About approval of the Procedure for forming and use of the Stabilization fund of the Kyrgyz Republic

For the purpose of further regulation of questions of forming and management of the Stabilization fund of the Kyrgyz Republic, provision of the reporting on use of its means, according to part 2 of Article 43-3 of the Budget code of the Kyrgyz Republic, article 71 of the Constitution of the Kyrgyz Republic I decide:

1. Approve the Procedure for forming and use of the Stabilization fund of the Kyrgyz Republic according to appendix.

2. Recognize invalid:

1) the Presidential decree of the Kyrgyz Republic "About approval of the Procedure for forming and use of the Stabilization fund of the Kyrgyz Republic" of March 4, 2022 No. 70;

2) the Presidential decree of the Kyrgyz Republic "About modification of the Presidential decree of the Kyrgyz Republic "About approval of the Procedure for forming and use of the Stabilization fund of the Kyrgyz Republic" of March 4, 2022 No. 70" of October 24, 2023 No. 268;

3) the Presidential decree of the Kyrgyz Republic "About modification of the Presidential decree of the Kyrgyz Republic "About approval of the Procedure for forming and use of the Stabilization fund of the Kyrgyz Republic" of March 4, 2022 No. 70" of November 16, 2023 No. 313;

4) the Presidential decree of the Kyrgyz Republic "About modification of the Presidential decree of the Kyrgyz Republic "About approval of the Procedure for forming and use of the Stabilization fund of the Kyrgyz Republic" of March 4, 2022 No. 70" of March 2, 2024 No. 53;

5) the Presidential decree of the Kyrgyz Republic "About modification of the Presidential decree of the Kyrgyz Republic "About approval of the Procedure for forming and use of the Stabilization fund of the Kyrgyz Republic" of March 4, 2022 No. 70" of January 31, 2025 No. 34.

3. This Decree becomes effective after ten days from the date of official publication.

Procedure for forming and use of the Stabilization fund of the Kyrgyz Republic

Chapter 1. General provisions

1. This Procedure determines legal and organizational basis of forming and use of means of the Stabilization fund of the Kyrgyz Republic (further - the Stabilization fund).

2. Stabilization fund - the off-budget fund created for ensuring social and economic development of the Kyrgyz Republic.

Chapter 2. Purposes and tasks of the Stabilization fund

3. Main objectives of the Stabilization fund are:

1) maintenance of stable social and economic development of the country;

2) decrease in dependence of economy on impact of adverse external factors;

3) ensuring national security and strengthening of defense capability of the Kyrgyz Republic.

4. Tasks of the Stabilization fund are:

1) financing of separate actions;

2) investment into financial and other instruments, including precious metals.

5. Money of the Stabilization fund is allocated for the following purposes:

1) implementation of the state social and economic programs;

2) creation, increase, updating, upgrade of fixed assets;

3) development of industries of economy;

4) other actions determined by the President of the Kyrgyz Republic.

Chapter 3. Sources and procedure for forming of the Stabilization fund

6. Sources of forming of means of the Stabilization fund are:

1) privatization of strategic objects;

2) realization of subsoil plots of nation-wide value;

3) investment revenues from management of the Stabilization fund;

4) other means determined by the President of the Kyrgyz Republic (further - other means).

7. Other means include the following list, but are not limited to it:

1) voluntarily transferred funds of legal entities and physical persons, residents and nonresidents of the Kyrgyz Republic;

2) the funds transferred from deposit accounts of law enforcement and supervisory authorities in the form of voluntarily indemnified loss caused to the state;

3) other receipt of funds listed on voluntary basis and which are not contradicting the purposes of the budget legislation of the Kyrgyz Republic;

4) means of the administered account of authorized state body in the sphere of management of state-owned property according to the procedure determining conditions and procedure for alienation of the objects which passed into state-owned property on the bases provided by the civil legislation of the Kyrgyz Republic, the legislation of the Kyrgyz Republic on offenses, the penal and criminal procedure legislation of the Kyrgyz Republic;

5) other money which is earlier not provided in resource part of the republican budget according to decisions of the Cabinet of Ministers of the Kyrgyz Republic;

6) expense reallocation of the republican budget according to decisions of the Cabinet of Ministers of the Kyrgyz Republic;

7) the transfer amount of part of the income of the republican budget provided when forming the draft of the republican budget in the Stabilization fund.

8. The means received according to subitems 1, 2 and 4 Items 6 of this Procedure are considered in resources and expenses of the republican budget for further transfer in the Stabilization fund.

9. The means which are not provided in the law on the republican budget before modification of it are listed in the Stabilization fund with the subsequent written notice of special-purpose committee of Jogorku Kenesh of the Kyrgyz Republic.

10. Investment revenues from management of the Stabilization fund arrive directly into its accounts.

11. Money according to subitems 1-3 of Item 7 of this Procedure arrives in resource part of the republican budget from the corresponding deposit accounts by means of the corresponding intertreasurer orders and further is listed in the Stabilization fund through account part of the republican budget.

12. Money of the Stabilization fund is accumulated on accounts (somovy and currency) authorized state body on forecasting and budget implementation (further - authorized state body) in National Bank of the Kyrgyz Republic which are considered as one consolidated account for the cash accounting of the Stabilization fund.

13. The regulations of servicing of accounts on the cash accounting of the Stabilization fund are provided in the agreement signed between authorized state body and National Bank of the Kyrgyz Republic.

Chapter 4. Management of the Stabilization fund

14. The decision on assignment from the Stabilization fund is made by the President of the Kyrgyz Republic.
