About approval of Rules of financing of the cultural centers of the Republic of Kazakhstan abroad

According to subitem 1-4) of article 6 of the Law of the Republic of Kazakhstan "About culture" the Government of the Republic of Kazakhstan DECIDES:

1. Approve the enclosed Rules of financing of the cultural centers of the Republic of Kazakhstan abroad.

2. This resolution becomes effective from the date of its signing.

Rules of financing of the cultural centers of the Republic of Kazakhstan abroad

Chapter 1. General provisions

1. These rules of financing of the cultural centers of the Republic of Kazakhstan abroad (further – Rules) are developed according to subitem 1-4) of article 6 of the Law of the Republic of Kazakhstan "About culture" (further – the Law) and determine procedure for financing of activities of the cultural centers of the Republic of Kazakhstan abroad.

2. The basic concepts used in these rules:

1) assets – the property and non-property benefits and the rights having cost assessment, and also the cultural values which are in property of the cultural center;

2) the budget – the expense plan and the income for certain financial year;

3) the income – the money received as a result of activities of the cultural center and also donations and the charitable help;

4) the host party – foreign state in the territory of which the cultural center is placed;

5) the cultural center of the Republic of Kazakhstan abroad (further – the cultural center) – the organization performing interaction concerning development and distribution of cultural values of the Republic of Kazakhstan, using educational, scientific and cultural potential;

6) financial year – period of time, since January 1 till December 31 of calendar year during which budget implementation is performed;

7) the head of the cultural center – the citizen of the Republic of Kazakhstan performing management of activities of the cultural center, appointed by authorized body;

8) the deputy manager of the cultural center – the citizen of the Republic of Kazakhstan performing the functions directed to the organization of work of certain activities of the cultural center and the acting as the head of the cultural center in the absence of the head of the cultural center appointed by authorized body;

9) the employee of the cultural center – person performing activities on contractual basis, the citizen of the Republic of Kazakhstan appointed by the head of the cultural center according to the approved number of staff of the cultural center (further – the worker);

10) the employee of the cultural center – person performing activities on contractual basis with whom employment relationships are governed by the legislation of adoptive state (further – the employee);

11) family members – constantly and jointly living the spouse (spouse) of the head, the deputy manager and the worker, joint or one of spouses the minor children including adopted (adopted) the parents who are in dependence;

12) authorized body – the central executive body performing management and cross-industry coordination in the field of culture;

13) the office – all rooms, buildings or part of buildings used for placement of the cultural center;

14) expenses – the money aimed at providing activities of the cultural center for realization of the tasks and functions set for it.

Chapter 2. Procedure and sources of financing

3. The basis of financing of activities of the cultural center is implementation of the bilateral international treaty signed between the Republic of Kazakhstan and foreign state about mutual organization of the cultural centers.

4. Financial provision of the cultural center is performed at the expense of the means of the republican budget and money received as a result of activities of the cultural center, and also donations and the charitable help.

5. Rendering paid services is allowed if it does not contradict regulations of the international treaty, in the following cases:

1) organization of theatrical and concert actions, exhibitions and other cultural actions;

2) organization of rates for studying of languages and culture;

3) distribution of the periodicals, catalogs, posters, programs and audiovisual materials which are directly concerning the actions organized by the cultural centers;

4) provision of consulting services for the purpose of education in the Republic of Kazakhstan.

6. The budget affirms authorized body within the means provided in the republican budget for the corresponding financial year.

7. The procedure for planning, approval, financing, budget implementation and reporting is established according to requirements of the budget legislation of the Republic of Kazakhstan.

8. The plan for the income affirms authorized body according to the budget legislation of the Republic of Kazakhstan taking into account pricing of adoptive state on goods, works and services.

9. The cultural center is provided with the transport, the office and other property necessary for ensuring its activities, according to the standard rate approved by authorized body according to the budget legislation taking into account features of adoptive state.

10. The procedure for ownership, use and order of the cultural center assigned to it property is established by the legislation of the Republic of Kazakhstan in the field of state-owned property.

11. Material, pension and social security of the head, deputy manager and employee of the cultural center, having nationality of the Republic of Kazakhstan, is performed within the provided budgetary funds.

12. The budget request is constituted and considered according to Article 75 of the Budget code of the Republic of Kazakhstan.

13. Financing of the cultural center is made according to the funding plan approved by authorized body.

14. Payment for the performed works (the rendered services) is made by authorized body based on the submitted reports on the done work, acts of the performed works (the rendered services), invoices.

15. To the act of the performed works (the rendered services) the report on actual expenses is attached to the act of the performed works (the rendered services) on form according to appendix to these rules.

16. The structure and the staff list of the cultural center the forthcoming financial year affirm the head of the cultural center in coordination with authorized body.
