About provision of personal data and other accompanying information in billing system of housing and communal services

Based on paragraph two of Item 3 and part one of Item 10 of the Presidential decree of the Republic of Belarus of January 15, 2025 "About single settlement and information space" the Council of Ministers of the Republic of Belarus DECIDES: No. 28

1. Approve Regulations on procedure for provision of personal data and other accompanying information in billing system of housing and communal services it (is applied).

2. To the Ministry of Internal Affairs, the Ministry of Taxes and Tax Collection, the research and production state republican unitary enterprise "National Cadastral Agency", the republican unitary enterprise "National Center of Electronic Services", open joint stock company "The non-bank credit and financial organization "Single Settlement and Information Space" (further - NKFO ERIP) to take measures for provision on a grant basis in billing system of housing and communal services of personal data and other accompanying information by means of the nation-wide automated information system (further - OAIS).

3. Information provided according to the Regulations on procedure for provision of personal data and other accompanying information in billing system of housing and communal services approved by this resolution is processed by users of billing system of housing and communal services only with use of this system, except cases of the organization of electronic information exchange (including with use of OAIS) during the implementing of ministerial procedures, provision of such data to the users determined in subitems 11.3 and 11.4 of Item 11 of the Presidential decree of the Republic of Belarus of January 15, 2025 No. 28.

4. Use of OAIS for ensuring the information exchange provided by this resolution will be organized according to Regulations on the nation-wide automated information system, the approved Presidential decree of the Republic of Belarus of December 16, 2019 No. 460.

5. This resolution becomes effective since July 18, 2025.

Regulations on procedure for provision of personal data and other accompanying information in billing system of housing and communal services

1. This Provision determines procedure and amount of provision of personal data and other accompanying information in billing system of housing and communal services by information exchange of this system with the state information resources (systems) by means of OAIS.

2. For the purposes of this provision terms and their determinations in the values established in appendix 1 to the Presidential decree of the Republic of Belarus of January 15, 2025 No. 28 are used.

3. The Ministry of Internal Affairs for processing in billing system of housing and communal services according to the purposes (functions) determined in subitems 7. 1, 7.4 and 7.5 Items 7 of the Presidential decree of the Republic of Belarus of January 15, 2025 No. 28, based on the agreement (agreement) provides NKFO ERIP on electronic request by means of OAIS:

data from the state information system "Register of the Population" according to appendix 1;

data from the automated information system "Accounting of Citizens of the Republic of Belarus, Foreign Citizens and Stateless Persons at the Place of Residence and the Place of Stay" according to appendix 2.

The data specified in the paragraph the second to part one of this Item are provided according to identification number of physical person, the parts one of this Item specified in paragraph three, - on registration address at the place of residence and (or) the place of stay, and also on set of changes of these data for the time period.

According to the paragraph the second parts one of this Item:

the data specified in subitem 1.8 of Item of 1 appendix 1, are provided for the purposes of accounting, calculation (calculation), recalculation and charge of service fee gazo-and electric utility services, privileges on payment for housing and communal services, payment for use of premises;

the data specified in subitem 1.9 of Item of 1 appendix 1, are provided for the purposes of the direction in the place of receipt of the salary and the income of the debtor of the executive document on debt collection equated to it on payment for use of premises and (or) payment for the main and additional housing and communal services, on expense recovery for the electric power consumed on lighting of auxiliary rooms and operation of the equipment, including elevators in apartment apartment houses, on service fee on management of common property of joint household in apartment houses, penalty fee in connection with such debt, debts on compensation of the amounts of the land tax or the rent for the parcels of land occupied with apartment houses and also for the purposes of accounting, calculation (calculation), recalculation and charge of service fee gazo-and electric utility services and are stored about day of realization of these purposes;

the data specified in Item 2 appendices 1, are provided for the purposes of accounting, calculation (calculation), recalculation and charge of payment for housing and communal services, payments for use of premises, privileges and penalty fee on payment for such services, non-cash housing subsidies, outstanding amount on payment for housing-and-municipal and other services, and also for the purposes of forming of information for accomplishment of functions on solidary debt collection on payment for housing and communal services, payment for use of premises, penalty fee in connection with such debt, implementation according to petitions from citizens and legal entities of ministerial procedures.
