About approval of the Procedure for functioning of Fund of development of park zones of the city of Bishkek

1. Approve the Procedure for functioning of Fund of development of park zones of the city of Bishkek according to appendix.

2. Recommend to city administration Bishkek:

- provide target use of money of Fund of development of park zones of the city of Bishkek;

- take other measures following from this resolution.

3. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

4. This resolution becomes effective after ten days from the date of official publication.

Procedure for functioning of Fund of development of park zones of the city of Bishkek

1. General provisions

1. This Procedure for functioning of Fund of development of park zones of the city of Bishkek determines the purposes, tasks, financing sources, the mechanism of distribution and control of use of fund of development of park zones of the city of Bishkek (further - Fund).

2. Main objectives of Fund are:

- preserving and further development of park zones of the city of Bishkek;

- ensuring sustainable development, improvement, protection, recovery and upgrade of park zones in the territory of the city of Bishkek;

- accumulation and target use of the means aimed at the development, reconstruction and recovery of park zones of the city of Bishkek.

3. The fund is not independent legal entity and is effective under authorized body of city administration Bishkek.

2. Sources and procedure for forming of Fund

4. The fund is created for acquisition account on the bank account opened to authorized body of city administration Bishkek.

5. Fund are formed for the account:

- money from physical persons and legal entities;

- other receipts which are not forbidden by the legislation of the Kyrgyz Republic.

6. Money of Fund is accumulated on the bank account of authorized body of city administration Bishkek.

3. Management of Fund

7. Governing body of Fund is the Supervisory board on management of development of park zones of the city of Bishkek of Fund (further - the Supervisory board).

8. The supervisory board provides transparent and effective use of fund and performs the activities on a voluntary basis. The operating procedure and structure of the Supervisory board affirm the decision of city administration Bishkek.

9. The supervisory board performs the following functions:

1) approval of the actions aimed at the development of park zones of the city of Bishkek, and the amount of money allocated by Fund;

2) decision making on cases in point;

3) control of use of money of Fund.

10. The supervisory board has the right to involve in accordance with the established procedure representatives of state bodies, local government bodies, independent experts and consultants.

11. Meetings of the Supervisory board are held as required and are considered competent with the assistance of at least 2/3 members of the Supervisory board. Decisions are made by a majority vote, the members of the Supervisory board who are present at meeting, in case of equality of votes the final decision is made by the chairman of the Supervisory board.

12. Meetings of the Supervisory board are drawn up by the protocol which is signed by the chairman and members of the Supervisory board.

13. Based on the protocol of the Supervisory board the city administration Bishkek makes the decision on allocation of money of Fund on financing of the actions determined in Item 15 of this Procedure.

14. The authorized body of city administration Bishkek acts as the customer of the works specified in Item 15 of this Procedure.

4. The actions financed by Fund

15. Fund can be allocated for realization of the following events:

- designing, reconstruction and capital repairs of park zones;

- improvement and gardening of the territories (planting of trees, flowers, bushes, etc.);

- arrangement of infrastructure: paths, lighting, elements of architectural forms;

- device of systems of watering and drainage;

- installation of nurseries and sports grounds, etc.

5. Reporting

16. City administration Bishkek:

- bears responsibility, stipulated by the legislation the Kyrgyz Republic, for safety, target and effective use of money of Fund;

- quarterly constitutes and submits the report on receipts and use of fund in the Supervisory board;

- exercises control of observance of this Procedure.

17. The fund stops the activities for the decision of the Cabinet of Ministers of the Kyrgyz Republic.
