About further increase in responsibility and forming of compact management system of bodies and organizations of justice within administrative reforms

For the purpose of ensuring execution of the Presidential decree of the Republic of Uzbekistan of January 25, 2023 No. UP-14 "About First-priority Organizational Measures for Effective Establishing Activities of Republican Executive Bodies", and also strict observance of the rights and freedoms of citizens, further increase in responsibility of bodies and organizations of justice in expansion of range of the state and legal services provided to them:

1. Determine additional activities of judicial authorities:

identification of the legal problems which are found in everyday life of the population, carrying out the analysis and acceptance of practical measures on their elimination;

project development of the acts of the legislation directed to elimination of the system problems revealed on places;

adjustment and coordination of system of rendering free primary legal aid to citizens;

rendering the methodical help with forming of single law-enforcement practice in state bodies and the organizations, public authorities on places and self-government institutions of citizens.

2. For the purpose of the effective organization of activities of judicial authorities and further expansion of scope with legal services in regions to assign the following additional tasks to district (city) departments of justice:

monthly carrying out in makhallyakh actions "Day of justice" on consideration and the solution of the urgent problems lifted by the population on places. At the same time in makhallyakh, the located in the remote areas, exit state services are rendered at least two times a month;

preparation of offers on enhancement of the legislation on elimination of the legal problems revealed in everyday life of citizens by carrying out podvorovy bypass and the shares "Legal assistance";

bringing essence and value of the acts of the legislation to "the makhallinsky seven" in simple and available language, and also the problem resolution of the population concerning the legal issues in his everyday life included "the makhallinsky seven" in the Online-mahalla platform;

ensuring rendering free primary legal aid to the population, first of all to the citizens included in "Iron notebook", "Female notebook", "Youth notebook" and the information system "Unified Register of Social Protection";

informing youth, the women, persons needing social protection and also subjects of entrepreneurship about the privileges established by acts of the legislation, preferences, subsidies, grants and other types of the state support and about procedure for their application;

rendering to district (city) divisions state bodies and the organizations, public authorities on places and to self-government institutions of citizens of the methodical help with forming of single law-enforcement practice.

3. Implement the following procedure for rendering free primary legal aid to citizens since July 1, 2024:

The Ministry of Justice together with NNO "Madad" in the centers of the state services of all areas and cities of the republic step by step creates legal advisory bureaus of NNO "Madad" (further - legal advisory bureaus);

legal advisory bureaus provide to the population free legal consultations, and also render assistance in preparation of the procedural documents necessary in case of the pre-judicial and judicial dispute resolution;

for financing of activities of legal advisory bureaus according to reasonable calculations of NNO "Madad" government subsidies at the expense of Public fund for support of non-state non-profit organizations and other institutes of civil society under Oliy Majlis of the Republic of Uzbekistan and public funds under the Jokargi Kenes of the Republic of Karakalpakstan, Kengashakh People's Deputies of areas and the city of Tashkent are allocated;

equipment of the created legal advisory bureaus the necessary computer equipment and furniture is performed by fund of development of bodies and organizations of justice.

To the Ministry of Economics and finance to provide in annual parameters of the Government budget of means, necessary for financing of the government subsidies specified in this Item.

To the Ministry of Justice to raise funds of technical assistance and grants of the international financial institutions and foreign donors for support of activities of legal advisory bureaus.

4. For the purpose of increase in sense of justice and legal culture of the population, bringing acts of the legislation to contractors, increase in efficiency of works on explanation of their essence and value among the population:

a) in self-government institutions of citizens The Lawyer Waved project within which the short-term free training courses directed to continuous increase in legal knowledge and skills of chairmen of self-government institutions of citizens will be organized is implemented;

b) at schools since 2024/2025 academic years:

the system of continuous increase in professional knowledge and skills of teachers of subject "Right" and their methodical providing by means of special electronic platform of the Ministry of Justice is adjusted;

are carried out the subject Olympic Games "Legal scholar" among pupils and the tender "The Best Lecturer in Law" among teachers of subject "Right";

the visual education guidances, videos, computer games and mobile applications directed to independent development of legal knowledge by pupils are created;

c) since June 1, 2024 the new procedure for bringing to the population by state bodies and organizations of essence and value of acts of the legislation and reforms takes root. At the same time:

The Ministry of Justice proceeding from activities of state bodies and the organizations prepares materials on legal promotion which are led up to their most local links by means of the Single system of exchange of legal information;

digitalization of activities of state bodies and organizations for finishing legal information is performed and innovative methods of legal promotion are widely applied;

in state bodies and the organizations the divisions responsible for the organization and coordination of activities for bringing to the population of the legal information relating to the sphere of their activities are determined;

level and quality of bringing to the population of essence and value of acts of the legislation and reforms by state bodies and organizations are one of criteria for evaluation of efficiency of their activities.

5. Agree with the offer of the Ministry of Justice on determination of every environment of week in "The afternoon of legal promotion" in makhallyakh.

Determine that in "Day of legal promotion" by district (city) departments of justice, including the centers of rendering legal services, bodies of ZAGS, the centers of the state services together with the interested organizations hold the following events:

the organization of the address actions for legal promotion directed to the legal problem resolution, brought in the Online-mahalla platform and revealed on places;

provision of legal consultations and explanations by determination of the questions, most urgent for the population;

holding system actions for legal promotion about procedure for provision of privileges and financial support, purpose of benefits, protection against unemployment, providing with temporary work, receipts of the public assistance for the segments of the population needing social protection;

organization of events on legal promotion about procedure for use of the state services which are the most demanded in everyday life and benefits of use of them through the Single portal of interactive state services and other electronic resources.

6. Determine that bodies and organizations of justice, including the Tashkent state legal university and legal technical schools on the basis of the idea "The future of the country - behind youth, law-abiding and intolerant of offenses", directed to increase in sense of justice and legal culture of youth, forming at it legal immunity to the factors exerting negative impact on her legal education are responsible for:

the organization of the complex actions for legal promotion directed to forming among youth of the intolerant relation to offenses, strengthening of feeling of respect at it for the law, participation in destiny of the country and patriotism;

holding actions "Legal assistance to the peer" by the organization of visit by youth of bodies and organizations of justice;

the organization of practical actions for increase in image and prestige of legal profession, instilling at youth of pride and respect for this profession, increase in her interest in finding of legal knowledge;

the organization of online school of the legal literacy oriented to increase in legal knowledge of youth with implementation of free training courses by right;

carrying out "Month of legal knowledge" in educational institutions, the organization of the seminars trainings and tenders on various legal subjects directed to encouragement of receipt of legal knowledge by youth.

7. Determine the Ministry of Justice authorized body by methodical ensuring law enforcement in state bodies and the organizations.

Establish procedure according to which:

a) The Ministry of Justice annually develops the program of address and case analytical studies for studying and methodical ensuring law-enforcement practice and provides its realization. At the same time:

till September 1, 2024 in the Ministry of preschool and school education, the Ministry of Agriculture, khokimiyat of Dustliksky district of the Jizzakh region and self-government institutions of citizens the model law-enforcement system is adjusted. In subsequent law-enforcement activities at least 10 ministries and departments are annually analyzed and enhanced;

guidelines manuals on elimination of the system problems which are found in law-enforcement practice which are placed in the National database of the legislation (Lex.uz) are developed;

offers on optimization of functions of state bodies and the organizations with use of methods of business process reengineering (BPR) are made;

are provided development and deployment in practice of drafts of standard documents on clerical work for state bodies and the organizations to whom studying was carried out;

skills of employees of state bodies and organizations for implementation of single law-enforcement practice are improved;

b) state bodies and the organizations by means of the Single system of exchange of legal information make in the Ministry of Justice offers on elimination of the existing problems in law-enforcement practice, gaps and contradictions in the legislation.

At the same time Ministry of Justice:

studies and analyzes condition of observance of established procedure of execution of acts of the legislation on providing the rights of citizens, and also law-enforcement practice, including with departure on places;

takes measures for enhancement of law-enforcement practice and the legislation on system basis with carrying out generalization and the profound analysis of offers of state bodies and organizations.

8. For the purpose of creation of additional conveniences in the sphere of rendering the state services to the population and subjects of entrepreneurship to establish procedure according to which:

a) since July 1, 2024:

identification of citizens in the Mobile-ID system is performed at will in composite form in the course of design of the ID card and the biometric passport for trip abroad by means of the centers of the state services;

practice of reclamation from the companies, organizations and the organizations of electronic copies of archive documents in case of their destruction is cancelled in accordance with the established procedure;

entering electronically into the state register of data on the rights to real estate which state registration was carried out earlier (the certificate on state registration is granted or it is confirmed by making of text on the title document), and which are valid on the date of introduction, and also provision of the statement about it from the state register are performed on free basis;

execution of transactions on transfer of the non-residential premise to other person is performed in case of corporal appearance of the parties of the transaction in the center of the state services with establishment of their personality by the employee of the center, and the drawn-up transaction at the same time goes to bodies for the inventory for state registration;

b) until the end of 2024:

when rendering the state services the method of biometric identification of the personality (Face-ID) takes root. At the same time provision by citizens of the documents proving their identity is not required;

passing by citizens of identification and repeated identification in the Mobile-ID system by means of the centers of the state services and notary offices are performed on free basis.

9. Implement procedure according to which if necessary approbation of new state services in certain region as experiment before introduction of procedure for their rendering is carried out.

Determine that:

the temporary regulations of rendering the state services implemented within the experiment are accepted by the Ministry of Justice, the Ministry of digital technologies and authorized state body rendering the state service;

the experiment continues up to 6 months following the results of which rendering in new procedure for the state services stops or in the Cabinet of Ministers the offer on its implementation on all republic is made.

10. Agree with the offers of the Ministry of Justice, Ministry of the higher education, science and innovations, the Ministries of preschool and school education about enhancement of system of preparation of legal personnel providing:

implementation of the "school-lyceum-technical school-university" system by preparation of legal personnel by the organization of "Legal class" and profound studying of legal objects at schools;

creation of the academic lyceums of the Tashkent state legal university based on legal technical schools of the Namangan and Samarkand regions and acceptance of their gifted graduates in the highest educational institutions in the law direction on the basis of interview without tests.

To the Ministry of Justice together with the interested ministries and departments in two-month time to introduce to the Cabinet of Ministers the draft of the resolution establishing procedure for acceptance of gifted graduates of the academic lyceums of the Tashkent state legal university in the highest educational institutions in the law direction on the basis of interview without tests.

11. Form:

a) Institute of retraining and advanced training of legal personnel under the Ministry of Justice of the Republic of Uzbekistan based on Training center of lawyers under the Ministry of Justice, the Center of professional training of legal personnel for international standards under the Tashkent state legal university, Training center of advanced training of court experts under the Republican center of judicial examination of name X. Sulaymanova, Scientific and methodical training center on archiving and clerical work under the Uzarkhiv Agency;

b) Institute of the analysis of the legislation and assessment of regulatory impact (further - Institute) based on public institution "Center of development of the state services" of the Ministry of Justice.

Establish procedure according to which the Ministry of Justice annually develops and provides program implementation of assessment of regulatory impact of drafts of acts of the legislation. At the same time till 2028 the indicator of assessment of regulatory impact of drafts of regulatory legal acts is carried to 100 percent, the existing regulatory legal acts - to 50 percent.

Transfer to the Ministry of Justice on the right of operational management the building, at the address: the city of Tashkent, Ulitsa Buyuk ipak yul, 69, and to place Institute in this building.

In two-month time to provide to the Ministry of Justice equipment of Institute with necessary furniture, the computer equipment and other material means by extrabudgetary funds of the ministry.

12. Determine that for the purpose of widespread introduction of scientific approaches in realization of the state legal policy at the Tashkent state legal university, and also at Institute of retraining and advanced training of legal personnel under the Ministry of Justice of the Republic of Uzbekistan the system takes root:

scientific and methodical and providing advice for activities of bodies and organizations of justice, spheres of rendering legal services, judicial examination, archiving and clerical work;

carrying out scientific research and development of recommendations concerning efficiency of works on increase in sense of justice and legal culture of the population;

carrying out basic, applied and innovative researches on topical issues of law;

implementation of the research projects aimed at the development of the sphere of legal education and rendering legal services by means of use of legal technologies;

carrying out researches of legal problems in regions and industries on the basis of project approaches with departure on places and developments of relevant proposals by extrabudgetary funds of bodies and organizations of justice and grants.

To the Ministry of Justice together with the interested ministries and departments to approve "Road map" on implementation of measures, the scientific approaches directed to widespread introduction in realization of the state legal policy in a month.
