1. Approve Regulations on payment procedure of lump-sum allowance in case of approach of disability as a result of damage suffered to the worker by mutilation, occupational disease, other damage of health or its death connected with execution of labor obligations by it according to appendix.

2. Determine that implementation of this resolution regarding workers of the budget sphere is carried out within the approved republican budget for the corresponding years.

3. This resolution is subject to official publication and becomes effective since January 28, 2025.

Regulations on payment procedure of lump-sum allowance in case of approach of disability as a result of damage suffered to the worker mutilation, occupational disease, other damage of health or its death connected with execution of labor obligations by it

Chapter 1. General provisions

1. This Provision establishes payment procedure of lump-sum allowance to workers (or to their heirs) in case of the approach of disability, mutilation, occupational disease, other damage of health or death connected with execution of labor obligations by them. The provision extends to all employees of the organization, irrespective of their position and length of service.

2. The lump-sum allowance is paid in the following cases:

1) approaches of disability at the worker as a result of mutilation or the occupational disease got in the course of accomplishment of labor obligations;

2) the death of the injured (supporter) connected with execution of labor obligations.

3. The lump-sum allowance is paid over compensation of the lost earnings, additional types of indemnification, stipulated in Clause 218 Labor codes of the Kyrgyz Republic.

4. The amount of indemnification to the victim is determined depending on the extent of loss of professional working capacity established to it which is determined based on the conclusion of medico-social commission of experts (further - MSEK).

Chapter 2. Determination of the size of lump-sum allowance and source of financing

5. The lump-sum allowance is granted taking into account disability and disability:

- in case of disability of III group - in the amount of three annual average salaries on the republic calculated from the average monthly salary established by National Statistical Committee Kyrgyz the Republics (further - NSK);

- in case of disability of the II group - five annual average salaries on the republic calculated from the average monthly salary established by NSK;

- in case of disability of the I group - seven annual average salaries on the republic calculated from the average monthly salary established by NSK;

6. The lump-sum allowance, in the amount of twelve annual average earnings calculated from the average monthly salary established by NSK is paid to persons having the right to indemnification in connection with the death of the supporter.

7. The size of the average monthly salary for determination of the size of lump-sum allowance is established based on the official data NSK existing at the time of accident approach.

8. For the workers of the budget sphere, including for the state and municipal companies, organizations performing economic activity by the principles of self-financing except for of the government civil and local government officers determined by the Law of the Kyrgyz Republic "About the public civil service and municipal service" the lump-sum allowance is granted in the following sizes:

- in case of disability of III group - five hundred thousand (500000) som;

- in case of disability of the II group - one million (1000000) som;

- in case of disability of the I group - one million five hundred thousand (1500000) som.

9. The lump-sum allowance in the amount of two million is paid to persons having the right to indemnification in connection with the death of the supporter (2000000) som.

10. In case of the death of the injured (supporter) persons determined according to Article 221 of the Labor code of the Kyrgyz Republic have the right to indemnification.

11. The lump-sum allowance is paid from own means of the employer.

Chapter 3. Procedure and payment due dates of the amounts of lump-sum allowances

12. Payment of lump-sum allowance is made in the organization, the company, organization in which until death or getting injured the victim worked.

13. In case of reorganization or liquidation of the organization payment of lump-sum allowance is made by his legal successor or higher body under authority of which the organization is.

14. The decision on payment of lump-sum allowance is determined based on the Act of labor accident (the H-1) form on place of employment of the victim and is drawn up by the order.

15. The employer shall perform payment of lump-sum allowance by transfer to the bank account or cash not later than in 10 working days after decision making about payment.

Chapter 4. Procedure for giving and consideration of the applications on allowance payment

16. For receipt of lump-sum allowance the worker/applicant (or his heirs) submits the application to the organization in which the victim worked, in writing, having specified in it the reason and circumstances of approach of injury or death.

The following documents are enclosed to the application:

- conclusion of MSEK about extent of loss by the victim of professional working capacity;

- conclusion of MSEK or treatment and prevention facility about needs of the victim in medical, social and employment rehabilitation;

- copy of the death certificate;

- the certificate of family composition of the dead with indication of persons which were in its dependence;

- copy of the certificate of birth of children;

- the certificate that the member of the family of the dead does not work and it is busy with care of his children, grandsons, brothers and sisters;
