Art. 1. - Approve Methodology of calculation of the losses caused by transition of lands from category of lands of agricultural purpose or lands of forest fund in other category it (is applied).

Art. 2. - This law becomes effective since January 1, 2026.

Methodology of calculation of the losses caused by transition of lands from category of lands of agricultural purpose or lands of forest fund in other category

I. General provisions

1.1. The methodology of calculation of the losses caused by transition of lands from category of lands of agricultural purpose or lands of forest fund in other category is developed for the purpose of establishment of single method of calculation of these losses.

1.2. Compensation of the losses caused by transition of lands from category of lands of agricultural purpose or lands of forest fund in other category is performed in all cases by the interested physical persons and legal entities irrespective of purpose of lands and type of property on them, except as specified, provided by part (4) Article 60 of the Land code No. 22/2024.

1.3. The money intended for compensation of the losses caused by transition of lands from category of lands of agricultural purpose or lands of forest fund in other category is transferred into the government budget if the decision was approved by the order of the Government, or into the local budget if the decision was made by council of administrative and territorial unit of the first or second level or People's Assembly of Gagauzia.

II. Calculation of the losses caused by transition of lands from category of lands of agricultural purpose or lands of forest fund in other category

2.1. The losses caused by transition of lands from category of lands of agricultural purpose or lands of forest fund in other category are calculated according to Item 2.6 and depend on specific features of the specified lands, such as land area and assessment of site class of the soil, using rate for one ballo-hectare when calculating the losses caused by transition of lands from category of lands of agricultural purpose or lands of forest fund in other category and correction coefficient to rate for one ballo-hectare.

2.2. The site class of the soil is determined by results of the soil researches conducted in field conditions by the public or private institution having laboratory for carrying out the corresponding researches and qualified personnel. The specified researches are considered valid in case of their carrying out not earlier than before four years about day of the edition of the administrative act about transition of lands from category of lands of agricultural purpose or lands of forest fund in other category.

The site class of the soil is calculated for each soil contour within the parcel of land of the agricultural purpose or forest fund which is subject to transfer in other category.

2.3. Rate size for one ballo-hectare when calculating the losses caused by transition of lands from category of lands of agricultural purpose or lands of forest fund in other category (further - rate for one ballo-hectare), is equivalent to the size of unrealized income from the corresponding parcel of land for 99 years and is determined by the following formula:

T = 99 x ((Vp/S)/Fm),

where:

T - rate for one ballo-hectare, lei;

Vp - the annual average amount of agricultural products in current prices determined over the last ten years (except for the year preceding year for which the corresponding indicator is established) according to National bureau of statistics, one thousand lei;

S - the annual average area of sowing lands irrespective of category of economy determined over the last ten years (except for the year preceding year for which the corresponding indicator is established) according to National bureau of statistics, one thousand hectares;

Fm - the weighted average site class of soils of the Republic of Moldova, points.

2.4. The rate for one ballo-hectare affirms annually the order of the Minister of Agriculture and the food industry.

2.5. When calculating the losses caused by transition of lands from category of lands of agricultural purpose or lands of forest fund in other category the following correction coefficients are applied to rate for one ballo-hectare:

2.5.1. for municipiums of Chisinau and Belts (including the cities and villages (commune) which are their part) - 1,0;

2.5.2. for other cities / municipiums - 0,8;

2.5.3. for other villages (communes) - 0,5;

2.5.4. for the parcels of land which are referred to category of the lands intended for construction and improvement, and the lands intended for housing construction in the rural zone (except for apartment apartment houses), according to town-planning documentation - 0,25.

Note. In case of the parcels of land located in the administrative and territorial units provided by subitems 2.5.2 and 2.5. 3, and also in case of the parcels of land provided by subitem 2.5. 4, competent authorities in case of approval of the local budget can make the decision on application of other correction coefficients in the set limits but which are not exceeding 1,0.

2.6. Calculation of the losses caused by transition of lands from category of lands of agricultural purpose or lands of forest fund in other category is made on formula:

Pt = (S1 x F1 + S2 x F2 + S3 x F3 +... + Sn x Fn) x T x Q,

where:

Pt - the losses caused by transition of lands from category of lands of agricultural purpose or lands of forest fund in other category, lei;

S 1, S 2, S 3, Sn - the area of soil contours within the parcel of land of the agricultural purpose or forest fund which is subject to transfer in other category, hectare;

F 1, F 2, F 3, Fn - site class of the soil on soil contours within the parcel of land of the agricultural purpose or forest fund which is subject to transfer in other category, points;

T - rate for one ballo-hectare, lei;

Q - correction coefficient to rate for one ballo-hectare.
