About registration of hazardous production facilities in the state register of hazardous production facilities

According to article 2 of the Federal law "About Industrial Safety of Hazardous Production Facilities" Government of the Russian Federation decides:

1. Approve the enclosed Rules of registration of hazardous production facilities in the state register of hazardous production facilities.

2. Recognize invalid acts of the Government of the Russian Federation according to the list according to appendix.

3. Realization of the powers provided by this resolution is performed by federal executive bodies within the number of workers of the federal executive bodies and budgetary appropriations provided to the specified bodies in the federal budget on management and management in the field of the established functions established by the Government of the limiting Russian Federation.

4. The data characterizing hazardous production facility, provided by legal entities and individual entrepreneurs for registration of the hazardous production facility operated by them in the state register of hazardous production facilities and also the applications for exception of hazardous production facility of the state register of hazardous production facilities submitted (directed) to day entries into force of this resolution are subject to consideration according to the regulatory legal acts operating about day of entry into force of this resolution.

5. This resolution becomes effective since March 1, 2026.

The rules approved by this resolution are effective till March 1, 2032.

Rules of registration of hazardous production facilities in the state register of hazardous production facilities

1. These rules establish order of registration of hazardous production facilities in the state register of hazardous production facilities (further - the state register), including requirements to maintaining the state register.

2. The hazardous production facilities specified in appendix 1 to the Federal Law "About Industrial Safety of Hazardous Production Facilities" (further - the Federal Law) which are operated by legal entities and individual entrepreneurs (further - the operating organizations) are subject to registration in the state register.

3. Registration of hazardous production facilities in the state register is performed by Federal Service for Environmental, Technological and Nuclear Supervision (its territorial authorities), the Ministry of Defence of the Russian Federation, Federal Security Service of the Russian Federation, Federal Guard Service of the Russian Federation, Russian Foreign Intelligence Service, the Directorial Board for the Special Programs of the President of the Russian Federation, Federal Penitentiary Service (further - federal executive bodies) and State Atomic Energy Corporation "Rosatom" (further - Corporation).

4. The state register contains the data on the operating organizations, hazardous production facilities this about the hazardous production facilities excluded from the state register and archive part of the state register.

Data on the operating organizations, hazardous production facilities subordinated to the Ministry of Defence of the Russian Federation, Federal Security Service of the Russian Federation, Federal Guard Service of the Russian Federation, Russian Foreign Intelligence Service, the Directorial Board for the Special Programs of the President of the Russian Federation, Federal Penitentiary Service and Corporation, are made to departmental sections of the state register.

Data on other operating organizations, hazardous production facilities are made to territorial sections of the state register.

5. Maintaining departmental Sections of the state register is performed by the Ministry of Defence of the Russian Federation, Federal Security Service of the Russian Federation, Federal Guard Service of the Russian Federation, Russian Foreign Intelligence Service, the Directorial Board for the Special Programs of the President of the Russian Federation, Federal Penitentiary Service and Corporation.

Maintaining territorial Sections of the state register is performed Federal Service for Environmental, Technological and Nuclear Supervision (its territorial authorities).

6. The state register is kept in departmental information system of Federal Service for Environmental, Technological and Nuclear Supervision.

7. For registration of hazardous production facility in the state register the operating organization carries out assessment of processes (works) which are performed (are carried out) on hazardous production facility, regarding their compliance to processes (works) specified in appendix 1 to the Federal Law and classification of hazardous production facility according to appendix 2 to the Federal Law (further - identification).

8. When carrying out identification the operating organization carries out assessment of all processes (works) which are performed (are carried out) on hazardous production facility, and also considers all engineering procedures and the technical devices used on hazardous production facility performed on hazardous production facility.

9. For the purpose of assessment of processes (works) which are performed (are carried out) on hazardous production facility, when carrying out identification the operating organization carries out the analysis:

a) the project documentation on construction, reconstruction of hazardous production facility, the project documentation on capital repairs of the linear object which is hazardous production facility, documentation on modernization, capital repairs of hazardous production facility (taking into account the changes made to such documentation (in case of their availability);

b) reasons for safety of hazardous production facility (in case of development of the specified reasons according to item 4 of article 3 of the Federal Law);

c) declarations of industrial safety (in case of development of the specified declaration according to Item 2 of article 14 of the Federal Law);

d) production schedules (in the presence);

e) data on the applied technologies on production;

e) specifications of equipment in place;

g) documentation on the technical devices used on hazardous production facility;

h) data on amount of dangerous substances which at the same time are or can be on hazardous production facility concerning which identification, and also on the hazardous production facilities located at distance of less than 500 meters from hazardous production facility concerning which identification is carried out irrespective of, such hazardous production facilities are operated by one operating organization or the different operating organizations (in the presence of such data concerning the hazardous production facilities located at distance less than 500 meters from hazardous production facility concerning which identification is carried out) is carried out.

10. Based on the data obtained during identification, the operating organization creates the data provided by the subitem "an" of Item 13 of these rules characterizing hazardous production facility.

11. By results of the carried-out identification the operating organization appropriates to hazardous production facility the standard name (personalized code) according to appendix and determines class of danger of hazardous production facility which is offered to be appropriated in case of registration of hazardous production facility in the state register.

Features of carrying out identification concerning hazardous production facilities to which separate standard names (personalized codes) are appropriated are determined by appendix to these rules.

12. Correctness of carrying out identification, including assignment to hazardous production facility of the standard name (personalized code), is checked by federal executive body and Corporation in case of registration of hazardous production facility in the state register (modification of the data containing in the state register) based on the documents and data provided by the operating organization according to Items 13 - 16 and 28 these rules.

13. For registration of hazardous production facility in the state register the operating organization represents to federal executive body or Corporation the statement for registration of hazardous production facility in the state register (further - the statement for registration of object) conforming to the requirements established by these rules and also the following documents and data attached to it:

a) the data characterizing hazardous production facility, prepared based on the analysis of documents and data, stipulated in Item 9 these rules, other documents and results of the carried-out identification, containing the following data:

full name and address of hazardous production facility;

standard name (personalized code) of hazardous production facility;

processes (works) which are performed (are carried out) on hazardous production facility and are specified in appendix 1 to the Federal Law;

classification of hazardous production facility according to appendix 2 to the Federal Law;

class of danger of hazardous production facility which is offered to be appropriated to hazardous production facility, determined by results of the carried-out identification;

the types of activity performed on hazardous production facility and which are subject to licensing (activities for operation explosion-fire-hazardous and chemically hazardous production facilities I, II and III classes of danger, the activities connected with the address of explosive materials of industrial function and (or) production of surveying works);

data on the operating organization (for the legal entity - complete and (in the presence) the reduced names, identification taxpayer number, the primary state registration number, the address, position, surname, name and middle name (in the presence) the head of the legal entity; for the individual entrepreneur - surname, name and middle name (in the presence), identification taxpayer number, the primary state registration number of the individual entrepreneur, the address to which the individual entrepreneur is registered at the place of residence);

names of the company or its workshop, the site, the platform, other production facility which is hazardous production facility, buildings and constructions on hazardous production facility;

the name of dangerous substance according to the table 1 of appendix 2 to the Federal Law, type of dangerous substance according to the table 2 of appendix 2 to the Federal Law and data on its quantity according to the subitem "z" of Item 9 of these rules;

the name, type, brand, model (in the presence), registration or accounting numbers (in the presence) for self-propelled lifting constructions and the equipment which is working under pressure in portable and transportable installations, subject to accounting according to federal regulations and rules of industrial safety, project (operational) characteristics, serial numbers and (or) accession numbers (in the presence) of the technical devices used on hazardous production facility;

project (operational) characteristics of buildings and constructions on hazardous production facility and date of their commissioning (in the presence of such data);

signature date of the data characterizing hazardous production facility;

b) copies of the documents confirming availability at the operating organization on the property right or other legal cause:

or the parcels of land on which the hazardous production facility is placed or buildings and constructions on hazardous production facility (if the appropriate rights to such parcels of land or buildings and constructions (encumbrances of such parcels of land or buildings and constructions) are not registered in the Single state real estate register);

or technical devices using which the processes are performed (are performed works) specified in Items 2 and 3 of appendix 1 to the Federal Law;

c) details of the documents confirming availability at the operating organization on the property right or other legal cause of the parcels of land on which the hazardous production facility is placed or buildings and constructions on hazardous production facility (if the appropriate rights to such parcels of land or buildings and constructions (encumbrances of such parcels of land or buildings and constructions) are registered in the Single state real estate register);

d) the copy of text part of the Section "Technology solutions" of the project documentation of the building and (or) construction on hazardous production facility (with indication of details of experimental testimony of the project documentation of the respective building and (or) construction) or the copy of documentation on modernization of hazardous production facility (with indication of details of experimental testimony of industrial safety of documentation on modernization of hazardous production facility if documentation on modernization of hazardous production facility is not part of the project documentation of such object);

e) reasons for safety of hazardous production facility or documents which contain reasons for safety of hazardous production facility, with indication of details of positive experimental testimony of industrial safety of such reasons (in cases, stipulated in Item 4 articles 3 of the Federal Law).

14. If the project documentation of the building and (or) construction on hazardous production facility developed before entry into force of the order of the Government of the Russian Federation of February 16, 2008 No. 87 "About structure of Sections of the project documentation and requirements to their content" does not contain the Section "Technology solutions" or the project documentation of the building and (or) construction on hazardous production facility, documentation on modernization of hazardous production facility are absent, instead of the copy of the document provided by the subitem "g" of Item 13 of these rules, the operating organization represents to federal executive body or Corporation the copy of the production schedules developed according to federal regulations and rules of industrial safety or other documents containing the following data on such building, construction, object:

a) the characteristic of the accepted technology scheme of production in general and separate parameters of engineering procedure;

b) description of sources of raw materials and materials;

c) indicators and characteristics of the accepted engineering procedures and the equipment;

d) quantity and types of the service equipment, including weight lifting equipment, vehicles and mechanisms;

e) data on settlement number, the vocational list of workers with distribution on groups of production processes, number of workplaces and their equipment;

e) the description of the project decisions directed to observance of requirements of production schedules;

g) schematic diagrams of engineering procedures from the place of intake of raw materials and materials before finished product output;

h) technology layouts on the body (workshops) with indication of locations of the capital processing equipment and vehicles;

i) the scheme of cargo flows (in case of their availability).

15. For registration in the state register of hazardous production facility on which according to the technology documentation provided by federal regulations and rules of industrial safety continuous production process of the main productive activity caused by features of engineering procedure instead of copies of the documents and data provided by subitems "b" and "v" of Item 13 of these rules is performed the operating organization has the right to provide to federal executive body or Corporation the consent of the owner of such object to its operation (in a free form), and also the documents confirming continuity of production process of the main productive activity caused by features of engineering procedure.

16. For registration of hazardous production facility in the state register, and also in case of modification of the data containing in the state register until state registration of the property right to the building, construction on hazardous production facility or other rights to such building, construction (encumbrances such buildings, constructions) which is legal causes of availability at the operating organization such buildings, constructions instead of copies of the documents provided by paragraphs the first and second the subitem "b" of Item 13 of these rules, the operating organization has the right to provide to federal executive body or Corporation the copy of the technical plan such buildings, constructions and (or) the copy of the title document on the parcel of land on which such building, construction is placed and if such the building, construction can be placed on the parcel of land without provision of the parcel of land and establishment of the servitude, - the copy of permission to use of the lands and the parcel of land which are in the state-owned or municipal property.

17. The statement for registration of object, the statement for modification of the data containing in the state register (further - the statement for modification of data), contain the statement for exception of hazardous production facility of the state register (further - the statement for object exception):

a) data on the operating organization (for the legal entity - complete and (in the presence) the reduced names, identification taxpayer number, the primary state registration number, the address, position, surname, name and middle name (in the presence) the head of the legal entity, contact information (the e-mail address (in the presence), the postal address, phone); for the individual entrepreneur - surname, name and middle name (in the presence), identification taxpayer number, the primary state registration number of the individual entrepreneur, the address to which the individual entrepreneur is registered at the place of residence, contact information (the e-mail address (in the presence), the postal address, phone);

b) data on the rights of the operating organization to hazardous production facility, the parcels of land on which the hazardous production facility, buildings and constructions on hazardous production facility with indication of type of the right, details of the documents confirming such rights, cadastral numbers of the parcels of land is located (in the presence of such data);

c) information on registration of hazardous production facility in the state register (for the statement for modification of data, statements for object exception);

d) the bases for modification of the data containing in the state register (for the statement for modification of data);

e) the bases for exception of hazardous production facility of the state register (for the statement for object exception);

e) information on change of the data on the operating organization containing in the state register (for the statement for modification of data providing change of such data);

g) address of hazardous production facility;

h) the method of receipt of the notifications provided by the paragraph third Item 23, the paragraph the second Item 24 chosen by the operating organization (for the statement for registration of object, the statement for modification of data) and the paragraph the second Item 36 (for the statement for object exception) these rules.
