1. Approve the enclosed Rules of purchase of goods at the Kazakhstan producers and the conclusion of ofteyk-contracts within the national project on upgrade of energy and utility sectors.

2. To provide to development department of industrial infrastructure and intra country value of the Industry ministry and construction of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Industry ministry and construction of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of purchase of goods at the Kazakhstan producers and the conclusion of ofteyk-contracts within the national project on upgrade of energy and utility sectors

Chapter 1. General provisions

1. These rules of purchase of goods at the Kazakhstan producers and the conclusion of ofteyk-contracts within the national project on upgrade of energy and utility sectors (further - Rules) are developed according to Item 5 of article 10-12 of the Law of the Republic of Kazakhstan "About the housing relations" and determine procedure for purchase of goods at the Kazakhstan producers and the conclusion of ofteyk-contracts within the national project on upgrade of energy and utility sectors.

2. In these rules the following concepts are used:

1) the potential supplier – the Kazakhstan producer included in the register of the Kazakhstan producers applying for the conclusion of the agreement of purchase of goods;

2) homogeneous goods – goods which, without being identical, have similar characteristics and consist of similar components that allows them to perform the same functions;

3) electronic platform of purchases of the national project on upgrade of energy and utility sectors (further – electronic platform) – the information system providing carrying out electronic procurement within implementation of the national project on upgrade of energy and utility sectors, providing electronic services in providing point of access for purchase of goods, works and services, the conclusions of the agreement on "turnkey" construction and also selection and monitoring of projects within implementation of the national project on upgrade of energy and utility sectors;

4) the supplier – the Kazakhstan producer included in the register of the Kazakhstan producers which signed the agreement of purchase of goods;

5) the technical operator – the legal entity with absolute participation of the state in the authorized capital determined by the Government of the Republic of Kazakhstan as the technical operator in the field of the housing relations and housing and communal services of the national project on upgrade of energy and utility sectors;

6) consortium - the tactical voluntary equal alliance (consolidation) on the basis of the agreement on joint economic activity in which legal entities combine these or those resources and is coordinated by efforts for the solution of specific economic objectives;

7) goods of the Kazakhstan origin – the goods which are completely made in the Republic of Kazakhstan or the processed goods corresponding to conditions of production in case of which production the minimum threshold of production and technological operations data on which to contain in the register is carried out;

8) the Kazakhstan producer – the subject of entrepreneurship which is resident of the Republic of Kazakhstan, included in the register of the Kazakhstan producers;

9) the customer – the contractor and (or) the consortium realizing the construction project "turnkey", performing purchase of goods according to these rules;

10) the register of the Kazakhstan producers (further - the register) – the object of information and communication infrastructure of "the electronic government" containing data on the Kazakhstan producers and the goods of the Kazakhstan origin made by them;

11) the electronic copy of the document – the document which is completely reproducing type and information (data) of the authentic document in electronic and digital form.

3. Purchase of goods at the Kazakhstan producers and the conclusion of ofteyk-contracts within the national project on upgrade of energy and utility sectors is performed by means of electronic platform according to the inventory, created by the design estimates.

At the same time the inventory provided by the design estimates automatically is placed in electronic platform by integration into the Single portal of complex examination of projects (epsd.kz).

Chapter 2. Procedure for purchase of goods at the Kazakhstan producers and the conclusion of ofteyk-contracts

Paragraph 1. Order of registration of the potential supplier

4. Registration on electronic platform is the compulsory provision for receipt of access to functionality of submission of requests, participation in procedures of purchase of goods and the conclusion of ofteyk-contracts.
