About the mechanism of legal proceedings on cases on corruption and the cases connected with corruption
For the purpose of strengthening of efforts on fight against corruption and quality assurance and efficiency of legal proceedings on criminal cases about corruption acts and to the cases connected with corruption acts
The Parliament adopts this organic law.
(1) This law regulates role, creation, procedure for the organization and functioning of specialized anti-corruption base at the level of degrees of jurisdiction as the mechanism of acceleration of administration of law.
(2) the Organization and functioning of specialized anti-corruption base at the level of degrees of jurisdiction are regulated by the Constitution of the Republic of Moldova, the Law on judicial system No. 514/1995, the Law on the status of the judge No. 544/1995, the Law on disciplinary responsibility of judges No. 178/2014, the Law on selection of judges and assessment of their activities No. 147/2023, by the Code of penal procedure, the Code of civil procedure, the Administrative code and other regulations.
The role of creation of specialized anti-corruption base at the level of degrees of jurisdiction consists in administration of law on the criminal cases provided by the law which belong to top-level corruption crimes, and cases on connected with corruption acts, and also on other cases provided by this law, in implementation of judicial control of acts of National authority on integrity which establish essential difference between the gained income performed by expenses and the acquired property and in administration of law on the cases on confiscation of unreasonable property initiated by National authority on integrity.
At the level of degrees of jurisdiction the specialized anti-corruption base includes:
a) Specialized anti-corruption board the Vessels Chisinau (further - Anti-corruption board);
b) specialized anti-corruption structures of the Appeal Center chamber.
(1) the Anti-corruption board considers in the first instance criminal cases on the crimes provided by Articles 181-1-181-3, 239-240, parts (3) - (5) Articles 244, Articles 324-335-1, 337-338-2, 340-341 and part (2) article 352-1 of the Criminal code No. 985/2002, and also on crimes, related.
