About cases and procedure for movement of goods in other places which are places of movement of goods through customs border of the Eurasian Economic Union

For the purpose of streamlining of movement of goods and vehicles on certain sites of Frontier of the Kyrgyz Republic, according to Item 3 of Article 10, item 4 of Article 353 of the Customs code of the Eurasian Economic Union, part 2 Articles 11, part 3 of article 148 of the Law of the Kyrgyz Republic "About customs regulation", articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Determine other places of movement of goods which are places of movement of goods through customs border of the Eurasian Economic Union, and also the requirement to arrangement and material equipment of other places necessary for the organization of the state types of control according to appendix to this resolution.

2. Determine that:

1) movement of goods through other places specified in Items 1-5 of appendix to this resolution is allowed in the following cases:

- movement of foreign goods and vehicles from the territory of the third country on the territory of the same country through the territory of the Kyrgyz Republic which cannot remain in the territory of the Kyrgyz Republic;

- movement of goods for private use with payment of single rates of customs duties and taxes the, and also customs duties and taxes levied in the form of cumulative customs payment according to acts of the Eurasian economic commission;

2) foreign vehicles with goods on which the Cabinet of Ministers of the Kyrgyz Republic makes the decision on exemption of customs fees or there is appeal of the ministries, departments of the Kyrgyz Republic or the plenipotentiary of the President of the Kyrgyz Republic in Batken Province of the Kyrgyz Republic, and also the foreign automobile vehicles and empty cargo vehicles moved from the territory of the third country on the territory of the same country through other places specified in Items 1-5 of appendix to this resolution are transported with establishment of route of transportation of goods by customs authority without carrying out customs escort;

3) movement of goods in other places specified in Items 6-14 of appendix to this resolution is allowed only when moving by physical persons of goods for private use within the established cost, weight and (or) quantitative regulations;

4) in other place specified in Item 15 of appendix to this resolution only export of the following types of the goods placed under customs procedure of export at Batken customs and entrance on the territory of the Kyrgyz Republic of empty cargo vehicles for loading of these goods is performed:

To provide to authorized state body in the field of protection of frontier non-admission of movement through other places specified in Items 6-14 of appendix to this resolution, the foreign goods specified in the subitem 1 of Item 2 of this resolution, and also the goods exceeding the established regulations of duty-free importation for private use. Such goods are subject to redirection for movement through other places specified in Items 1-5 of appendix to this resolution.

4. To plenipotentiaries of the President of the Kyrgyz Republic in the Batken and Osh regions of the Kyrgyz Republic in six-months time from the date of entry into force of this resolution to provide provision of the parcels of land to authorized state bodies in the field of protection of frontier and customs affairs in accordance with the established procedure with leading of the electric power and water supply for the organization of activities, creation and development of necessary infrastructure in other places specified in appendix to this resolution.

5. To the state monitoring bodies specified in appendix to this resolution in three-months time from the date of accomplishment of actions, the stipulated in Item 4 presents of the resolution, within budgetary funds:

1) to complete arrangement and equipping of workplaces in other places specified in appendix to this resolution;

2) to hold the organizational and regular and other events necessary for realization of provisions of this resolution.

6. The realization of this resolution is enabled within the approved number of staff and means provided in the republican budget for 2025 and the next years for the relevant state bodies.

7. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

8. This resolution becomes effective after fifteen days from the date of official publication, except for Items 1-3, which become effective after six months from the date of entry into force of this resolution.
