About approval of the Regulations on use of electronic confidential services in case of receipt by payment service providers of access to accounts of users of payment services

According to Articles 7, of 15, 56 Laws of Ukraine "About the National Bank of Ukraine", article 9 of the Law of Ukraine "About electronic identification and electronic confidential services", article 53 of the Law of Ukraine "About payment services", for the purpose of determination of procedure for use of electronic confidential services in case of receipt by payment service providers of access to accounts of users of payment services the Board of the National Bank of Ukraine decides:

1. Approve Regulations on use of electronic confidential services in case of receipt by payment service providers of access to accounts of users of payment services which is applied.

2. To department of safety (Alexander Palamarchuk) after official publication to inform skilled suppliers of electronic confidential services, data on which are entered in the confidential list based on the decision of certification center, payment service providers on initiation of payment transaction, payment service providers on provision of data from accounts, payment service providers on servicing of the account information on adoption of this resolution.

3. To impose control over the implementation of this resolution on the Head of the National Bank of Ukraine Andrey Pyshny.

4. The resolution becomes effective since August 1, 2025.

Regulations on use of electronic confidential services in case of receipt by payment service providers of access to accounts of users of payment services

1. This Provision is developed according to the laws of Ukraine "About the National Bank of Ukraine", "About electronic identification and electronic confidential services" (further - the Law on confidential services), "About payment services" (further - the Law on payment services) and determines procedure for use of electronic confidential services in case of receipt by payment service providers of access to accounts of users of payment services.

This Provision is developed according to requirements of the National DSTU ETSI TS 119 495 standard: 2022 "Digital signatures and infrastructures (ESI). Sectoral specific requirements. Profiles of certificates and the requirement of policy of TSP for open bank servicing (ETSI TS 119 495 V1.5.1 (2021-04), IDT)", the State company "Ukrainian Research and Training Center of Problems of Standardization, Certification and Quality" approved by the order of November 29, 2022 No. 232 (further - DSTU ETSI TS 119 495).

2. Terms in this Provision are used in such value:

1) request for blocking - the electronic statement / electronic data sent to qualified predostavitel of electronic confidential services (further - qualified predostavitel) the National Bank of Ukraine (further - National Bank) and based on which the qualified predostavitel blocks the qualified certificate of electronic seal or the qualified certificate of authentication of the website (further - the qualified certificate of open banking);

2) request for updating - the electronic statement / electronic data based on which the skilled supplier renews the qualified certificate of open banking blocked at the initiative of National Bank;

3) request for cancellation - the electronic statement / electronic data which go to qualified predostavitel National Bank and based on which the qualified predostavitel cancels the qualified certificate of open banking;

4) the skilled supplier of electronic confidential services - the skilled supplier of electronic confidential services, data on whom are entered in the Confidential list based on the decision of certification center.

The term "single identifier of National Bank" is used in the value given in the Regulations on system of single identification of members of the financial market of Ukraine approved by the resolution of Board of the National Bank of Ukraine of August 30, 2021 No. 92.

Other terms in this Provision are used in the values given in the Law on confidential services, the Law on payment services.

3. Requirements of this provision extend to payment service providers on initiation of payment transaction (further - Scientific Production Enterprise on initiation of payment transaction), payment service providers on provision of data from accounts (further - Scientific Production Enterprise on provision of data from accounts), payment service providers on servicing of the account (further - Scientific Production Enterprise on servicing of the account), skilled suppliers, National Bank.

Scientific Production Enterprises on initiation of payment transaction, Scientific Production Enterprise on provision of data from accounts, Scientific Production Enterprise on servicing of the account (further - Scientific Production Enterprise) when using electronic confidential services, qualified predostavitel by provision of electronic confidential services shall fulfill requirements of the Law on confidential services, requirements of the regulatory legal acts adopted according to it, and also requirements of this provision.

4. The qualified certificate of open banking can be created taking into account the requirements determined in Item 9 of this provision only for:

1) Scientific Production Enterprise on servicing of the account;

2) Scientific Production Enterprise on initiation of payment transaction;

3) Scientific Production Enterprise on provision of data from accounts.

The qualified certificate of open banking contains data that the qualified certificate of open banking is created for Scientific Production Enterprise on servicing of the account and/or Scientific Production Enterprise on initiation of payment transaction, and/or Scientific Production Enterprise on provision of data from accounts (further - type of Scientific Production Enterprise) for which this qualified certificate of open banking is created.

The list of the data containing in qualified certificates of open banking is determined in appendix to this Provision.
