About approval of Rules of maintaining the register of the Kazakhstan producers

1. Approve the enclosed Rules of maintaining the register of the Kazakhstan producers.

2. To provide to development department of industrial infrastructure and intra country value of the Industry ministry and construction of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Industry ministry and construction of the Republic of Kazakhstan;

3. To impose control of execution of this order on the supervising vice-Minister of Industry and construction of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of maintaining register of the Kazakhstan producers

Chapter 1. General provisions

1. These rules of maintaining the register of the Kazakhstan producers (further – Rules) are developed according to Item 2 of article 97-1 of the Entrepreneurial code of the Republic of Kazakhstan and subitem 41-1) of article 9 of the Law of the Republic of Kazakhstan "About industrial policy" (further – the Law) and determine procedure for forming and maintaining the register of the Kazakhstan producers (further - the register).

2. The register is the object of information and communication infrastructure of "the electronic government" containing data on the Kazakhstan producers and the goods made by them.

Use of the register of the applicant and the Kazakhstan producer is performed on a grant basis.

3. In these rules the following concepts are applied:

1) the applicant – the subject of entrepreneurship who is resident of the Republic of Kazakhstan, submitted the application about inclusion in the register;

2) the Kazakhstan producer – the subject of entrepreneurship which is resident of the Republic of Kazakhstan, included in the register of the Kazakhstan producers;

3) goods of the Kazakhstan origin – the goods which are completely made in the Republic of Kazakhstan, or the processed goods corresponding to conditions of production in case of which production the minimum threshold of production and technology operations, data on which contain in the register, is carried out;

4) digital verification – the automatic process of assessment of the applicant performed by means of object of information and communication infrastructure of "the electronic government";

5) model of machine training "Logistic Regression" – algorithm of machine training for tasks in data processing and estimates of productive activity, used in the course of digital verification;

6) industry association (union) – the associations of individual entrepreneurs and (or) legal entities for the purpose of coordination of their business activity, and also representation and protection of interests accredited in National chamber of entrepreneurs of Atameken;

7) industry state body – the state body performing management in the respective sphere (industry) of public administration;

8) authorized body in the field of the state stimulation of the industry (further – authorized body) – the central executive body performing management in the field of the industry and also in limits, stipulated by the legislation the Republic of Kazakhstan, cross-industry coordination and participation in realization of the state stimulation of the industry;

9) share of intra country value – percentage of cost of raw materials and materials of foreign origin in cost of ready goods;

10) production localization level – the quantitative index determining the number of the carried-out technology transactions in number of technology transactions according to the List of conditions of production, the production and technology operations approved by authorized body according to Item 3 of article 51-7 of the Law.

4. Forming of the register is performed by authorized body and consists of the following stages:

1) application through personal account of the user on the web portal of object of information and communication infrastructure of "the electronic government" (further – the web portal);

2) digital verification;

3) assessment of production by the industry commission;

4) decision making by authorized body about inclusion or not inclusion in the register.

5. The authorized body provides publication and maintaining the urgent register in form according to appendix 1 to these rules.

6. Confirmation of availability of the Kazakhstan producer in the register is the statement in form according to appendix 2 to these rules.
