and municipal sectors;

6) users of the Electronic platform - the administrator of the Electronic platform, the applicant, authorized persons;

7) the applicant - the subject of natural monopoly, the potential supplier, the supplier;

8) authorized persons - Technical and Financial operators, the Tariff regulator, authorized state bodies in the respective spheres of state regulation, local executive bodies.

3. The electronic platform is used for automation of the following processes applied within implementation of the national project on upgrade of energy and municipal sectors:

1) planning, selection, coordination of projects, and also monitoring of their realization;

2) determinations of funding mechanism and (or) subsidizing of part of rate of remuneration on loan on projects;

3) purchases of works and services, selection of suppliers, conclusion of agreements of purchases;

4) subsidizings of rate of remuneration on the loans obtained by subjects of natural monopolies and also on the government securities issued by local executive bodies;

5) purchases of goods at the Kazakhstan producers and the conclusion of ofteyk-contracts;

6) report generation and analytical information on the above-stated processes.

Chapter 2. Organization of processes of the Electronic platform

4. The electronic platform provides transparency, efficiency and the sequence of processes, confidentiality and safety of data.

5. For use of the Electronic platform users undergo the procedure of registration.

6. Registration of applicants is performed taking into account acceptance of the following conditions:

1) consent to data collection and processing with limited access, including personal data, bank and commercial secrets;

2) obligations on provision of authentic documents and data.

7. Registration of authorized persons is performed with appointment of responsible persons and assignment of obligations on them on non-proliferation of information obtained in the course of work with the Electronic platform.

8. In case of registration of users on the Electronic platform the accounting record with the appropriate rights of access is created:
