About measures for enhancement of system of regulation in the sphere of telecommunications

For the purpose of forming of free competitive environment in the market of telecommunication services, further improvement of quality of the rendered services, establishing effective use of telecommunication networks, and also ensuring execution of the Law "About Telecommunications" I decide:

I. Main objective

1. Main objective of adoption of this Decree is implementation of the reforms directed to forming of free competitive environment in the market of telecommunication services, increase in system effectiveness of management of telecommunication networks, further improvement of quality of the rendered services.

II. Enhancement of public administration in the sphere

2. Create the Agency of regulation of telecommunications (further - the Agency).

3. Determine that:

(a) according to articles 9 and 11 of the Law "About Telecommunications" Ministry of Digital Technologies the Agency - regulating authority in the sphere of telecommunications is authorized state body in the sphere of telecommunications;

(b) Agency:

(i) is republican executive body;

(ii) performs the powers according to article 11 of the Law "About Telecommunications";

(iii) performs monitoring of compliance of quality of the services rendered by operators and providers to the established requirements according to the approved plan monthly at least once;

(iv) is independent on finance, structure and on decision making within powers, and also accountable in the activities to the Cabinet of Ministers.

4. Establish the number of staff of managerial personnel of the Agency in number of 31 units. At the same time established posts of the Agency according to the Presidential decree of the Republic of Uzbekistan of June 26, 2025 No. UP-105 are created:

(a) due to optimization of 16 established posts of the Ministry of digital technologies and the organizations of its system;

(b) at the expense of 15 established posts reduced in Committee of treasurer service under the Ministry of Economics and finance.

III. Financing sources

5. Determine sources of financing of activities of the Agency:

(a) in 2025 - fund of development of digital technologies;

(b) since 2026:

(i) means of the Government budget;

(ii) 5 percent of part of receipts from the state fees for issue of licenses for the right of implementation of types of activity in the sphere of telecommunications sent to Fund of development of digital technologies;

(iii) other sources which are not forbidden by the legislation.

6. And finance when forming parameters of the Government budget to provide to the Ministry of Economics since 2026 prediscretion of necessary means for financing of activities of the Agency.

IV. Organization, providing and control of execution of the Decree

7. To the Cabinet of Ministers:

(a) in a month to accept the order of the Government on the organization of activities of the Agency;

(b) in two-month time to make in Administration of the President of the Republic of Uzbekistan offers on the changes and amendments in acts of the legislation following from this Decree.

8. To the ministry of digital technologies to take measures for placement of the Agency in the building to the address in a month: the city of Tashkent, Yashnabadsky district, Ulitsa Makhtumkuli, the house 114-A, on the basis of the right of free use.

9. To impose control of execution of this Decree on the Prime Minister of the Republic of Uzbekistan A. N. Aripov.
