About approval of the Regulations on the mechanism of the early notification about emergence of new drugs, new psychoactive agents, preprecursors and substitutes of precursors in the Kyrgyz Republic
For the purpose of implementation of the National development program of the Kyrgyz Republic till 2026 approved by the Presidential decree of the Kyrgyz Republic "About the National development program of the Kyrgyz Republic till 2026" of October 12, 2021 No. 435, according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:
1. Approve Regulations on the mechanism of the early notification on emergence of new drugs, new psychoactive agents, preprecursors and substitutes of precursors in the Kyrgyz Republic according to appendix.
2. Determine that the expenses connected with implementation of this resolution are performed within means of the involved state bodies and local government bodies for the corresponding years, and also at the expense of other means which are not contradicting the legislation of the Kyrgyz Republic.
3. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.
4. This resolution becomes effective after fifteen days from the date of official publication.

1. The regulations on the mechanism of the early notification on emergence of new drugs, new psychoactive agents, preprecursors and substitutes of precursors in the Kyrgyz Republic (further - the Provision) determine the purposes, tasks and procedure for functioning of the mechanism of the early notification about emergence of new drugs, new psychoactive agents, preprecursors and substitutes of precursors (further - the mechanism of the early notification).
2. In this Provision the following concepts and terms are used:
coordinators - responsible officials of respondents;
the commission on drugs and drug addiction - the advisory body designed to perform the activities on a voluntary basis for the risk analysis and threats proceeding from specific types of new psychoactive agents, preprecursors and substitutes of precursors, and introduction of reasonable offers on their inclusion in the List of the drugs which are subject to control in the Kyrgyz Republic, psychotropic substances, their analogs and precursors, and also live organisms containing them approved by the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About the drugs, psychotropic substances, their analogs and precursors which are subject to control in the Kyrgyz Republic" of March 26, 2025 No. 152 (further - the List of drugs and psychotropic substances) or in the List of strong substances, and also to determination of their sizes for qualification of acts under the Criminal code of the Kyrgyz Republic and the Code of the Kyrgyz Republic about offenses;
the mechanism of the early notification about emergence of new drugs, new psychoactive agents, preprecursors and substitutes of precursors in the Kyrgyz Republic - the interdepartmental, multi-profile, permanent system including the interested state bodies and local government bodies (further - OMSU), providing monitoring and assessment of drug abuse situation, timely identification and exchange of information about emergence of new drugs, new psychoactive agents, preprecursors and substitutes of precursors, and also performing assessment of the related risks and development of offers on response measures and counteractions to health hazards of the population;
new drugs - the substances included in lists of the Single convention of the United Nations (further - the UN) about drugs of 1961, the Convention of the UN on psychotropic substances of 1971 and the Convention of the UN on fight against illicit trafficking in drugs and psychotropic substances of 1988 (further - international conventions) or the list of the Eurasian economic commission (further - ECE), but not included according to the Law of the Kyrgyz Republic "About drugs, psychotropic substances, their analogs and precursors" in the List of drugs and psychotropic substances;
new psychoactive agents - psychoactive agents in the form of chemical substances or medicines of natural origin which are not controlled within international conventions and decisions of ECE and are not included in the List of drugs and psychotropic substances, but the populations constitute health hazard;
psychoactive agents - chemical substances or medicines of natural origin which in case of acceptance or introduction in human body influence mental processes;
the register of new drugs, new psychoactive agents, preprecursors and substitutes of precursors - the database containing data on emergence of new drugs and new psychoactive agents, and also preprecursors and substitutes of precursors;
respondents - the operating units of the ministries, departments and OMSU interacting with the republican center of monitoring;
the republican center of monitoring of new drugs, new psychoactive agents, preprecursors and substitutes of precursors (further - the republican center of monitoring) is crucial element of the mechanism of the early notification. The republican center of monitoring provides functioning of this mechanism, performs monitoring of the situation connected with turnover of new drugs, new psychoactive agents, preprecursors and substitutes of precursors and also coordinates activities of participants of the mechanism of the early notification for the purpose of prevention of further distribution of the specified substances in the territory of the Kyrgyz Republic;
strong substances - the psychoactive agents which are not included in the lists of drugs, psychotropic substances, their analogs and precursors having psychoactive effect on human body or strengthening effect of the psychoactive agents included in lists of strong substances.
3. This Provision determines the principles of work, organizational structure of the mechanism of the early notification, task, function, the right and obligation of participants of the mechanism of the early notification, and also procedure for their interaction with physical persons and legal entities.
4. Participants of the mechanism of the early notification are competent state bodies and OMSU of the Kyrgyz Republic, the international and non-profit organizations, mass media (further - media), other legal entities and physical persons.
