RESOLUTION OF THE PRESIDENT OF THE REPUBLIC OF UZBEKISTAN

About additional measures for further development of institute of notariate and widespread introduction to the sphere of modern information and communication technologies

According to the Presidential decree of the Republic of Uzbekistan of May 24, 2024 and for the purpose of increase in role of institute of notariate in case of protection of the rights and legitimate interests of citizens and subjects of entrepreneurship, and also consecutive continuation of the works connected with digitalization of activities of notaries I decide No. UP-80 "About Further Increase in Responsibility and Forming of Compact Management System of Bodies and Organizations of Justice within Administrative Reforms":

1. Implement since March 1, 2026 procedure for making by notaries of executive texts according to the following indisputable civil requirements in the amount up to the thousandfold size of basic settlement size:

(a) the requirement based on notarially certified transactions;

(b) the requirement about the address of collection of the personal estate which is ensuring obligation fulfillment of the debtor in the presence of the written and notarially certified transaction;

(c) requirements about debt collection for the lease payments compulsory for contributions and payments from owners of rooms in apartment houses, to utilities and communication services.

2. Approve offers of the Ministry of Justice and Notarial chamber of Uzbekistan on implementation since April 1, 2026 in activities of notaries of the following:

(a) age increase in limit of continuance in office of the notary in the Republic of Uzbekistan from sixty five to seventy years.

At the same time by results of the interview conducted by the Highest qualification commission under the Ministry of Justice (further - the Highest qualification commission), the notary at own will can continue labor activity up to seventy years;

(b) implementation instead of tender to destination to position of the notary of office of notary public and qualification examination on the occupation right private notarial activities of procedure for the single selection consisting of two stages with use of opportunities of information technologies:

(i) at the first stage applicants pass tests on such spheres as the public and public administration, anti-corruption, the civil law, notariate and inheritance right. At the same time tests will be organized by the Ministry of Justice and the Agency according to knowledge and qualifications under the Ministry of the higher education, science and innovations with use of information technologies;

(ii) at the second stage applicants, successfully last tests, during the practice examination which is carried out by the Highest qualification commission perform preparation of projects of notarial actions on special electronic platform and answer problematic issues (incidents);

(c) provision of permission to participation in the single selection provided in the subitem "b" of this Item is exclusive to persons which successfully ended the rates organized at Institute of retraining and advanced training of legal personnel under the Ministry of Justice;

(d) suspension of effective period of the license based on the statement of the notary who is engaged in private practice in case of impossibility of performance it the professional activity on reasonable excuse;

(e) implementation of the mechanism of application in addition to suspension or cancellation of the license of the notary who is engaged in private practice, alternative corrective actions in the form of the prevention and penalty;

(g) implementation of the stamp (special) form of single form by standardization of the stamp (special) forms used in case of registration of notarial actions. At the same time:

(i) registration of notarial actions on the stamp (special) form can be performed at the request of the parties;

(ii) registration on stamp (special) forms of the notarial actions performed in the video conferencing mode is not required;

(h) the certificate of all notarially processed documents the signature, notary's seal and/or QR code (matrix bar code).

3. Establish procedure according to which when rendering notarial services the following requirements are cancelled:

(a) since December 1, 2025:

(i) reclamation by notaries of the original of the marriage agreements which are notarially certified in the territory of the republic due to implementation of procedure for obligatory loading of their copy in the automated information system "Notary" (further - System);

(ii) storage on electronic media of files audio-and videos of fixing of process of implementation of notarial actions. At the same time the possibility of attachment of files of audio-and videos of this kind directly to notarial actions and their storages in System is created;

(b) representation since January 1, 2026 to the notary of the original document confirming the personality of the citizen of the Republic of Uzbekistan for implementation of notarial actions. At the same time the identity of citizens is identified with use of modern information technologies by means of details of the document confirming their personality and also verified by means of biometric data (fingerprints and Face-ID).

4. Confer to the Ministry of Justice the following additional powers when implementing state policy in the field of notariate:

(a) establishment of the greatest number of positions of the notary in certain territory (in the notarial district);

(b) position assignment of the notary of office of notary public in the remote (hardly accessible) areas and in the territories (in notarial districts) with low demand for position of the notary without participation of applicants in single selection, on the basis of the interview conducted by the Highest qualification commission.

5. Approve:

(a) The list of the remote (hardly accessible) areas and the territories (notarial districts) with low demand for position of the notary in which appointment of notaries is possible on the basis of interview without participation in single selection to position of the notary of office of notary public, according to appendix No. 1 *;

(b) The list of the state services rendered by notaries in composite form according to appendix No. 2 *;

(c) The schedule of notarial actions which registration is adjusted remotely by means of the video conferencing mode in 2025 - 2027, according to appendix No. 3 *;

() "Road map" on further development of institute of notariate and implementation to the sphere of modern information and communication technologies in 2025 - 2027 according to appendix No. 4*.

6. Determine that in the remote (hardly accessible) areas and in the territories (in notarial districts) with low demand for position of the notary specified in appendix No. 1 * to this resolution:

(a) the notaries who performed activities of the notary within at least three years based on the conclusion of the Highest qualification commission are granted the right to continuation of activities as the notary who is engaged in private practice in any other territories of the republic chosen by them;

(b) in case of introduction of position of the notary of office of notary public the requirement about obligatory introduction at least on one established post of positions of the assistant notary and the secretary of the notary is not applied to each office of notary public.
